A 1,500 SQ. FT. BUDDING ADDITION TO BE
USED FOR A TEACHER'S LOUNGE AND STORAGE
SECFION I: FINDINGS
WHWEAS, the Planning Conmission of the City of Cupertino received an
application for a Use Permit, as described on Page 2 of this Resolution;
and
WHPIH 2M' the applicant has met the burden of proof required to support
said application; and
WHEREAS, the Planning Comaissicn finds that the application meets the
followingrequirements:
a) That the use or uses are in conformance with the General Plan of the
City of Cupertino, and are not detrimental to existing uses or to
uses specifically permitted in the zone in which the proposed use is
to be located.
b) That the property involved is adequate in size and shape to
accommodate the proposed use.
c) That the proposed Use will not generate a level of traffic over and
above that of the capacity of the existing street system.
d) That the proposed use is otherwise not detrimental to the health,
safety, peace, morals and general welfare of persons residing or
working in the neighborhood of such proposed uses, nor injurious to
property and improvements in the neighborhood.
NCW, THEPEFORE, BE IT RESOLVED:
That after careful consideration of rape, facts, exhibits, testimony and
other evidence submitted in this matter, the application for Use Permit is
hereby reccmmnended for approval, subject to the oonditicns which are
enumerated in this Resolution beginning on Page 2 thereof; and
That the subconclusions upon which the findings and conditions specified
in this Resolution are based and contained in the Public Hearing record
concerning Application 42-U-87 as set forth in the Minutes of the Planning
Commission Meeting of September 14, 1987, and are incorporated by
reference as though fully set forth herein.

contained in this Resolution.
A) The lard use intensity shall be limited to an intensity that will
not generate more than 16 cre-way trips per acre at the peak
traffic hour or such other traffic constraints as may be imposed
by the current General Plan. For the purpose of the 16 cru -way
trip Traffic Intensity Performance Standard. The following
accounting of trips is hereby incorporated into the project
approval:

Following City Council approval of the subject use permit, t, the
applicant shall record a covenant to describe the trip -acre
constraint and the total number of trips allocated to the
particular development at the time of development approval. The
covenant shall be worded to suggest that future Purchasers of
properties consult the individual use permit files to obtain an
up-to-date status report of trips allocated to each particular
ply
Use Permit approval is limited to 1,500 sq. ft. addition to the
administration building of the church school for use as a teacher's
loupe and storage area.
All oonditionns of approval attached to Use Permit number 2-U-86 under
Ordinance No. 2772 shall remain in full force and effect except where
said condition conflict with the conditions enumerated in this
resolution. If a conflict results, the conditions contained herein
shall prevail.
PASSED AND ADOPTED this 14th day of September, 1987 at a Regular Meeting
of the Planning Om mission of the City of Cupertino, State of California,

II) FINDINGS
A) The Planning Commission finds that the proposed increase of 260
sq. ft. of kitchen/storage area generates an insignificant .074
trips which will not increase traffic levels or parking demand
beyond that authorized in the base Use Permit approval.
B) The proposed location is not visible to public thoroughfares and
is minimally visible to any adjoining property. Existing
Architectural character is maintained by the addition.
C) The approval action is based on Exhibits A-2 and B-1 of
Application 42-U-87 (Amended).
