SUBJECT: PLANNING COMMISSION ACTION LETTER - Application 33-U-87 (Mod.)
This letter confirms the decision of the Planning Commission, given at the regular meeting of
May 13, 1996, approving a use permit modification according to the enclosed copy of Planning
Commission Resolution No. 4705.
Please note these conditions carefully. Subsequent submittal of materials for building permits
or other entitlements will be checked for compliance with the conditions listed in the
Resolution; discrepancies may result in processing delays. Please contact our office if you
have questions about this matter.
Please be aware that an appeal of this decision can be made within fourteen calendar days of
the decision. If this occurs, you will be notified of a public hearing which will be scheduled
before the City Council.

RESOLUTION NO. 4705
OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
APPROVING A USE PERMIT MODIFICATION TO CONSTRUCT A 3,653 SQ. FT.
CLASSROOM ADDITION TO AN EXISTING CHURCH AND SCHOOL
WHEREAS, the Planning Commission of the City of Cupertino received an application for a Use
Permit, as described in Section II. of this Resolution; and
WHEREAS, the necessary public notices have been given in accordance with the Procedural
Ordinance of the City of Cupertino, and the Planning Commission has held one or more public
hearings on this matter; and
WHEREAS, the applicant has met the burden of proof required to support said application; and has
satisfied the following requirements:
1) 7-lie proposed use, at the proposed location, will not be detrimental or injurious to property or
improvements in the vicinity, and will not be detrimental to the public health, safety, general
welfare, or convenience;
2) The proposed use will be located and conducted in a manner in accord with the Cupertino
Comprehensive General Plan and the purpose of this title.
NOW, THEREFORE, BE IT RESOLVED:
�. That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this
matter, the application for Use Permit Modification is hereby approved subject to the conditions which
are enumerated in this Resolution beginning on Page 2 thereof; and
That the subconclusions upon which the findings and conditions specified in this resolution are based
and contained in the public hearing record concerning Application 33-U-87 (Mod.) set forth in the
Minutes of the Planning Commission Meeting of May 13, 1996, and are incorporated by reference
though fully set forth herein.

SECTION III• CONDITIONS ADMINISTERED BY THE COMMUNITY DEVELOPMENT OPMENT DEPT
1. APPROVED EXHIBITS
The recommendation of approval is based plan sheets 0, 1, 5 and 6, dated 4/15/96.
2. STAGE LOCATION
A use permit modification shall be approved prior to relocation of the stage.
3. TRASH CONTAINER
The trash container located near the north driveway shall be removed and relocated to the
southwest comer of the property. The detailed landscaping and enclosure plans for this area shall
be approved by staff at the building permit stage.
4. FIRE SPRINKLER SYSTEM
An approved automatic fire sprinkler system shall be provided throughout all portions of the
building.
5. PREVIOUS CONDITIONS
All previous conditions previously imposed shall remain in full force and in effect except as
modified herein.
