De Anza Boulevard CSJPE'RTINO, CALIFORNIA 95014 RESO=CK NO. 3070 OF THE PLANNING Ct1*MWICN OF THE CITY OF CUPERITNO 1'ECCMKE2Mn4G MTIAL OF A USE PERMrr TO OPERATE AN EXISTING SERVICE S=CN ON A 24 HOUR A DAY BASIS VaMMA4, the Planning Omission of the City of Cupertino has received an application for a Use Permit, as described on Page 2 of this Resolution; and • WHEREAS, the necessary notices have been given in acoordance with the Procedural ordinance of the City of Cupertino, and the Planning ommission has held one or more Public Hearings on this matter; and WHEREAS, the Planning Oommission makes the following findings in regards to this application: 1) The project may result in noise disturbances which will affect adjacent residents during sleep hours. 2) The proposal oonflicts with the General Plan which requires protection of residential areas which adjoin ccamercial sites frcu noise. 3) The use may be detrimental to the safety, peace, and general welfare of persons in the neighborhood. 4) The reccumendation for denial is consistant with Planning Cmmdssicn • and City Council policy to dissapprove 24 hour operations which are located in close pradmity to residentIally zone and developed ply. That after careful consideration of maps, facts, e;diibits, testimony and other evidence submitted in this matter, the application for Use Permit is hereby rec®erxW for denial by the City cmuril of the City of Cupertino; and BE IT FiJFZ3M RESOLVED That the subconclusicns upon: which the findings specified in this Resolution are based are contained in the Public Hearing record concerning Application 32-TJ-87 as set forth in the Minutes of the Planning cams ion meeting of August 10, 1987 and are incorporated by reference as though fully set forth herein.
