FINDINGS:
1) Reduction of the northerly setback is predicated on the assumption that the subject site,
and the project approved on the adjacent site to the north will be built simultaneously,
obviating the need for a maintenance corridor.
2) The requested changes constitute a minor modification of the approved Use Perrnit as
provided in Condition 15 of 23-U-87, since there will be no Increase in building area or
distribution of floor space.

CONDITIONS:
Condition 20 of Use Permit 23-U-87 is hereby amended as follows:
20) MAINTENANCE OF NORTH WALL
The site plan shall be adjusted to provide 12-18 inches of setback from the North
property line Of the building is constructed independently of the Identical structure
approved under Application 40-1-1-87. If the building is constructed simultaneously with
the building approved for the adiacent site to the North, said setback mayrange from 0 -
3 inches. The Developer may adjust the setbacks slightly on Pasadena Avenue and
Granada Avenue to accommodate the planned square footage. The setback
adjustment shall be subject to staff approval at the building permit stage. In aeu of this,
the applicant may obtain a building maintenance easement from the adjacent property
owner.

1. STREET WIDENING
Street widening, improvements and dedications shall be provided in
accordance with City Standards and specifications as required by the
City Engineer (per Monta Vista Design Guidelines).

Curbs and gutters, sidewalks and related structures shall be installed
in accordance with grades and standards (per Monta Vista Design
Guidelines) as specified by the City Engineer.
3. STREET LIGHTING INSTATdA%ION
Street lighting (per Monta Vista Design Guidelines) shall be installed
and shall be as approved by the City Engineer. Lighting fixtures
shall be positioned so as to preclude glare arra other forms of visual
interference to adjoining properties, and shall be no higher than the

4. FIRE HYDT2APlP
Fire hydrants shall be located as required by the City.
5. TRAFFIC SIGNS

be of a type approved by the City (per Monta Vista Design Guidelines).
7. GRADING
Grading shall be as approved and required by the City Engineer in

Drainage shall be provided to the satisfaction of the City Engineer.
Surface flow across public sidewalks may be allowed in the R-1, R-2
and R-3 zones unless storm drain facilities are deemed necessary by
the city Engineer. Development in all other zoning districts shall be
served by on site storm drainage facilities connected to the City
storm drainage system. If City storm drains are not available,
drainage facilities shall be installed to the satisfaction of the City
Engineer.
The developer shall comply with the requirements of the Underground
Utilities Ordinance No. 331 and other related Ordinances and
regulations of the City of Cupertino, and shall coordinate with
affected utility providers for installation of underground utility
devices. The developer shall submit detailed plans showing utility
underground provisions. Said plans shall be subject to prior approval
of the affected Utility provider and the City Engineer.
10. MWSFORh1ERS
Electrical transformers, telephone vaults and similar above ground
equipment enclosures shall be screened with fencing and landscaping or
located underground such that said equipment is not visible from
public street areas.
The developer shall dedicate to the City all waterlines and
appurtenances installed to City Standards and shall reach an agreement
with San Jose Water Works for water service to the subject
development.

13. USE LIMITATIONS — (GENERAL CIMJERCIAL)
Permitted uses for the non residential space may include all uses
allowed without the securing of a Use Permit in the City of Cupertino
CG (General Ccmmnexcial) zoning district. All other uses requiring Use
Permit review in the CG zone shall require Use Permit review.
14. CONSOLIDATE PARCELS
The applicant shall consolidate all existing parcels into a single
lot.
15. )EDIFICATION OF APPROVED DEVEMPMD" PLAN
In the event that the applicant or subsequent property owner shall
desire to make any minor changes, alterations or am xdrient of the
approved development plan, a written request or revised development
plan shall be submitted to the Director of Planning and Development.
If the Director makes a finding that the c cages are minor aril do not
result in a material affect upon and appearance or function of the
project, said changes may be certified on the revised plan. If
approval of said changes is withheld, the applicant may appeal to the
Planning C=mission.
If the Director finds that the requested charges are material, such
changes shall be referred to the Planning Commission for approval. If
the charges are denied by the Planning Commission, the applicant may
appeal to the City Council as provided in City Ordinance No. 652.
If said charges are approved by the Planning Commission, an appeal may
be made to the City Council by any interested party. Further, any
member of the City Council may request a hearing before the City
Council regarding said approved changes. Said request shall be made
within ten (10) days from the date of approval of said charges by the
Planning Commission.
16. LANDSCAPE AND COLOR RE -
on -site landscaping and building colors shall be subject to informal
ASAC review and approval prior to issuance of occupancy pormits or
building final.

access easement with the adjoining property owner(s) when said
property owner(s) are obligated to participate in a similar

Pasadena Avenue, Granada Avenue and imperial Avenue.
18. PROPERTY USE OONSIRAIIT15
The approval is granted to develop the site to a mixed use totaling
3,650 sq. ft., more or less, consisting of at least 130 sq. ft. of
commercial space, 1,500 sq. ft. of office and three (3) apartment
units encompassing 2,000 sq. ft. The 1,500 sq. ft. of office space
may be used for retail uses consistent with condition 13.
19. PARKIIIG
n1ree (3) covered parking spaces adjacent to the building shall be
designated specifically for the apartment units and shall equal a
standard 9 ft. x 18 ft. size. The setback on Granada Avenue may be
reduced slightly to a000mmodate this requirement. Additionally, the
applicant shall either use the 224 sq. ft. upstairs office for
residential purposes or designate an additional 285 sq. ft. of office
space for retail commercial uses.

SECTION I: FINDINGS

This letter will confirm the decision of the Architectural and Site Approval
Committee given at its regular meeting of August 8, 1988. The landscape plan
was approved with the following modifications:
1. Trees along the Granada Avenue frontage shall be Pyrus kawakamii
(Evergreen Pear). One additional tree shall be added along the frontage.
2. The tree at the corner of Granada and Pasadena Avenues shall be a Gingko
biloba "Fairmount".
3. The two parking area trees shall be Quercus agrifolia (Coast Live Oak).
4. ASAC encouraged you to consider an alternate shrub species for the
Nandina domestica (Heavenly Bamboo) proposed in the parking areas.
The decision of the Architectural and Site Approval Committee is final unless
appealed within five working days to the City Council. Please give me a call if
