RECOMMENDING AMFNEM?r TO THE FLOOR AREA RATIO TRANSFER
MANUAL TO INCORPORATE A FLOOR AREA RATIO POLICY
APPLYING TO EXTRAORDINARY USES
FINDINGS:
1.
The Floor Area Ratio was incorporated into the General Plan to
limit traffic intensity and control the intensity of building
forms throughout the camunity.
2.
Sane extraordinary uses generate traffic irrespective of the
ratio of building area to lard area. In some cases, the traffic
generation characteristics may'W significantly over estimated or
under estimated.
3.
The Commission specifically finds. that a Floor Area Ratio Policy
is necessary to better implement the intent of the General Plan
toward minimizing and controlling overall traffic flow in the
areas regulated by the Floor Area Ratio Policy.
4.
The Floor Area Ratio Transfer Manual is renamed Floor Area Ratio
Policy Manual.
FLOOR AREA RATIO POLICY:
1.
EXZRAORDINARY USE DEFINED
Extraordinary uses are uses which do not exhibit a reasonable
relationship between the building area and the amount of traffic
generated during the peak traffic hour.,.A reasonable amount of
traffic expected to be generated by any use is approximately 16
one-way weekday/evening peak hour trips per acre consistent with
that policy applied under the City.of Cupertino Traffic Intensity
Performance Standard. Typically, extraordinary uses include uses
with unusual site area requirements, or unusual -building area
requirements. Use characteristics may include traffic levels
based upon other on -site facilities not related to the building
area such as service stations, amusement parks. Examples of
extraordinary uses include the following:
a. Auto sales lots.
b. Service stations.
C. Theaters.
d. Furniture Stores.
e. Fast Food Restaurants.
f. Amusement Parks.
g. Convenience Stores.

The Planning Commission finds that it is not possible for the
City to document or anticipate all uses which may fall into the
above categories. Accordingly, the City shall require a separate
traffic analysis detailing the ACT and peak hour one-way trip
traffic generated by the use for all uses which have
extraordinary building area requirements relative to traffic
generation. In such cases, the total amount of traffic should
generally not exceed a ratio of 16 one-way trips per acre during
the peak traffic hour.

TRAFFIC ANALYSIS - EfiIW..ORD=y STTE AREA REQUg2II4EN CS
For uses which generate traffic based on other use
characteristics not related to the building area such as service
stations, auto lots with auxiliary uses, amusement parks, etc. A
separate traffic analysis shall --also be required to verify the
trip generation characteristics per acre. In general, the
traffic generated per acre should not exceed 16 one-way peak hour
trips.
4.
DIVFIiI'ED SIDE TRIPS
Trips which are diverted side trips from the major roadways may
be discounted where it can be demonstrated that said diverted
side trips are not generated anew as a result of the specific
use. The overall traffic generation net of diverted side trips
shall be reasonably close to 16 one-way peak hour trips per acre.
