January 4, 1988 at which the following staff recormrien ation was approved
in the regard to the acquisition of an aerial 'ladder truck:
The City Attorney was authorize to prepare an agreement between the City
and Central Fire District based upon the following' stipulations, said
agreement to be executed by the City manager.
1. That the City of Cupertino shall be the beneficiary of a letter of
credit or directly receive a deposit for $150 000 from each applicant
(R=vatheus and Marriott). The interest earned on said money between
the date of deposit and the date of execution of the purchase contract
for the vehicle will be assigned to each developer.
20 That the City Manager be authorized to review the final contracted
cost of the fire truck to ensure ccupliance with the intents of the
condition which provides that each applicant pay no more than $150,000
or not to exceed 1/3 of the total cost of the fire truck.
3. That the aerial ladder truck be normally stationed in a manner which
would meet the intended need to suppress high rise fires in Cupertino
and that the fire truck not be viewed, as a replacement to allow other
existing aerial ladder trucks to be located elsewhere within the
district.
4 0 That the fire truck be use in an .it OUs der in
conjunction with the icy of either of the multi -story
structures. If the fund are not conitted within 5 yearn of receipt,
they shall be refunded to then existing property owners.
50 That the City of Cupertino will receive 2/3 of the then current value
of said fire apparatus if the City creates its own fire agency.
