RECOMMENDING APPROVAL OF A USE PERMIT TO CONVERT AN
(IV EXISTING 1 ,000 SQ. FT. SINGLE-STORY HOUSE INTO A
1 ,750 SQ. FT. TWO-STORY OFFICE BUILDING.

FINDINGS AND SUBCONCLUSIONS:
Approval is subject to the findings as set forth on Page 1 and
the subconclusions as set forth in the minutes of the Planning
Commission meeting of July 22, 1985.
CONDITIONS:
• 1-15. STANDARD CONDITIONS
Standard Conditions to the extent that they do not
conflict with the special conditions enumerated herein.
In the event a conflict does exist, the special
conditions as enumerated herein shall apply.
• 16. APPROVED EXHIBITS
That the recommendation of approval is based on Exhibits
A 2nd Revision (Alternative 1) and B 1st Revision of
Application 21-U-85 except as may be amended by special
conditions enumerated herein.
17. USE LIMITATIONS
The subject approval permits the proposed .structure to
be used for office activities only. Other uses, such as
commercial uses, are not permitted.
le. PARKING
Parking shall be provided at a ratio of 1 space for
every 285 sq. ft. of gross floor area.
19. SQUARE FOOTAGE
The applicant shall reduce the proposed office building
' to approximately 1 ,750 gross sq. ft.

20. JOINT DRIVEWAY
111 The applicant shall sign an agreement to participate in
a joint driveway easement with the adjoining easterly
property owner at such time as in the future as said
adjoining property owner is obligated to participate in
a similar agreement. The intent is that the applicant
and adjoining property owner share a driveway in the
future which extends from Granada Avenue to parking
located at the rear of the properties.
21. STREET LIGHTS
Street lights shall be consistent with the standards
outlined on Page 24, Section 12a of the Monta Vista
Design Guidelines.
22. MODIFICATION OF THE APPROVED DEVELOPMENT PLAN
In the event that the applicant or subsequent property
owner shall desire to make any -minor change, alteration
or amendment in the approved development plan or
building permit, a written request and revised
development plan or building permit shall be submitted
to the Director of Planning and Development. If the
Director makes a finding that the changes are minor and
do not affect the general appearance of the area or the
• interests of owners of property within or adjoining the
development area, the Director may certify the change on
the revised plan. If such approval is withheld the
applicant may appeal to the Planning Commission. If the
changes are material , the Director shall submit said
changes to the Planning Commission for approval . If the
change is denied by the Planning Commission, the
applicant may appeal to the City Council as provided in
Ordinance 652 of the City of Cupertino. If the change
is approved, an appeal my be made by an interested
party. Further, any member of the City Council may
request a hearing before the City Council , said request
to be made within ten (10) days from the date of
approval - when the change has been approved by the
Planning Commission.
2 . LANDSCAPING AND MAINTENANCE AGREEMENT
The applicant shall prepare and implement a coordinate
landscaping plan involving landscaping beds adjoining
the common property line for the property located to the
west of the project site. The coordinating landscaping
plan shall involve the removal of a fence line and the
extension of the landscaping bed as illustrated on
Exhibit A 1st Revision, Alternative 1 by approximately 2
410 ft. into the applicant 's project site. The curb for the
2 ft. extension will act as a wheel stop for parked
cars.

The applicant shall omit a written agreement between the
property owners for the property to the west and the
applicant 's site guaranteeing that the common property
line would be kept clear and free of fencing and jointly
maintained based upon an agreed upon maintenance
responsibility. The intent of the Condition is to
provide a landscaped bed separating parking for the
applicant 's project and the adjoining project t❑ the
west. The City staff shall the authority to approve the
landscaping plan and aforementioned letter of agreement-
The applicant shall attempt to coordinate a landscaping
plan with the property owner to the south whereby
additional trees and other landscaping materials could
be planted on the southerly property. The City staff
shall determine if reasonable attempt was made to
accomplish the off-site landscaping.

meeting of the Planning Commission of the City of Cupertino,
