California 9501S This will confirm the action by the City Council at their meeting of . May 21, 1984 at Which your Application 2-Z-84 was approved per Planning Commission Resolution No. 2498. First reading of Ordinance No. 1269 rezoning approximately .68 acre located on the south side of Silverado Avenue was held. Second reading and enactment are scheduled for the meeting of June 4, 1984. The ordinance becomes effective 30 days after enactment. Application 3-U-84 was approved per the following conditions: 1-14. Standard Conditions Standard Conditions to the extent that they do not conflict with the special conditions contained herein. In the event a conflict does exist, the special conditions as enumerated herein shall apply. 15. Exhibits The approval is based upon Exhibits A, A-1, B and C of Application 3-U-84 as may be amended by additional conditions contained herein. 16. Aooroved Uses The approval is for a maximum of 11, 482 sq. ft. two-story office building. The allowed uses may include general, administrative and industrial administrative offices but shall specifically preclude manufacturing uses. All new uses or change in use which are not reflective of the office uses shall require use permit review as determined by the Director of Planning. Prototype research and development activity is permissible if conducted in consort with office functions of a business establishment. Prototype "R and D" activity shall be regulated in accordance with guidelines specified in the General Plan. 17. Reciprocal Ingress/E¢ress The applicant shall record a covenant agreeing to enter into reciprocal ingress/egress easements with the adjoining commercial center to the south across the parking area on Site B. The City has a similar agreement placed on the approval of an application on the adjoining center. Installation of the ingress/egress driveway shall not take place unless and until Silverado Avenue is closed off at the southerly property line of the subject property, thereby separating the residential area from intrusion by commercial traffic. 18. Landscaping The site plan shall be modified to eliminate parking spaces No. 1, 17, 18 and 33 which shall be planted with landscape materials. Additionally, the sidewalks treatment along Silverado Avenue shall conform with City Standard Details requiring a 5 ft. monolithic sidewalk. The 5 ft. area behind sidewalk shall be planted in landscaping. The modified landscaping plan shall be subject to informal review and approval of the Architectural and Site Approval Committee. 19. Privacy Impacts The trellis attachment along the east side of the building shall be modified to incorporate a vertical screen to shield direct views from the second story offices into the yards of the adjoining single—family homes. 20. An 8 ft. masonry wall measured from the residential property to the east shall be constructed along the easterly property line to be stepped down in height as it approaches the front property line. 21 Modification of the Aporoved Development Plan or a 6uildinR Permit In the event that the applicant or subsequent property owner shall desire to make any minor change, alteration or amendment in the approved development plan or building permit, a written request and revised development or building permit shall be submitted to the Director of Planning and Development. If the Director of Planning and Development makes a finding that the changes are minor and do not affect the general appearance of the area or the interests of owners of property within or adjoining the development area, the Director of Planning and Development may certify the change on the revised plan. If such approval is withheld, the applicant may appeal to the Planning Commission. If the changes are material, the Director of Planning and Development shall submit' the change to the Planning Commission for approval. If the change is denied by the Planning Commission, the applicant may appeal to the City Council as provided in Ordinance 652 of the City of Cupertino. If the change is approved,' an appeal may be made by an interested party. Further, any member of the City Council may request a hearing before the Council, said request to be made within ten (10) days from date of approval - when the change has been approved by the Planning Commission. 22. Trash Enclosure The trash enclosure located at the southeast corner of the property shall be relocated into the parking area of Site A as identified on Exhibit A, subject to the review and approval of the staff at the building permit level. The expiration date for the use permit is May 21, 1986 (see Section 6.4 of Ordinance No. 652 as revised by Ordinance No. 1136). Council also approved a Minute Order to ASAC requiring sufficient planting and screening in the rear yard, and requested staff to contact the owners of De Anza Square Shopping Center regarding dumpsters and fencing on the adjacent site.
