Subject: REPORT OF DIRECTOR'S DECISION REGARDING PLANNING APPLICATIONS
Chapter 19,13 of the Cupertino Municipal Code provides for administrative approval
• of minor changes in projects. The Director reports his decision to the City Council
and Planning Commission in time to allow any Councilmcmbcr or Planning Commissioner
to appeal the decision.

Description
Request to allow the replacement of l9potted Privet Trees with 24-inch box New Zealand Christmas
Trees on a one for one basis in front of the Dc Anza Plaza Office Building (N2) in order to upgrade and
enhance the appearance of the property. The Privets arc in a state of decline and the pots were not
adequately plumb to permit adequate irrigation. The proposed trees would add some seasonal color to this
property.
Action
The Director of Community Development deemed the modification minor and approves the change on
October 29, 1993. The fourteen working day appeal period expires on November 18, 1993.

Subject: Landscape Renovation Plans
Dear Colin:
In reference to our telephone conversation last Friday, we have amended our
landscape renovation drawings to include additional clarification notes
regarding the existing irrigation system to remain in place and existing
landscape areas that are to remain intact.
As we discussed over the phone, the intent of this landscape renovation
is to upgrade and enhance the appearance of the property, provide predominantly
perennial flowering color in the existing concrete pottery, and replace the
existing Privet trees in pottery along De Anza Blvd. and adjacent to building
two. These 4" to 6" dia. Privets are in a state of decline partially due to
• neglect, some frost damage, and the pottery was never installed in a proper
plumb manner. Since the pots were never leveled prior to tree installation,
the tree were not being uniformly watered by the existing irrigation bubblers.
our intent is to replace the existing declining Privet trees with another
flowering, evergreen tree that would provide some color interest into the
fall and early winter months. After eliminating all deciduous flowering trees
(about 95% of California's ornamental trees!), and disregarding others that
are susceptible to fire -blight, we selected Metrosideros excelsus, New Zealand
Christmas Tree. This tree meets our requirements and has performed very well
in the South Bay area according to our own experience, conversations with a
local nursery (A to Z Nursery on Saratoga -Sunnyvale Road), and discussions
with landscape contractors.

Cupertino Municipal Code Section 19.132, the Director of Community Development Itas deemed your
request minor and has approved your request to replace the k;Wpottcd Privet Trees with 24" box New
Zealand Christmas Trees on a one for one basis. As the discussed, the renovation of the balcony
landscaping and triangular turfarca are not covered by this administrative approval and will be subject to
a separate site approval by the Planning Commission.
