applications per Planning Commission Resolution No. 4465 with the following conditions:

2. APPROVED USE
Approval is granted to conduct a Monday through Saturday higher education facility

3. ENROLLMENT LIMITATION
The tenant shall not exceed an enrollment of 145 students. The hours of operation
shall not exceed 10 p.m., Monday through Friday and 6 p.m. on Saturday.
The property owner shall enter into a private agreement with the adjoining parcel
west for reciprocal parking. The agreement shall run with the land and shall be
recorded prior to occupation by the school.

All Sanitary District fees and other requirements shall be completed and proof
provided to the Building Department prior to occupation.
11. CENTRAL FIRE
Submittal of building and floor plans shall be submitted and approved prior to
occupation with plans provided to the Building Department.
12. SIGNAGE
All signage must conform to the approved sign program.

for clarification. Failure to incorporate conditions into your plan set will result in
delays at the plan checking stage. If development conditions require tree

SECTION 1: FINDINGS
WHEREAS, the Planning Commission of the City of Cupertino received an application for a Use Permit, as
described on Page I of this Resolution; and
WHEREAS, the applicant has met the burden of proof required to support said application; and
WHEREAS, the Planning Commission finds that the application meets the following requirements:
a) That the use or uses are in conformance with the General Plan of the City of Cupertino, and arc not
detrimental to existing uses or to uses specifically permitted in the zone in which the proposed use is to be
located.
b) That the property involved is adequate in size and shape to accommodate the proposed use.
c) That the proposed use will generate a peak trip rate above the 14.4 peak hour trips assigned to the site. The
increase will not change the level of service on the adjoining roadways and is not considered a significant
increase above that which is assigned to the site.
d) That the proposed use is otherwise not detrimental to the health, safety, peace, morals and general welfare of
persons residing or working in the neighborhood of such proposed uses, nor injurious to property and
improvements in the neighborhood.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this matter, the
application for Use Permit is hereby recommended for approval, subject to the conditions which are enumerated in

APPLYING TO EXTRAORDINARY USES
FINDINGS:
1. The Floor Area Ratio was incorporated into the General Plan to
limit traffic intensity and control the intensity of building
forms throughout the community.
2. Some extraordinary uses generate traffic irrespective of the
ratio of building area to land area. In some cases, the traffic
generation characteristics may be significantly over estimated or
• under estimated.
3. The Commission specifically finds that a Floor Area Ratio Policy_
is necessary to better implement the intent of the General Plan
toward minimizing and controlling overall traffic flow in the
areas regulated by the Floor Area Ratio Policy.
4. The Floor Area Ratio Transfer Manual is renamed Floor Area Ratio
Policy Manual.
FLOOR AREA RATIO POLICY:
1. EXTRAORDINARY USE DEFINED
Extraordinary uses are uses which do not exhibit a reasonable
relationship between the building area and the amount of traffic
generated during the peak traffic hour. A reasonable amount of
traffic expected to be generated by any use is approximately 16
one-way weekday/evening peak hour trips per acre oansistent with
that policy applied under the City.of Cupertino Traffic Intensity
Performance Standard. Typically, extraordinary uses include uses
with unusual site area requirements, or unusual building area
requirements. Use characteristics may include traffic levels
based upon other on -site facilities not related to the building
area such as service stations, a:misemrnt Parks. Examples of
extraordinary uses include the following:
a. Auto sales lots.
b. Service stations.
C. Theaters.
d. Furniture Stores.
e. Fast Food Restaurants.
f . Amusement Parks.
g. Convenience Stores.

4. DIVF= SIDE TRIPS
Trips which are diverted side trips fram the major roadways may
be diso=mted where it can be demonstrated that said divested
side trips are not generated anew as a result of the specific
use. The overall traffic generation net of diverted side trips
shall be reasonably close to 16 one-way peak hour trips per acre.

Four letters in support of the application were submitted (enclosed).
Staff
A fourteen (14) parking space deficit would be created by the proposed use. The 4,400 sL of remaining office use
typically vacates at 5:00 PM, which would make available fifteen parking spaces for the night school students
beginning classes at 6:00 PM. Instead of deed restricting the parcel to require the 4.400 sL of office users to vacate
the property at 5:00 PM, staff has created a condition requiring a parking agreement with the adjoining property
located to the west. The adjoining parcel located to the west has an excess of 34 parking spaces, making this
solution fcasiblc.
The proposed use will generate 120 vehicle trips during the later portion of the peak hour and will be split equally
(60 trips) on each direction of Stevens Creek Boulevard. This exceeds the 14.4 peak hour trips assigned to the site
by 46 trips. The Traffic Division completed a computer analysis of the roadway impacts and no change to the level
of service on Stevens Creek Boulevard, Blaney Avenue and Randy Lane will result.
The recently adopted General Plan, Policy 2-3 (page LU-6) indicates that socially beneficial development may be
allocated additional vehicle trips if they are evaluated and mitigated, if necessary. The proposed use offers an
after -work, higher education degree program which is an "extra" ordinary use and is beneficial to our existing
employee base.

Planning Commission
Commissioner Bautista and Chairwoman Austin were in support of the application regardless of the peak hour
trips because the General Plan Traffic Model has some flexibility built into it. Further, the vehicle trips would be
equally split on both sides of Stevens Creek Boulevard with no change to the level of service on Stevens Creek
Boulevard and ollter adjoining roadways. Commissioner Bautista indicated that the application would not be
precedent setting because the use is so unique. Also, the benefits of the use outweighs the impacts created. It was
also indicated that the annual Congestion Management Agency trip analysis would be an adequate check and
balance of the Generat Plan Transportation goals.
Commissioner Doyle opposed the application because the added trips arc in excess of the trips projected for the site
by the Cenral Plan transportation computer model. Further, the approval would be precedent setting.
Commissioner Doyle's solution was to condition this application to schedule classes after the 5:00 p.m. to 6:00
p.m. peak hour. The applicant said that a 6:15 p.m. or 6:30 p.m. start time would not work because students do
not want to stay in class beyond 10:00 p.m.
