RECOMMENDING APPROVAL OF A USE PERMIT TO CONSTRUCT A
CON^1ERCIAL OFFICE BUILDING TOTALING APPROXIMATELY
8,500 SQ. FT. OF GROSS FLOOR AREA AND TO DEVELOP A
PARKING LOT FOR PROPERTIES FRONTING THE SECTION OF
ALRAMBRA AVENUE LOCATED SOUTHERLY OF ITS INTERSECTION
WITH SANTA CLARA AVENUE.

FINDINGS AND SUBCONCLUSIONS:
•Approval is recommended subject to the findings as set forth on Page 1. and
subconclusions as set forth in the minutes of the Planning Commission meeting
of October 8, 1979.
CONDITIONS:
1-14. Standard Conditions to the extent that they do not conflict with the special
conditions enumerated herein. In the event a conflict does exist, the special
conditions as enumerated herein shall apply.
15. The approval is based upon Exhibits A, A-1 and B of Application 23-U-79 as
may be clarified and amended by additional conditions contained herein.
16. The approval is for commercial and/or commercial office uses for the project
area as defined by Tentative :lap Application 21 -TM -79. For the purpose of
clarification, the use permit approval includes the existing cocktail lounge
use located on Parcel 3 of said map.
The intensity of each use on each parcel shall be determined by the available
number of off-street parking stalls located on each parcel. The parking ratio for
commercial and office use is one parking space for each 130 sq, ft. of
gross building square footage. The parking requirement for a cocktail lounge
is one space for each employee during a maximum employment shift and one space for
each four seats.
17. The approval. is granted contingent upon the annexation of affected properties
into the -City.of Cupertino -.end -.a., subsequent.. City Council approval to abandon
Alhambra Avenue southerly of its intersection with Santa Clara`Avenue:
18. The approval. is predicated upon the recordation of a final map for Tentative
Map Application 21 -TM -79.
19. The parking spaces, parking lot circulation areas, and necessary drainage and
landscaping improvements designated on Exhibits A and A-1 shall be installed
concurrently with the construction of the commercial office development on
Lot 1 of Application 21 -TPI -79.

20. The parking lot and circulation improvements for the 40 ft. wide Peninsula
Boulevard right of way in front of the project site may be deferred until
Peninsula Boulevard is abandoned and agreements are completed and signed
providing for a parking improvement plan. The degree of improvements and
pro rated costs shall be approved by the City Council in conjunction with
an abandonment hearing.
21. A reciprocal off-street parking and circulation easement including a provision
for maintenance, shall be executed by the property owners of Lots 1, 2 and 3
of Tentative Map Application. 21 -TM -79.

ABANDONMENT OF RESIDUAL RIGHT OF WAY FOR THE FORMERLY
USED RIGHT OF WAY OF PENINSULA AVENUE TO BE CONSISTENT
WITH GENERAL PLAN.
