RESOLUTION NO. 1628
OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
4 GRANTING A NINE (9) MONTH EXTENSION OF USE PERMIT
APPLICATION 30-U-74 REGARDING THE TEMPORARY USE OF
A SERVICE STATION FOR A RETAIL TIRE OUTLET.
The use permit extension is granted contingent upon
the conditions enumerated by Planning Commission
Resolution No. 1367 with Condition No. 16 modified
to limit the use permit approval to a nine (9) month
period.

LOCATION: Southwest corner of the intersection of Stevens Creek Boulevard
and Pasadena Avenue
CONDITIONS:
1-14. Standard Conditions to the extent that they do not conflict with the
special conditions enumerated herein. In the event a conflict does
exist, the special conditions as enumerated herein shall apply.
15. That the approval is based upon Exhibit A of 30-U-74 as may be
modified by conditions contained herein.
® 16. That the use of the property for a retail tire sales operation shall
be limited to a nine (9) month approval from the effective date of
this use permit hearing. The Planning Commission shall review the
use permit upon the expiration of the nine (9) month period. The owner
and applicant shall sign a written agreement to this effect. The
purpose of this condition is to insure that the applicant and the owner
of the property are aware that the Commission's approval of the tire
sales facility is based upon a desire to allow the property owner to
utilize his property during the City's review of a specific plan for
the Old Monta Vista commercial area. The final land use plan
resulting from the Stevens Creek Plan Line studies may result in a
determination that a tire retail activity may not be appropriate for
Old Monta Vista.
17. That the Architectural and Site Approval Committee shall limit the
improvement requirements normally associated with a commercial develop-
ment with the understanding that the use is a temporary use only.
18. That—.the application involves the approval of a tire retail operation
only. All tire mounting and activities shall be conducted entirely
within the building. The applicant shall submit a tire display program
to the Architectural and Site Approval Committee for review if it
involves the display of tires on the exterior of the building.

INCONSISTENT WITH THE GENERAL PLAN.

Therefore, the Planning Commission hereby finds the use permit Application 30-U-74
which approves the temporary tire sales facility, shall expire immediately. The
li City Attorney, upon authorization by the City Manager, shall meet with the applicants
and property owners to establish a reasonable date for closure of the
temporary tire sales business.
