RESOLUTION NO. 1759
OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
RECOMMENDING THE APPROVAL OF A USE PERMIT TO ALLOW
CONSTRUCTION OF THREE COMMERCIAL BUILDINGS, CONTAINING
APPROXIMATELY 46,500 SQ. FT. , IN A P (PLANNED DEVELOPMENT) ZONE.

SUBMITTED: September 15, 1977
LOCATION: Southwest corner of the intersection of Stevens Creek Boulevard
and Portal Avenue.
FINDINGS AND SUBCONCLUSIONS:
Approval is recommended subject to the findings as set forth on Page 1 and
subconclusions as set forth in the minutes of the Planning Commission meeting
of October 24, 1977.
CONDITIONS:
1-14. Standard Conditions to the extent that they do not conflict with the
special conditions enumerated herein. In the event a conflict does
exist, the special conditions enumerated herein shall apply.
® 15. That the approval is based upon Exhibit B of Application 28-U-77 as
may be modified by additional conditions contained herein.
16. That the applicant/property owner shall enter into reciprocal ingress/
egress agreements with the adjoining Drexel Heritage Furniture Store
site.
17. That the approval is for a clothing store consisting of 14,000 sq. ft.
and fabric store consisting of 14,500 sq. ft. for Phase One and a future
commercial building which shall not exceed 18,500 sq. ft. as shown on the
approved site plan.
The applicant shall have the ability to substitute uses of a retail sales
nature in the 14,000 sq. ft. designated for a clothing store on Exhibit B.
Uses shall be restricted to those of a retail sales nature such as music
shops, record stores, office supplies, book stores, florist shops, arts
and crafts stores, and/or commercial office uses such as real estate
offices, insurance offices, etc. New uses may be permitted to occupy
the clothing store space in this project when, in the opinion of the
Planning Director, they substantially conform to the above list of
permissible uses and where it is determined that they will not exceed
a maximum trip generation rate of two trips per 1,000 sq. ft.
All changes in use which do not conform with the approved uses, or uses
designated for the future building area shall require use permit approval.

18. The land use intensity shall be limited to an intensity that will not
generate more than 16 one-way trips per acre during the peak traffic
hour. For the purpose of the 16 one-way trip Traffic Intensity Performance
Standard, the following accounting of trips is hereby incorporated into
the project approval:
Trips Generated by the Project-
Clothing Store 14,000 x 2 = 28 trips
Fabric Store 14,500 x 2 = 14.5
TOTAL = 42.5
Allowable trips 4.73 acres x 16 = 75.7
Trips allocated to future building area 33.2
PASSED AND ADOPTED this 24th day of October, 1977, at a regular meeting of the
Planning Commission of the City of Cupertino, State of California, by the
following roll call vote:
