U-1977-16b 16-U-77 RESOLUTION NO. 1721 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO 41) RECOMMENDING THE APPROVAL OF A USE PERMIT TO CONSTRUCT 36 SINGLE-FAMILY, DETACHED RESIDENTIAL DWELLINGS IN A P (PLANNED DEVELOPMENT ZONING DISTRICT) APPLICANT: B.A.S. Homes, Inc. ADDRESS: 20823 Stevens Creek Boulevard, Suite .C-2, Cupertino; California 95014 SUBMITTED: June 24, 1977 LOCATION: Adjacent to and westerly of Foothill Boulevard opposite the intersection of Foothill Boulevard and Alpine Drive ZONE: P (Planned Development with Residential Intent) FINDINGS AND SUBCONCLUSIONS : Approval is recommended subject to the findings as set forth on Page 1 and subconclusions as set forth in the minutes of the Planning Commission meeting of August 8, 1977 . CONDITIONS : • 1-14. Standard Conditions to the extent that they do not conflict with the special conditions enumerated herein- In the eyent a conflict does exist, the special conditions enumerated herein shall apply. 15. That the approval is based upon Exhibit A 1st Revision of Application ® 16-U-77 as may be amended by additional conditions contained herein. 16 . The Architectural and Site Approval Committee shall review the final sound barrier 's location, design, and height and landscape planting materials for the landscaped setback area adjacent to Foothill Boule- vard frontage. The segment of sound barrier located north of the main entrance road shall have a height limitation based upon the relation- ship of said barrier to the finish. grade of Foothill Boulevard when improved. Said barrier shall be no higher than 3 ft. above the final sidewalk elevation of Foothill Boulevard as measured from a point perpendicular to said sidewalk. Lot 17 shall be deleted and Lots 18, 19 and 20 reconfigured to provide for additional landscaping space for the major entrance into the development. The removal of said dwelling is also prompted by its exposure to noise on Foothill Boulevard . 1.7 . The Planning staff shall review individual building plans and final grading plans for the proposed lots. The Planning staff is directed to ensure that final grading and building plans provide a minimum disruption to trees located within the proposed building envelopes and that the plans provide for a reasonable attenuation of noise emanating from motor vehicles using Foothill Boulevard. The intent is to comply with Title 25 of the California Administrative Code for interior and exterior noise levels . Due to topographical conditions, it may not be possible to fully comply with the Title 25 noise standard for exterior yards for all lots, therefore, strict complianc;e.,wi.th;..said ® standard is not required. The review may preclude the applicant from utilizing standardized building plans used on other lots within the development thereby forcing the applicant to develop a custom plan to reflect existing topography and trees. A proposed street section shown on the site plan, Exhibit A 1st Revision, is not approved. The major entrance street shall be 40 ft. from face of curb to face of curb while the secondary streets will have a section consisting of 30 ft. of pavement. The Director of Public Works may deviate from that standard in specified locations to retain trees or minimize grading. 19. All structures excluding fences and swimming pools and small accessory structures not designed for human habitation shall be within the building envelopes as defined on Exhibit A 1st Revision. 20. The applicant shall install landscaping, including an irrigation system, for the landscaped setback areas located adjacent to Foothill Boulevard as described by Exhibit A 1st Revision as may be amended by a subsequent Architectural and Site Approval Committee action. The applicant shall record a covenant binding subsequent lot purchasers to fund the long-term cost of City maintenance of said landscaping setback areas. The applicant shall deposit with the City and the City shall establish an account to fund the estimated periodic maintenance costs of said landscaping for a period not to exceed ten (10) years. The intent of the condition is for the applicant to install natural plant materials and maintain said areas until said ® landscaping is well established and relatively maintenance free. The future lot owners will be responsible for maintenance costs upon expiration of the ten (10) year period or upon exhaustion of the ten (10) year maintenance fund deposit, whichever occurs first. 21. A master television tower is not permitted. HOMES (APPLICATIONS 14-TM-77 AND 16-U-77) OF 4+ ACRES OF LAND FOR PARK/ OPEN SPACE PURPOSES. The Commission finds the proposed acquisition to be consistent with the Open Space/Conservation Element of the General Plan. Furthermore, the acquisition represents a unique contribution to the City park system because of the natural beauty of this site and the opportunity to incorporate one of the last g,r-,.ovEs•_.,of.::na-t,ive :Oaks:'located, in-:ahe.,,Va11ey..Floor into public open space.
