U-1977-12b12-U-77 RESOLUTION NO. 1703 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOM ENDING APPROVAL OF A USE PERMIT TO ALLOW CONSTRUCTION OF AN OFFICE BUILDING CONTAINING APPROXIMATELY 2,000 SQ. FT. OF SPACE. APPLICANT: Barnhart Construction Company ADDRESS: 785 Walsh Avenue, Santa Clara, California 95050 SUBMITTED: May 9, 1977 LOCATION: Northeast corner of the intersection of Valley Green and Beardon Drives ZONE: P (Planned Development) FINDINGS AND SUBCONCLUSIONS: Approval is recommended subject to the findings as set forth on Page 1 and sub - conclusions as set forth in the minutes of the Planning Commission meeting of June 13, 1977. • CONDITIONS: 1-14. Standard Conditions to the extent that they do not conflict with the special conditions enumerated herein. In the event a conflict does exist, the special conditions enumerated herein shall apply. 15. That the approval is based upon Exhibits A and B of Application 12-U-77, as may be modified by additional conditions contained herein. 16. The land use intensity shall be limited to an intensity that will not generate more than 16 one-way trips per acre during the peak traffic hour. For the purposes of the 16 one-way trip traffic intensity performance standard, the following accounting of trips is hereby incorporated into the project approval. • Trips generated by the project: Office use: 2,050 sq. ft. x 1 trip end/1,000 sq. ft. - 2 Allowable trips equals .465 x 16 - 7.4 trip ends Surplus trip ends 5.4 In the event a development does not utilize the full 16 trips per acre allotted by the trip end performance standard, the owner of record shall have the ability to either retain, sell or transfer trips with other property owners within the traffic intensity performance standard area as defined by this document. All sales or transfers of trips shall be -2- 12-U-77 Resolution No. 1703 (continued) filed with the Planning Director and City Clerk. No sale or transfer • shall be finally consummated until a use permit has been approved for the property to which the trips are to be applied. The applicant shall record a covenant to describe the trip acre constraint and the total number of trips allocated to the particular development at the time of development approval. The covenant shall be presented in a manner to suggest that the future purchaser of properties consult the conceptual zoning file, and individual use permit files to obtain an up to date status report of the total number of trips allocated to each particular property. The applicant should submit documentation from the seller of trips identified above indicating that the trips have been transferred to the applicant. 17. The applicant shall modify the parking layout to provide for a one-way exit onto Beardon Drive. The applicant shall have the ability to delete two parking spaces to accommodate this one-way drive.
