FINDINGS AND SUBCONCLUSIONS
Approval is recommended subject to the findings as set 'forth on Page 1 and
subconclusions as set forth in the minutes of the Plane _na Commission meeting
of March 14, 1977®
CONDITIONS
1-14. Standard Conditions to the extent that they do not conflict with the
special conditions enumerated herein. In the event a conflict does
exist, thespecial conditions enumerated herein shall apply -

additional conditions presented herein.
16. The land use intensity shall be limited to an intensity that will not
generate more than 16 one-way grips per acre during the peak traffic
hour. For the purpose of the 16 one-way trip traffic intensity perform-
ance standard, the following accounting of trips is hereby incorporated
into the project approval:

17. The applicant shall sign a statement with'the City which is acceptable
to the City Attorney, agreeing to provide reciprocal parking and ingress/
egress easements to the properties designated on tentative parcel map
2 -TM -77 as owned by National Life and'Accident Insurance BCompany. and
aer' Property (see Exhibit A of Application 2 -TM -77) at such time as the
City can -require the same of said property owner/s.
Additionally, the agreement shall state that the applicant will provide
reciprocal -pat, king and ingress/egress easements with the adjoining
Catholic Church property at such time as the owner of_the St Joseph's
Catholic Church dedicates and/or improves the church frontage along
North De Anza Boulevard and agrees ' to provide reciprocal parking and
ingress/egress easements to the applicant. The agree Imens_should state
that it is understood that said easements are to be mutually agreeable
to both parties® The precise location of said ingress/egress easements
with the Church property to the north and east shall be determned and
based upon future negotiations concerning an enlarged -o-wayarea
and the most logical location of major driveway entrances off of said
right®ofmwaya
18. The applicant shall have the ability to modify the site plan to
incorporate parking arranged in an east -west direction- and/or incorporate
the "Drachman" compact oar arrangement subject to the review and ;approval
by the -Architectural and Site Approval Committee. The total vehicle park-
ing spaces shall provide a minimum of 113 spaces although the Architec-
tural and Site Approval Committed shall have the ability to approve a
lesser number if it is necessary to preserve the specimen trees on site.
190 The applicant shall provide a tree preservation plan detailing the*
trees to be preserved and removed, which analyzes the impact of con-
struction and grading operations as well as future landscaping proposals
on said, trees.
The plan shall be prepared by a landscape architect or
tree srgeon in accordance with Ordinance No. 778 and shall be presented
to the Architectural and Site Approval Committee at the time.o'f the
detailed architectural and site approval plans. It is understood that
every attempt shall be made to preserve as many of the specimen trees
as possible
20. This approval is for a two-phase project which includes -a 10,000 sq. ft.
building in Phase One consisting of 4,000 sq o f t o devoted to a bank
tenant, and 6,000 sq e ft. for general office uses and 7,000 sq o ft.

understood that the Phase Two portion of this project will incorporate
architecture styling which ,is similar to the architsctural'theme proposed
on the bank/office structure of Phase One. In addition, the applicant
shall providea 50 f t o landscape setback from Stevens Creek Boulevard
in which no circulation orarking shall be

to allow the building to encroach into the 50 ft. landscape setback
provided that the overall landscaping area totals 50 sc ;f t o times street
frontage. It is anticipated . that a . site plan change may be necessary to
accommodate_ the above provisions, and that the Architectural_ and Site Approval
Committee shall have the ability to make changes in the site plan to
accommodate the above provisions and to provide for a more logical
circulation systema

21. The applicant shall dedicate and improve adequate space for a bus

turnout subject to the standards of the Department of Public Works
and the Santa Clara County Transit District. The applicant may con-
tinue to use the drive as a one-way exit onto North De Anza Boulevard
until such time as a mutual ingress/egress drive can be provided with
the adjoining service station site to the south.
