OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
GRANTING APPROVAL OF A USE PERMIT TO CONSTRUCT AND
OPERATE A 100-DWELLING UNIT FEDERALLY SUBSIDIZED
SENIOR CITIZENS AND HANDICAPPED CITIZENS HOUSING
DEVELOPMENT IN A BQ (QUASI-PUBLIC) ZONE.

LOCATION: Easterly of and adjacent to Foothill Blvd. approximately 100 ft.
northerly of the intersection of Cupertino Rd. and Foothill Blvd.
SUBFINDINGS AND CONCLUSIONS :
1. The proposed use is in conformance with general plan policy permitting an
increase in dwelling-unit density when a proposal implements a community
goal. The community goal in this instance relates to the provision of
housing for senior and handicapped citizens.
2. The site planning and architectural form of the project is compatible
with property size and configuration.
3. That the life style of the proposed residents of the development will not
exceed the design capacity of the neighborhood utility infrastructure and
® road system.
4. That the conditions of approval of the project and the project design
will ensure that the project will not be detrimental to adjoining properties.
CONDITIONS:
1-14. Standard Conditions to the extent that they do not conflict with special
conditions enumerated herein. In the event a conflict does exist, the
special conditions as enumerated herein shall apply.
15. That the application is based upon Exhibits A 1st Revision, B and B-1
as may be amended by the additional conditions contained herein. If any
conflict exists, the additional conditions contained herein shall apply.
16. That the applicant shall move the buildings in an easterly direction and/or
modify the width and grade of the private drive along the westerly property
line to increase the landscape area between the private drive and Foothill
Boulevard. The intent of this modification is to accommodate tall growing
trees of an evergreen variety to screen the building mass from Foothill
Boulevard. The ultimate location and landscape materials shall be approved
by the Architectural and Site Approval Committee with the intent of meeting
the objectives stated herein.
17. The Architectural and Site Approval Committee shall evaluate alternative
design elements to attenuate traffic related noise emanating from Foothill
Boulevard as it affects the exterior landscape areas and the interior
court areas bounded by Buildings A, B and C. The Architectural and Site
Approval Committee shall evaluate each alternative related to its effective-
ness and resultant cost.

18. The two lots located between the project site and Cupertino Road shall be
designated as a contingency parking area. Alternative plans shall be
submitted to the Architectural and Site Approval Committee illustrating
the layout of said parking lot. The owner shall sign a statement with
the City subject to the review of the City Attorney agreeing to convert
this area to the approved parking lot plans- should the City determine
that the need exists. In order to enable the property owners to plan
the property for long term use, the contingency parking lot use status of
the lot can be reevaluated bythe PlanningCommission within eighteen

months after completion of the project.
19. The applicant shall submit plans to the Architectural and Site Approval
Committee illustrating the location of existing trees on site and shall
present a detailed plan illustrating how they intend to preserve the
specimen trees during and after construction.
20. The applicant recognizes that this use permit is granted for a Federally
subsidized low/moderate income senior citizen and handicapped housing
project and that at no time in the future shall the use or occupancy
be modified without first receiving approval from the City Council of
the City of Cupertino.
21. That the applicant shall utilize 3/16 inch glazing on all of the windows
within 150 ft. of the center line of Foothill Boulevard which face or
have a view of the roadway, as per the recommendation on Page 4 of the
• acoustical report by Edward L. Pack, dated December 27, 1976.
22. That the applicant shall provide a bus stop shelter as per the suggestion
on the letter from the Santa Clara County Transportation Agency dated
December 16, 1976. The shelter shall be located on the subject property
or the parcel located to the south. The applicant shall dedicate the
additional right of way necessary to accommodate the shelter. The
shelter design shall be approved by the Architectural and Site Approval
Committee. The applicant and the City staff shall review the possibility
of partial or total funding for the shelter from the Santa Clara County
Transit District or through Housing and Community Development Act funds.
23. All incidental commercial activities shall be limited and oriented to the
Sunny View West and Sunny View Manor projects only. No signing from such
incidental commercial uses shall be visible from a public street.
24. The landscape planter area along the northerly property line shall be
increased to a minimum of fifteen (15) feet.
25. The Architectural and Site Approval Committee shall have the ability to
slightly modify or relocate the number of on-site parking spaces to
accommodate the landscape area provided for in Condition No. 24 and/or
improve the visual relationship between the project and residents on
Salem Drive.
26. The parking area on the north side of the project (adjacent_ to Salem
Drive properties) shall be limited to residence parking only. The
parking area and access drives will be labeled to prohibit guest and
vehicular traffic and parking in the aforementioned area. Refuse pickup

containers shall be moved from the easterly location of the northern
most building to the western end of said building.

the Planning Commission of the City of Cupertino, State of California, by
the following roll call vote:
