OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
APPROVING A USE PERMIT TO CONSTRUCT A "FAST FOODS"
40 'RESTAURANT IN A GENERAL COMMERCIAL ZONE

and Stelling Rd.

CONDITIONS AND FURTHER FINDINGS:
1-14. Standard Conditions to the extent that they do not conflict with the
special conditions enumerated herein. In the event a conflict does exist,
the special conditions as enumerated herein shall apply.
15. That the approval is based upon a 25-ft. minimum building setback from
the north property line. The building shall be oriented to the front of
the property and that there shall be a minimum of twenty-two (22) park-
ing spaces provided.
16. That the owner shall sign a statement agreeing to participate in
reciprocal driveway easements with the surrounding parcels. Said.
statement shall further agree to modify the on-site traffic circulation
® to coordinate with the circulation systems of the adjoining properties,
at such time as they are installed. The agreement shall be subject to
the review and approval of the City Attorney and shall be approved and
submitted to the Building Department prior to issuance of building
permits.
17. That the Architectural and Site Approval Committee shall review the
proposed site: layout for traffic flew, pedestrian access and traffic
collection and shall review the building to ensure that it relates to
the architectural styles of the Adamo building.
18. That this approval is for a maximum seating capacity of fifty-six (56)
including outdoor patio seating.
PASSED AND ADOPTED this 25th day of October, 1976, at a- regular meeting of the
Planning Commission of the City of Cupertino, State of California, by the fol-
lowing roll call vote:

RESOLUTION OF THE PLANNING COMMISSION OF'THE CITY OF CUPERTINO GRANTING
A USE PERMIT
I.
WHEREAS, the Planning Commission of the City of Cupertino received an
application for a USE PERMIT, as stated on Page 2; and
WHEREAS, the applicant has met the burden of proof required to support
said application; and
WHEREAS, the Planning Commission finds that the application meets the
following requirements:
a. Encourages the most appropriate use of land,
b. Conserves and stabilizes the value of property.
c. Provides for adequate open spaces for light and air,
d. Permits adequate control of fires,
e. Promotes the health, safety and public welfare,
f. Provides for the orderly development of the City, and
g. Is advantageous to the property and improvements in the zoning
district and neighborhood in which the property is located;
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps;,- facts, exhibits and other
evidence submitted in this matter, the application of the USE PERMIT be,
and the same is hereby granted, subject to the conditions stated on
Page 2; and
BE IT FURTHER RESOLVED:
That the aforementioned findings be approved and adopted, and that the
Secretary be, and is hereby'' directed to ' notify the parties affected by
this decision.
