APPLICANT: Vali Associates (Bruce Edwards) ADDRESS : 510 Madera Ave. , San Jose, California 95112 SUBMITTED: March 17, 1976 LOCATION: Southwest corner of the intersection of Mary Ave. and Freeway Rt. 280 ZONE: P (Planned Development with quasi-public use intent) ACREAGE: 4.8 acres • CONDITIONS AND FURTHER FINDINGS : 1-14. Standard Conditions to the extent that they do not conflict with the event conflict conditions enumerated herein. In the v nt a oof lict does exist, the special conditions as enumerated herein shall apply. 15. Approval is based upon site plan labeled Exhibit A of 4-U-76, as may be modified by additional conditions contained herein. 16. Permanent street improvements shall be installed from the southerly 411 property line in a northerly direction to a point on the future Mary Ave. overcrossing to be determined by the City. Any areas within the public right of way not improved for street purposes shall be devoted, to landscaping in a manner that is coordinated with the frontage landscaping of the project and approved by the Architectural and Site Approval Committee. Developer shall post bonds with the City for the remainder of the Mary Ave. street improvements along the frontage and enter into a deferred agreement to install the same. 17. A minimum setback shall be established from the back of future sidewalk on Mary Avenue of forty (40) feet. This area shall be devoted to landscape screening in a manner as approved by the Architectural and Site Approval Committee. 18. Adjacent to the southerly property line and the property line adjacent to Freeway Route 280 and the Flood Control channel, • a minimum 10-ft. setback shall be provided to be utilized for landscape screening in a manner to be approved by the Architectural and Site Approval Committee, or landscape screening may be provided on State property adjacent to the Freeway Route 280 in a manner as approved by the Architectural and Site Approval Committee. 410 19. That no structure on the site shall exceed one story in height or a maximum of twelve (12) ft. except for architectural facilities as approved by the Architectural and Site Approval Committee. -2- 4-U-76 • Resolution No. 1511 (continued) 410 20. That the use permit is granted for the utilization of the subject site for storage purposes only with the exception of the administrative office and that no work shall be performed on the site such as motor vehicle washing and repair, boat repair or construction. 21. The removal of any mature native trees on the site shall be subject to the review and approval of Architectural and Site Approval Committee. 22. The existing residential structure on the property shall be removed within ninety (90) days. Thirty-day extensions may be approved by the Director of Planning and Development if the removal is delayed by a governmental agency. Sisk, Planning Director DATE: April 9, 1976 SAMECT: Application 4-U-76 - Yalu Associates (Bruce Edwards) The applicant's request is for approval of a use permit to allow the construction of approximately 60,000 sq. f t. of mini storage space within a 4.8 acre panned development zoning district. The applicant's request as described by Exhibit A, 4-U-76, represents the identical plan which was reviewed and approved by the Planning Commission and City Council approximately a year a a half ago. The new application was filed because the applicant inadvertently let the use permit application expire. Recommendation It is recommended that application 4-U-76 be approved subject to the below listed conditions of approval. She conditions of approval reflect those approved in June of 1974 with the deletion of certain conditions that have been incorporated into the current site plan labeled Exhibit A, 4-p,-76. it is recommended that an additional condition be attached requiring the removal of an. existing residential structure located on the site within a 90-day period. The structure is currently involved in a County application concerning the movement of the structure to a site within old Monta Vista. The matter is currently scheduled to be heard by the Caunty's Architectural Site Control. Co=ittee in Late April. the structure is currently on blocks and represents an attractive nuisance to children living within the immediate neighborhood. IConditions of Approval 1-14.
