Application Application 5-U-74 (Modification) Siemens Corp. 19000 Homestead Road Description Request for building modifications including a change in style and materials for a small portion of the building, construction of a wall to enclose the rear delivery area, and construction of a fitness room. All architectural modifications have been reviewed and approved by the Architectural and Site Approval Committee. The applicant has made a written agreement that the fitness room will not be used for any other purposes. The floor area ratio requirement will not be exceeded and the parking requirement will not be diminished. Action The Director of Community Development deemed the modification minor and approves the change on November 5, 1992. The fourteen working day appeal period will expire November 25, 1992. The modification includes architectural modifications to the building, the addition of a fitness room at the East side of the project and a conference room on the Southwest corner of the project. The Architectural and Site Approval Committee has reviewed and made a favorable recommendation. A letter from you dated October 23, 1992 is on file in our office which states that Siemens agrees to utilize the fitness center space for that purpose only and that no other use shall be used in that area. BACKGROUND: • Under Chapter 19.132 of the Cupertino Municipal Code, the Director of Community Development may deem a change in a project to be minor and thus be eligible for an administative approval. At his discretion, the Director may refer an eligible change to the Planning Commission for a recommendation on architectural changes. In this case, the Director has deemed that the subject changes in the project are minor and is referring the application to the Planning Commission for architectural review. DISCUSSION: Siemens Components requests approval to add 955 square feet to an existing office building. According to Planning Department records the property had achieved a development intensity of .33 FAR. The current General Plan limits office and industrial areas to a .33 FAR. In order to continue with their plans to add 955 square feet, policies in the Development Intensity Manual regarding amenity space need to be utilized. According to the Development Intensity Manual, amenity space such as a cafeteria, fitness room, or an atrium which is not used for office space is not counted as floor area. Siemens has demonstrated that they can remain under the .33 FAR by designating 7,351 square Iccl of the total building area (99,985 s.f.) as amenity space. Included in the 7,351 s.f. is the cal'cteria, a breezeway which doubles as a lounge, a fitness center and the cafe patio. Architectural features: The additional space provides a more symetrical looking building, as well as more architectural interest.
