FINDINGS:
1. That the driveway break on Stevens Creek Boulevard serving the'
proposed bank drive-up window conflicts with the City's general
policy of limiting curb breaks on major boulevards and further
that the driveway break conf licts with the approved planned
development plan for the property which internalized ingress and
egress points for buildings to a central private street.
2. That the proposed building setback reduction from 30 feet to 20
feet and the driveway area would hinder future City efforts to
develop a comprehensive street landscaping program for Stevens
Creek Boulevard.

FINDINGS:
1-14. Standard Conditions to the extent that they do not conflict with the
special conditions enumerated herein. In the event a conflict does
exist, the special conditions as enumerated herein shall apply.
• 15. The approval is based upon the site plan labeled Exhibit A, lst
Revision, of 18-U-73 as may be amended by additional conditions
attached hereto.
16. The area shown as bank expansion is not approved as a part of this
use permit approval.
. 17. The buildings shall be limited to a maximum height of thirty (30)
feet.
18. A suitable Uuffer shall be installed on the westerly property line
determined by the Architectural and Site Agproval Committee.

RESOLUTION OF THE PLANNING COI�f�'iIISSION OF THE CITY OF CUPERTINO RECOMMEND-
ING APPROVAL OF A USE PERMIT
WHEREAS, the Planning Commission of the City of Cupertino received an
application for a USE PERMIT, as stated on Page 2; and
WHEREAS, the applicant has met the burden of proof required to support
said application; and .
WHEREAS, the Planning Commission f inds that the application meets the
following requirements:
a. Encourages the most appropriate use of land,
b. Conserves and stabilizes the value of property,
c. Provides for adequate open spaces for light and air,
d. Permits adequate control of fires,
e. Promotes the health, safety and public welfare,
f. Provides for the orderly development of the City, and ,
g. Is advantageous to the property and improvements in the zoning
district and neighborhood in which the property is located;
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits and other
evidence submitted in this matter, the application of the USE PERMIT
is hereby recommended for approval, subject to the conditions stated
on Page 2; and
BE IT FURTHER RESOLVED:
That the aforementioned findings be approved and adopted, and that the
Secretary be, and is hereby directed to notify the parties affected by
this decision.

2. Curbs, gutters, side��alks and structures shall be
iiistalled to grades and to be constructed in accord.ance

3. Street li�hting sh�ll be installed and shall be as
approved by the City Engineer. On-site ligh�ing shall
� be as rec{uired by the Architectural and Site Approval
Committee and ordinances and regulations of the City.
All on and o�f site lighting shall be designed to in
no way interfere �aith adjacent areas and shall be no
higher than the maximum height permitted by the zone
in which the property is located.
4. Fire l�ydrants shall be located as required by the City.
5. Traffic control si�ns will be placed at locations to be
specified by the City.
6. Street trees will be pl.anted in the public right-of-way
and shall be of a type approved by the- City iii accordance
with Ordinance No. 125.
7. Grading shall be as approved and required by the City
Engineer in accordance with Ordinance No. 214(a).
8. Drainage shall be to the satisfaction of the City
Engineer.
Surface f-1ow across public sidewalks may be allowed in
Rl, R2 and R3 zoning unless storm drain facilities ar.e
deemed necessary by the City Engineer.
' Al1 developments other than R1, R2 and R3 zoning shall
' be served by on-site storr� drainage facilities connected
to the Ci_ty storm drainage system. If City storm drains
are not available, drainage facilities shall be installed
to the satisfaction of the City Engineer.
9. T}ie applicant shall be responsible for complying with tl�e
requirements of the Undergrotznd Utility Ordinance No. 331
and other related ordinances and re�ulations of the City
of Gupertino, and shall make t}�e necessar}� arrangements
with the utility companies involvc�d f�^r the installatioi�

10. The location of all buildings, fences, roadways, park-
ing areas, landscaping�and other facilities or features
sliall be as shown on tlie site plan submitted labeled

11. Parking must rneet filie requirements set forth in
Cupertino City Ordinance No. 002(c�) and must be in
accordance with the approved plot plan.
12. A masonry wall wi11 be built by any commercial developer �
to separate such commercial area from any residential
area; such wall shall be six feet high above the highest
adjoining finished grade.
13. Landscaping areas s}iall be maintained as shown on site
plan. lletailed la.ndsrapinb plans, related to arrange-
ment, selection of plant materials and sizes, shall be
approved by the Architectural and Site Approval Com-
mittee and City Council prior to issuance of a building
permit.
14. 'I'he applicant shall be responsible for completin� the
site as shown on approved plot plan and shall be required
to entex into � development agreement �aith the City of
Cupertino proviaing for payment of necessary fees, includ-
ing but not lirrzited to, checking arid inspection fees,
storm drain fee 3I1C�. underground uti? ity fee. Said agree-
ment shall be executed prior to the :issuance of a building
permit.
