CONDITIONS AND FURTHER FINDINGS:
1-14. Standard Conditions to the extent that they do not conflict with the
special conditions enumerated herein. In the event a conflict does
exist, the special conditions as enumerated herein shall apply.
15. The application is approved based upon Exhibits A& B of 14-U-73 as
� may be modified by additional conditions contained herein.
16. The applicant shall enter into an agreement with the City of Cupertino
and directly affected property owners to the west and south of the
subject parcel to construct off-site improveinents deemed necessary by
L•lie Director of Public Works te make the subject application function '
effectively and the entire Brian Terrace Tract function in terms of
its utility infrastructure. ,
17. That the Architactural and Site Control Committee carefully evaluate
the Torre Avenue landscaping frontage of the proposed development in
terms of an overalZ lanc�scaping design theme for Torre Avenue and
Pacifica Driv� frontages of the entire Brian Terrace development. It
, is further recommended that the Architectural and Site Control
Committee develop compatible architectural design elements, signing
and lighting for the Brian Terrace development.
18. Prior to the issuance of a building permit, the developer sha11 pay
to the City the amount of $1,063.53 for reimbursement of underground
electrical utilities put in with the Town Center in accordance with
the action of the City Council on August 16, 19b5.

RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMEND-
ING APPROVAL OF A USE PERMIT �
WHEREAS, the Planning Commission of the City of Cupertino received an
application for a USE PERMIT, as stated on Page 2; and
WHEREAS, the applicant has met the burden of proof required to support
said application; and
WAEREAS, the Planning Commission f inds that the application meets the
following requirements:
a. Encourages the most appropriate use of land,
b. Conserves and stabilizes the value of property, •
c. Provides for adequate open spaces for light and air,
d. Permits adequate control of fires,
e. Promotes the health, safety and public welfare,
f. Provides for the orderly development of the City, and
- g. Is advantageous to the property and improvements in the zoning
district and neighborhood in which the property is located;
NOW, THEREFORE, BE IT RE50LVED:
That after careful consideration of maps, facts, exhibits and other
evidence submitted in this matter, the application of the USE PERMIT
is hereby recommended for approval, subject to the conditions stated
on Page and
� BE IT FURTHER RESOLVED:
That the aforementioned findings be apnroved and adopted, and that the
Secretary be, and is hereby directed to notify the parties aff ected by
this decision.
