CONDITIONS AND FURTHEP. FZNDINGS:
1-14. Standard Conditions to the extent that they do not conflict with the
special conditions enumerated herein. In the event a conflict does
exist, the special conditions as enumerated herein shall apply.
15. The application is approved based upon Exhibits A& B of 13-U-73 as
may be modified by additional conditions contained herein.
16. The applicant shall enter into an agreement with the City of Cupertino
and directly affected property owners to the west and south of the
subject parcel to construct off-site improvements deemed necessary by
the Director of Public Works to make the subject applicati�n function
effectively and the entire Brian Terrace Tract function in terms of
its utility infrastructure.
17. That an off-street parking ratio of one space for every 200 sq. ft.
of gross floor area be maintained for the development.
18. That the Architectural and Site Control Committee carefully evaluate
the Torre Avenue landscaping frontage of the proposed development in
terms of an overall landscaping design theme for Torre Avenue and
� Pacifica Drive frontages of the entire Brian. Terrace development.
It is further recommended that the Architectural and Site Control
Committee develop uniform architectural design elements, signing
and lighting for th� Brian Terrace development.
19. Prior to the issuance of a building permit the developer sha�.l pay
to the City the amount of $251.59 for reimbursement of underground
electrical utilities put in with the Town Center in accordance with
the acti.on of the City Council on August 16, 1965.

ING APPROVAL OF A USE PERMIT �
WHEREAS, the Planning Commission of the City of Cupertino received an
application for a USE PERMIT, as stated on Page 2; and
WHER�AS, the applicant has met the burden of proof required to support
said application; and ''
WHEREAS, the Planning Commission f inds that the application meets the
following requirements:
a. Encourages the most appropriate use of land, ,
b. .Conserves and stabilizes the value of property,
c. Provides for adequate open spaces for light and air,
d. Per�its adequate control of fires,
e. Promotes the health, safety and public welfare,
f. Provides for the orderly development of the City, and
g. Is advantageous to the property and improvements in the zoning
district and neighborr.00d in which the property is located;
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits and other
evidence submitted in this matter, the application of the USE PERMIT
is hereby recommended for approval, subject to the conditions stated
on Page 2; and
BE IT FURTHER RESOLVED:
That the aforementioned findings be appraved and adopted, and that the
Secretary be, and is hereby directed to notify the parties affected by
this decision.
