At their regular meeting of June 5, 1995, the Cupertino City Council granted negative declarations,
approved Application No. 4-Z-95 per Planning Commission Resolution No. 4607, and approved
Application No. 12-U-73 (modified) per Planning Commission Resolution No. 4606 with the
following conditions:

The recommendation of approval is based on the Site Plan revised March, 1995, except as may
be amended by the conditions enumerated herein.
The use permit shall be implemented within three months from the date that the parcel rezoning
becomes effective.
3. USE LIMITATIONS
Permitted uses may include educational programs, conferences, secular and non -secular
retreats. Receptions not associated with the above mentioned permitted uses shall be
prohibited, except for an annual alumni reception held by the Marianist Order.
4. SIX MQNTII REVIEW PERIOD
Use permit shall be reviewed six months after implementation of parking plan. Purpose of the
review shall be to analyze whether the 30 additional parking stalls proposed in said parking
plan are sufficient to meet the demand caused by the center's activities.
5. MAXIMUM ALLOWED GI TESTS
The capacity of the center shall not exceed SO individuals at any given time unless written
permission has been granted by the Director of Community Development with the exception of
an annual alumni reception held by the Marianist Order.
6. PERiMISSION To EXCEED MAXIMI TMA - O%VFQ C. 1 4TC
On special occasions, applicant may submit a request to the Director of Community
Development to exceed the maeimum allowed capacity of the center. With the request,
applicant shall also submit a carpool and shuttle plan for the event demonstrating that the
neighborhood will not be impacted by overflow parking.
No amplified sound shall be permitted on site.
Lighting fixtures shall be positioned so as to preclude glare and other forms of visual
interference to adjoining properties, and shall be no higher than the maximum height permitted
by the zone in which the site is located.

Curbs and gutters, sidewalks and related structures shall be installed in accordance with grades
and standards as specified by the City Engineer.
Street lighting shall be installed and shall be as approved the City Engineer. Lighting fixtures
shall be positioned so as to preclude glare and other forms of visual interference to adjoining
properties, and shall be no higher than the maximum height permitted by the zone in which the
site is located.
Fire hydrants shall be located as required by the city.

Street trees shall be planted within the public right-of-way and shall be of a type approved by
the city in accordance with Ordinance No. 125.
14. GRADING
Grading shall be as approved and required by the City Engineer in accordance with Chapter
16.08 of the Cupertino Municipal Code.
Storm drainage shall be provided to the satisfaction of the City Engineer.
Surface flow across public sidewalks may be allowed in the R-1, R-2, and R-3 zones unless
storm drain facilities are deemed necessary by the City Engineer. Development in all other
zoning districts shall be serviced by on-site storm drainage facilities connected to the city storm
drainage system. If city storm drains are not available, drainage facilities shall be installed to
the satisfaction of the City Engineer.
Electrical transformers, telephone vaults and similar above ground equipment enclosures shall
be screened with fencing and landscaping or located underground such that said equipment is
not visible from public street areas.
The developer shall execute a quitclaim deed for underground water rights to Cupertino Nater
Company and shall reach an agreement with Cupertino Water Company for water service to the
subject development.
18. I APROVEMENT AGREEMENT
The project developer shall enter into a development agreement with the City of Cupertino
providing the payment of fees, including but no limited to checking and inspection fees, storm
drain fees, park dedication fees and fees for undergrounding of utilities. Said agreement shall
be executed prior to issuance of construction permits.

clarification. Failure to incorporate conditions into your plan set will result in delays at the plan
checking stage. If development conditions require tree preservations, do not clear the site until
required tree protection devices are installed.
The expiration date for the use permit is June 5, 1997. (Section 6.4 of Ordinance No. 652 as revised by
Ordinance No. 1136).

WHEREAS, the Planning Commission of the City of Cupertino received an application for a change of
zone, as described in this Resolution; and
WIIEREAS, the necessary public notices have been given in accordance with the Procedural Ordinance of

WHEREAS, the applicant has met the burden of proof required to support said application; and
WHEREAS, the Planning Commission finds that the application meets the following requirements:

detrimental to existing uses or to uses specifically permitted in the zone in which the proposed use
is to be located.
b) That the property involved is adequate in size and shape to accommodate the proposed use,

Background:
In 1973 the applicant was granted a use permit allowing educational activities and
programs for individuals entering the Marinnist Order. These activities continued
at the site until approximately four years ago. Alter evaluating the use of the site,
• the applicant felt the site was not being used to its fullest capacity and expanded
the use from non -secular activities to secular activities. These activities include
musical recitals, conferences, business meetings and educational activities.
Discussion:
The use permit modification was initiated following notification by staff that the
change of activities required use permit approval. It was also apparent that a
serious parking deficiency existed. Only 14 parking spaces are currently available
on-site for visitor use, while the maximum capacity of the facility is 72 people.
Consequently there is a parking overflow into the surrounding neighborhood.

To correct the parking deficiency, the applicant recently purchased :m adjacent
Parcel on Alcalde Road. The parcel contains a small home which will be used as
a residence and storage facility. The remainder of the parcel will provide 15
additional spaces and will act as a buffer between the barbecue/picnic area and the
neighborhood. The applicant is requesting this parcel be rezoned from R2-4.25 to
13Q.
Five spaces previously used as staff parking will be converted to visitor parking
bringing the number of parking spaces for the facility to 34 spaces. The Marianist
Center employee parking will be provided off-site at another Marianist property
with the employees being shuttled to the Center. City staff believes that even with
the increased parking a deficiency still exists. To prevent overflow parking into
the surrounding neighborhood, staff' is recommending that although the maximum
capacity of the facility is 72 people, the Center be limited to a maximum of 50
people at any given time.
However, on special occasions the Center would like to be allowed the maximum
capacity of 72 individuals. On such occasions the applicant will be required to
request permission from city planning staff and submit a shuttle/ carpool plan
demonstrating that the neighborhood will not be impacted by the event. In
addition to the parking conditions, the use permit will also be conditioned so that
amplified music or outdoor entertaining will not be allowed.
Planning Commission:
On May 8, 1995, the Planning Commission considered the Marianist Novitiate's
request for rezoning and use permit modification. They accepted staffs
recommendations with minor modifications made to the use permit conditions.
One of the modifications was to allow receptions associated with the permitted
uses and allow an annual alumni reception held by the Marianist Order. The other
modification requires the use permit to be reviewed six months after the
implementation of the parking plan to analyze whether the 20 additional spaces
are sufficient to meet the parking demands of the center.
Several members of the public testified at the public hearing. In general, residents
of Merriman road are concerned with the following:
- High volume of cars on Merriman Road is dangerous.
- On-site parking is not adequate - center's clients will still park on
Merriman Road.
- The center's clients will not use the proposed parking lot on Alcalde Road.
- Over flow parking is infringing on privacy of residents of Merriman Road.
Recommendation:
Staff recommends approval of the use permit modification according to the
findings and conditions contained in Resolution 4606. Staff also recommends
approval of the rezoning of the .18 parcel from 1124.25 to BQ according to the
findings and conditions contained in Resolution 4607.
Since this is a code enforcement matter, staff is recommending that the Council
add a condition requiring the use permit to be implemented within three months
from the date the rezoning of the parcel is effective.

WHEREAS, an application was filed by the City of Cupertino (4-Z-95) for the rezoning
of property from R24.25 to BQ, Quasi -Public; and
WHEREAS, upon due notice and after one public hearing the Planning Commission
recommended to the City Council that the rezoning be granted; and
. WHEREAS, a map of the subject property is attached hereto as Exhibit A as a proposed
amendment to the Master Zoning Map of the City of Cupertino.

At their meeting of June 5, 1995, the City Council of the City of Cupertino conducted a
public hearing to consider a rezoning and considered a request for a use permit filed by
Marianist Novitiate. The project is located at 22655 Marianist Way.
The project is described as a use permit modification to allow retreats, educational
activities and receptions, and rezoning of a .18 acre parcel from RI -4.25 zone to BQ
zone.
The decision of the City Council was to approve said project. The City Council, by filing
a Negative Declaration on June 6, 1995, has determined that the project will not have a
significant impact upon the environment and, therefore, no Environmental Impact Report
has been prepared.
The Negative Declaration has been prepared pursuant to the provisions of State and City
guidelines. A copy of said Negative Declaration is available in the Office of the City
Clerk, 10300 Torre Avenue, Cupertino, California.
