FINDINGS:
l. That the orientation of the service bays of the proposed �ire service
center to Stevens Creek Boulevard and existing residential areas would
expose unsightly and noisy tire installation operations to the public.
2. That the applicant stated that open service bays must face the public
in order to convey the necessary image for retailing tires. -
3. That the Planning Commission does not agree with this reasoning.
Several franchise businesses have had to alter their standard building
designs in order to operate a business in Cupertino.

the Planning Commission of the City of Cupertino, State of California, by
the following roll call vote:

WHEREAS the Planning Commi�sio� of the City of Cupertino re-
ceived an application for a��e Permit, as stated on Page 2;and
WHEREAS the applicant has NOT met the bu�den of proof required
to support his said application; and
WHEREAS the Planning Commi�sion finds that the application
does NOT meet all of th� following requirements:
a. Encourages the most app�o�riate use of land,
b. Conserves and stabilize� the va1ue of property,
c. Provides f�r adequate open �paces for light
and air,
d. Pe�mits adequate control �f fires,
e. Prom�tes the health, safety and public welfare,
f. Provides fo� t�e o�de�ly development of the City,
and
g. Is adcantageous to the pro�erty and improvements
in the zoning di�tri�t and neighborh��d in which
the property i� loc�ted;
NOW, THEREFORE, BE I� RE��LVED:
That after careful consideration of maps, facts, exhibits and
other evidence submitted i� this matter•, the application for
the USE PERMIT be, and the same i� he��by denied; and
BE IT FURTHER RESOLVED:
That the finds quoted above and on page two be approved and
adopted, and that the S�creta�y be, and is he�eby directed
to notify the.parti�� affe�te� by thi� decision.
