This letter confirms the decision of the Planning Commission, given at the meeting of
September 10, 2001, approving a use permit modification to the conversion of a 730
square foot social room to two residential guest units at an existing 517 unit apartment
complex (Glenbrook Apartments) at 10100 Mary Avenue, according to Planning
Commission Resolution No. 6107.
Please be aware that this modification is approved for a period of two years effective
September 10, 2001 and expiring on September 10, 2003.
Also note that an appeal of this decision can be made within 14 calendar days of the
decision. If this occurs, you will be notified of a public hearing, which will be scheduled

OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO APPROVING
A USE PERMIT MODIFICATION TO ALLOW THE CONVERSION OF A 730 SQUARE
FOOT SOCIAL ROOM TO TWO RESIDENTIAL GUEST UNITS AT AN EXISTING 517

SECTION 1: FINDINGS
WI IEREAS, the Planning Commission of the City of Cupertino received an application for a Use
Permit, as described in Section 11. of this Resolution; and
WHEREAS, the necessary public notices have been given in accordance with the Procedural
Ordinance of the City of Cupertino, and the Planning Commission has held one or more public
hearings on this matter; and
WHEREAS, the applicant has met the burden of proof required to support said application; and
has satisfied the following requirements:
I ) The proposed use, at the proposed location, will not be detrimental or injurious to property or
improvements in the vicinity, and will not be detrimental to the public health, safety, general
welfare, or convenience;
2) The proposed use will be located and conducted in a manner in accord with the Cupertino
Comprehensive General Plan and the purpose of this title.
NOW, THEREFORE, BE IT RESOLVED:

complex which included the complex, surrounding park. shopping center, senior center. and the
area for the proposed conversion. Ile reviewed the applicant's request to convert the social room
to two guest rooms for apartment residents' use. Staff recommends approval of the application.
Mr. Gilli noted that one of the proposed guest rooms would be handicapped -accessible, Mr.
Piasecki stated that they would notify the applicant when they apply for the building permits if
both units were required to be handicapped -accessible. Ni r. Gilli noted that changes to the
structure would be internal with the exception ofa new door and a small pop -out on one side; and
said the building would have to meet the uniform building code for an occupied room and would
have a higher standard than a social room. He said he had not received calls from the residents
objecting to the proposed conversion to guest rooms. Mr. Gilli reported there is a high demand for
guest rooms and said the present social room is not used often; and noted that there are still other
social rooms in the complex. He explained the usage fee process for the guest rooms, which
mainly covers the housekeeping fees and said he felt it %%as a reasonable fee.
Mr. Kevin Weinmann, architect, said that the report was comprehensive and the owners were
trying to address a demand of the tenants to replace the social room, which two still exist and arc
not used frequently. lie added that the other goal was to provide a handicapped -accessible guest
room.
Chair Kwok opened the meeting for public input.
Dr. Richard Popejoy, said when such a room is built, there is nothing to preclude the applicant
from charging $200 per night next year, which becomes an issue; will it become a rental space or
another mini hotel? He said he felt if the building permit was approved, the applicant could easily
raise the rates because of costs; and where are those issues being addressed with proposed building
standards. lie said if a single funily house is proposed in Monta Vista, the markers are put up
which shows the height for two stories and the visual impact. Saratoga fire department also has
put up the markers where they are going to build one more story. Ile questioned why Cupertino
was giving preferential exclusion to commercial and retail developers; why aren't they required to
do the same things on a project such as this, or a project like redoing "Town Center or the three
stories oft I lighway 9?
Chair Kwok closed the public hearing.

BACKGROUND:
fhe applicant requests a use permit modification to comm a social room to mo guest roosts at
the Glenbrook Apartments. The guest rooms are available to residents lora nominal charge
(presently S55 a night). The typical use of the guest rooms is for relatives visiting from out of
town. One of the guest roosts will be handicapped -accessible. The proiect is categorically
exempt under C EQA.

Based on the demand lift guest rooms noted in the applicant's letter (lixhihit A). ill argument can
be made that the guest rooms arc a residcntiai amenity ill oes trot

Staff reviewed the parking situation onsite to ensure that adequate supply is available during full
occupancy ol'all apartment units and guest units.
The site has 317 apartment units and 4 existing guest units. The site has 1.034 parking spaces. or
thvo spaces for every apartment unit. The Parking Ordinance requires two spaces per unit. but
the City Council has allowed one space for every one -bedroom unit in the past. 333 ol'the 317
apartment units are one -bedroom (43%). Based on the percentage of one -bedroom units, stall'
docs not believe that the new guest units will impact the parking situation.

ROOMS:
I . We have had requests for a handicapped accessible guest room. We
would like to accommodate this request, and the existing guest rooms do
not have the square footage or the layout (i.e. tiny bath, toilet room etc.)
to be feasible for a properly designed handicap guest room.
2. The 4 existing guest rooms are currently booked for months in advance.
Residents are very frustrated to find out that the rooms are almost always
filled. There are approximately 1.200 people living at Glenbrook.
3. We currently have 2 "Social rooms" which are very large rooms with
couches, and a television. The rear social room is only used a few days
per year. In the housing industry there has been a social change to where
residents prefer to socialize on their own time and not "hang out" at a
social room to elect new people. The front social room handles any
demand for this use, and is far superior to the rear social room because it
has floor -to -ceiling glass on two sides of the building, and is located next
to the fitness center and the largest swimming pool and outdoor
whirlpool spa at Glenbrook.

standard one -bedroom apartments, 193 two-bedroom apartments, and 92 three-
bedroom apartments.
2. The apartment complex does not require residents to register their cars with
the apartment office. Therefore, we do not know the number of cars in total.
However, we can tell you that we have managed the property for 30 years and have no
visible parking issues.
3. There are 1,034 parking spaces i.e. a parking ratio of two full spaces for each
apartment unit. Each resident receives one assigned covered parking stall. Hence, half
of the stalls are assigned -covered parking and half are open parking stalls.

NOTE: Glenbrook Apartments shares a property line with Memorial Park and the
Senior Citizen Center, where dozen's of recreational activities take place. Also,
DeAnza College is across the street.
There was a recent opportunity to increase the amount of recreational space wherein a
staff meeting room was changed to a children's library and crafts room. Also, the
Indoor Driving Range and Aerobia & Dance Room were created from two outdated
low -ceiling racquetball rooms that were designed in 1968 prior to the "Official" raising
of the ceiling height for United States racquetball.
5. 'rash and laundry facilities: There are numerous trash and laundry facilities
available within walking distance from the proposed guest rooms. The disposal of
trash and laundry of sheets and pillow cases would be done at non -peak hours by a
Glenbrook employee who would be familiar with the least crowded laundry rooms
and dumpsters as well. Laundry facilities have never been a problem ever since the
invention of stacked dryers which replaced the single unit dryers originally installed at
Glenbrook. Hence, there are twice as many dryers as originally contemplated.
6. NQjZg: The allowed hours the residents can be in the billiard rooms or the
swimming pool are: 8 a.m. to 10 p.m. It should be noted that this is a "small and
quiet" swimming pool area because, unlike pool #1 and pool #5, there is no outdoor
whirlpool spa, no indoor sauna's and a small amount of patio furniture. Pool #1 and
#5 on the other hand are enormous pool areas that attract socially -oriented residents.

The City of Cupertino is in receipt of an application to modify a use permit to convert an existing
social room into two guest rooms at the Glenbrook apartments. i will be the project manager for
the planning application.
There is a Prehearing meeting scheduled for Wednesday. August 8, 2001 at 8:30 a.m. in
Conference Room C&D in City Hall. The purpose of the prehearing meeting is to allow
representatives of Central Fire, the Sanitary District, Building Dept and Public Works Dept to
comment on your proposal. This is not a decision-making or public meeting. You, or one of
your representatives should be in attendance at the meeting.
The item is scheduled to go to a public hearing in front of the Planning Commission on
September 10. 2001.

Based on the information provided, it appears that parking may be an issue. In order to
determine if parking is adequate please answer the following questions:

This letter confirms the decision of the Planning Commission, given at the meeting of
September 10,2001, approving a use permit modification to the conversion of a 730
square foot social room to two residential guest units at an existing 517 unit apartment
complex (Glenbrook Apartments) at 10100 Mary Avenue, according to Planning
Commission Resolution No. 6107.
Please be aware that this modification is approved for a period of two years effective
September 10, 2001 and expiring on September 10,2003.
Also note that an appeal of this decision can be made within 14 calendar days of the

OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO APPROVING
A USE PERMIT MODIFICATION TO ALLOW THE CONVERSION OF A 730 SQUARE
FOOT SOCIAL ROOM TO TWO RESIDENTIAL GUEST UNITS AT AN EXISTING 517

SECTION I: FINDINGS
WHEREAS, the Planning Commission of the City of Cupertino received an application for a Use
Permit, as described in Section II. of this Resolution; and
WHEREAS, the necessary public notices have been given in accordance with the Procedural
Ordinance of the City of Cupertino, and the Planning Commission has held one or more public
hearings on this matter; and
WHEREAS, the applicant has met the burden of proof required to support said application; and
has satisfied the following requirements:
1) The proposed use, at the proposed location, will not be detrimental or injurious to property or
improvements in the vicinity, and will not be detrimental to the public health, safety, general
welfare, or convenience;
2) The proposed use will be located and conducted in a manner in accord with the Cupertino
Comprehensive General Plan and the purpose of this title.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in
this matter, the application for a Modification to a Use Permit is hereby approved, subject to the
conditions which are enumerated in this Resolution beginning on Page 2 thereof; and
That the subconclusions upon which the findings and conditions specified in this resolution are
based and contained in the public hearing record concerning Application No. 22-U-67(M) as set
forth in the Minutes of the Planning Commission of September 10,2001 and are incorporated by
reference as though fully set forth herein.

July 23, 2001 except as may be amended by the Conditions contained in this Resolution.
2. GUEST UNIT ACCESSIBILITY
The project shall conform to Chapter 11A of the 1998 California Building Code to the
satisfaction of the Chief Building Official.
3. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government Code
Section 66020( d) (1), these Conditions constitute written notice of a statement ofthe amount
of such fees, and a description of the dedications, reservations, and other exactions. You are
hereby further notified that the 90-day approval period in which you may protest these fees,
dedications, reservations, and other exactions, pursuant to Government Code Section
66020(a), has begun. If you fail to file a protest within this 90-day period complying with
all of the requirements of Section 66020, you will be legally barred from later challenging
such exactions.
