CC Resolution No. 9195 RESOLUTION NO. 9195 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO MODIFYING THE CONDITIONS OF APPROVAL FOR USE PERMIT APPLICATION 4-U-85 OLA HASSAN (FORMERLY SNEAKERS OF NORTHERN CALIFORNIA) ============================================================================ WHEREAS, on or about August 30, 1994, the Director of Community Development detennined that substantial evidence indicated that unlawful activities related to the Ola's Caribbean, Cajun and African Restaurant was detrimental to the public health, safety and welfare, and WHEREAS, the Director of Community Development scheduled a public hearing before the Cupertino City Council on September 19, 1994 to consider whether the use pennit has been conducted in a manner detrimental to the public health, safety and welfare, and WHEREAS, the City Council reviewed and evaluated written, and graphic infonnation together with verbal testimony from public officials, the use pennit applicant and other interested parties, now NOW, THEREFORE, BE IT RESOLVED, that the City Council hereby modifies conditional use penn it 4-U-85 based upon the following rmdings and conditions. FINDINGS: I. Santa Clara County Sheriff's records demonstrate a pattern of unlawful activity resulting from the operation of the subject facility. The unlawful activity results in public safety problems and abnonnally high policing costs. 2, The restaurant bar periodically caters to large numbers of minors which results in unruly crowds which are difficult to manage. ADDITIONAL CONDITIONS: 1. The Sheriff's Department has the right to review a security plan and may require increases in security to ensure the safety of the public. 2. Law enforcement officers shall have the right to make periodic inspections of the restaurant during nonnal operating hours to evaluate the potential for possible policing problems such as overcrowding and serving alcohol to minors. 3, The applicant shall eliminate "under 21" seating for live entertainment events, PASSED AND ADOPTED at a regular meeting of the City Council of the City of Cupertino this 19th day of September, 1994, by the following vote: ~ AYES: NOES; ABSTAIN: ABSENT; Members of the City Council Bautista, Burnett, Dean, Sorensen, Koppel None None None A TIEST: APPROVED: /s/ Kim Marie Smith City Clerk /s/ Barb Koppel Mayor, City of Cupertino
