A RESOLUTION OF THE CUPERTINO CITY COUNCIL
AWARDING A DESIGN‐BUILD CONTRACT FOR THE CUPERTINO
LIBRARY EXPANSION PROJECT AND AUTHORIZING THE CITY
MANAGER TO EXECUTE THE CONTRACT IN THE AMOUNT OF
$6,476,168 WITH RODAN BUILDERS, INC. AND FURTHER AUTHORIZE
THE DIRECTOR OF PUBLIC WORKS TO EXECUTE ANY NECESSARY
CHANGE ORDERS UP TO A CONTINGENCY OF $500,000, FOR A TOTAL
AUTHORIZED APPROPRIATION OF $6,976,168
WHEREAS, the Library Expansion Project (ʺProjectʺ) involves design‐build
delivery of a 5,626 square foot, two‐story expansion of the existing Library,
including 130‐seat minimum audience capacity and presentation space, spillover
seating, flexible space, kitchenette, and supplemental storage; and
WHEREAS, pursuant to 22164 of the Public Contract Code, City issued a
Request for Qualifications (“RFQ”), dated May 12, 2020, to qualify and short‐list
potential Design Build Entities (“DBEs”) for the Project; and
WHEREAS, pursuant to 22164 of the Public Contract Code, City issued a
Request for Proposals (“RFP”), dated June 19, 2020, to the four short‐listed DBEs,
requesting proposals to provide the design‐build services (“Services”) for the
Project; and
WHEREAS, the four short‐listed DBEs submitted proposals on July 29, 2020
in response to the RFP; and
WHEREAS, the proposal submitted by one DBE was determined to be non‐
responsive and was removed from further consideration; and
WHEREAS, the three remaining proposals were reviewed and
preliminarily scored by the City’s evaluation panel, based on the evaluation
factors set forth in the RFP and in accordance with the requirements of the RFP;
and
WHEREAS, each of the three remaining DBE teams were invited to
participate in a private and confidential videoconference meeting with the
evaluation panel to present their respective proposals on August 5, 2020; and

WHEREAS, the City evaluation panel conducted follow‐up discussions and
negotiations, as authorized by the Public Contract Code, with the two DBEs with
the highest post‐presentation scores on August 6, 2020; and
WHEREAS, the City evaluation panel conducted further discussions and
negotiations with the DBE with the highest post‐presentation score, Rodan
Builders, Inc., on August 7, 2020; and
WHEREAS, Rodan Builders, Inc. submitted an amendment to its proposal
based on those discussions and negotiations (Proposal Amendment 1) on August
10, 2020; and
WHEREAS, at the conclusion of the follow‐up discussions and
negotiations, the responsive proposals were ranked based on total scores to
identify the proposal that provides the best value pursuant to the evaluation
factors set forth in the RFP; and
WHEREAS, the City’s evaluation panel determined that the Proposal
submitted by Rodan Builders, Inc., as amended by Proposal Amendment 1,
received the highest score and final ranking among responsive proposals at the
conclusion of the review and evaluation process, and will provide the best value
to the public in accordance with the evaluation factors in the RFP; and
WHEREAS, the final Design‐Build Contract Documents incorporate the
Proposal submitted by Rodan Builders, Inc., as modified by Proposal Amendment
1; and
WHEREAS, the City prepared an Addendum (“Addendum”) to the
Mitigated Negative Declaration for the Cupertino Civic Center Master Plan (State
Clearinghouse No. 2014032007) (“MND”) for the Project in compliance with the
California Environmental Quality Act (Public Resources Code Section 21000 et
seq.) (“CEQA”) together with the State CEQA Guidelines (California Code of
Regulations, Title 14, Section 15000 et seq.) (hereinafter, “CEQA Guidelines”); and
WHEREAS, on August 13, 2020 the Administrative Hearing Officer of the
City of Cupertino adopted the Addendum to the MND (Application No. EA‐2020‐
002) and approved an Architectural and Site Approval Permit , (Application No.
ASA‐2020‐004) to allow a 5,600 square foot, two story expansion to the existing
Cupertino Public Library, located at 10800 Torre Avenue (APN 369 31 033).

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Cupertino takes the following actions:
1. Award the accompanying Design‐Build Contract for the Cupertino
Library Expansion Project and authorize the City Manager to execute
the Design‐Build Contract in the amount of $6,476,168 with Rodan
Builders, Inc. as the DBE for the Project.
2. Authorize the Director of Public Works to execute any necessary change
orders up to a contingency of $500,000, for a total authorized
appropriation amount of $6,976,168.
