This letter intends to address one (1) dead Pyrus calleryana (ornamental pear) located in the center
courtyard in the building on the 19333 Vallco Parkway property in Cupertino, California. Please see
Exhibit 1.1 for the relative location of the subject tree, and for the location of the replacement tree.
The tree is dead and will need to be removed and replaced.
The pear tree was 14-inches diameter at 4.5 feet above grade and was 20-feet in height with a 30-
foot canopy spread. It was dead and had critical structure.
The tree was determined to be dead (see Exhibit 1.2) due to its extensive brown foliage, complete
lack of green foliage, and dried leaves in the summer growing season. A live tree should be vibrant
green this time of year. It is possible that the pear reached its growing limit as pears only live up to
30-years.
Removal of a dead tree does not require a live tree removal permit prior to its removal pursuant to
Section 14.18.140 Paragraph B of the City of Cupertino's Municipal Code; however, a subsequent
application must be filed within five (5) working days. The tree will require replacement, selected by
the Apple arborist to ensure optimal structure, health, and no girdling roots. The selected tree will
then be trained from an early age as needed to optimize branching structure, extending the
aesthetically and structurally sound lifespan of the tree. The proposed replacement is one (1) 36-inch
box Quercus spp. in the same location as the proposed removal.
The replacement tree will be selected for favorable characteristics whenever possible such as
drought tolerance, long lifespan, structurally sound, deep-rooted, Cupertino climate-appropriate,
onsite location-appropriate, shading value, pest resistance and overall enhanced aesthetics. The
new tree will be selected by an Apple arborist to ensure optimal structure, health, and reduce the risk
of girdling roots, and then trained from an early age as needed to optimize branching structure which
will extend the aesthetically and structurally sound lifespan of the trees.
