LRC 01-13-2020Legislative Review Committee Minutes January 13, 2020 Page 1 CITY OF CUPERTINO APPROVED MINUTES LEGISLATIVE REVIEW COMMITTEE 10300 Torre Avenue, City Hall, Conference Room A Monday, January 13, 2020 4:00 PM SPECIAL MEETING ROLL CALL The meeting was called to order at 4:02 p.m. Present: Mayor Scharf, Councilmember Chao, City Manager Deborah Feng, Townsend Public Affairs (TPA), and Assistant to the City Manager Katy Nomura APPROVAL OF MINUTES 1.Subject: Minutes from December 5, 2019 Recommended Action: Approve minutes from December 5, 2019 The minutes were approved unanimously. POSTPONEMENTS ORAL COMMUNICATIONS Jennifer Griffin spoke about her concern with ADU bills. Liana Crabtree brought attention to a written communication sent to the Mayor and Councilmember Chao regarding park land. PUBLIC COMMENT (including comments on all agenda items) This item was not conducted as the Chair decided to take public comment on agenda items when the agenda items were discussed. AGENDA REVIEW This item was not conducted. ACTION ITEMS 2.Subject: Discuss the City's draft 2020 Legislative Platform and recommend for City Council's adoption Recommended Action: Approve the draft 2020 Legislative Platform and recommend for City Council's adoption Legislative Review Committee Minutes January 13, 2020 Page 2 Assistant to the City Manager Katy Nomura explained that the attached redlined draft of the Legislative Platform includes the original changes prior to the December 5th meeting, in red and the new changes after the December 5th meeting, in green. The Mayor and Councilmember Chao reviewed the changes and provided the following comments and additional changes: Government Transparency This section has been changed to provide more clarity to items relating to public information. Item number 3 will be removed and number 4 will be fixed to highlight other disclosure legislation aside from the Public Records Act (PRA). Housing and Community Development Councilmember Chao clarified number 5 to include reporting on entitled and approved units. Public Comment: Jennifer Griffin spoke against not reassessing property values for people who add ADU’s and escape increases of property taxes. Liana Crabtree suggested changing item number 1 in Housing and Community Development (HCD) section to say Below Market Rate housing instead of affordable housing because it is more specific. The Mayor and Councilmember Chao agreed to change number 1 to include below market rate housing at all income levels. Liana also suggested shifting the focus of number 18 in HCD to increasing teacher and staff incomes instead of providing teacher housing through their employers, due to problematic employer/employee situations. The Mayor and Councilmember Chao decided to remove number 18 since number 7 encompasses support for housing at all income levels. Action Taken: Mayor Scharf makes a motion to recommend the Draft 2020 Legislative Platform with the above changes for City Council’s adoption. Councilmember Chao seconds and the motion carries unanimously. 3.Subject: Legislative Updates Recommended Action: Receive legislative update and provide input TPA explains that the legislature reconvened on Monday January 6th for the second year of the legislative session. Currently their focus is to move any 2 year bills that did not move out of their house of origin last year. These measures need to be out of the Policy Committee and voted on by their respective houses by January 31st. On Friday January 10th, the Governor released his proposed FY 2020-21 budget. The legislature will hold a long series of hearings to discuss the components of the governor’s budget in the next few weeks and will go until May when the governor does his May revise. Legislative Review Committee Minutes January 13, 2020 Page 3 SB 50 was significantly amended by Senator Wiener, but still faces significant questions and skepticism. The two main amendments include a delayed implementation until January 2023 and the ability for local governments to implement an alternative plan. This measure will need to move out of the Senate Appropriations Committee before it can be considered on the Senate floor. If it does move out of the Appropriations Committee then it would need to pass the Senate with a majority vote. If SB 50 fails to move out of the Committee, TPA expects Senator Wiener will introduce a new bill by the February 21st deadline. This is the deadline for all new bills to be introduced. The City of Cupertino currently has an “Oppose” position on this bill and TPA recommends maintaining that position at this point due to the lack of specificity of the new amendments. Public Comment: Jennifer Griffin is concerned about SB 50 and has expressed her concern to the Capital. 4.Subject: Update on the Governor's proposed state budget Recommended Action: Receive update on the Governor's proposed state budget This item was not conducted and is being continued to the next meeting. 5.Subject: Update on state budget proposal regarding funding for affordable housing Recommended Action: Receive update on state budget proposal regarding funding for affordable housing Assistant to the City Manager, Katy Nomura, explained that the City Manager is working on making a proposal to put in the state budget regarding affordable housing in Cupertino or in surrounding cities. The Community Development Department is working on an analysis of various sites as potential options for building affordable housing. Currently, the City is looking for a legislator to sponsor this budget proposal and will work on communicating with the City’s local legislators. Public Comment: Jennifer Griffin spoke about Congressman Ro Khanna and other state legislators. 6.Subject: Discussion of Future Meetings and Agenda Topics Recommended Action: Recommend future meeting and agenda topics The update on the Governor’s proposed budget will be continued to the next meeting. The next meeting will also have a presentation by the County Assessor on the split roll bill. The next meeting will be scheduled sometime after February 21st so that the LRC can review all of the new bills. ADJOURNMENT The meeting was adjourned at 5:24 p.m.
