Subject: Director's Minor Modification, DIR-2019-010, to allow for a voluntary retrofit of an
existing retaining wall and a new retaining wall adjacent to a parking area in a Quasi -
Public zone.
Chapter 19.164 of the Cupertino Municipal Code allows for administrative approval of
minor changes in a project. The Director reports his decision to the City Council and
Planning Commission in time to allow an appeal of the decision within fourteen
calendar days.
DISCUSSION
The applicant, Salvatore Caruso of Salvatore Caruso Design Corporation, representing the property
owner, Ramona Blvd. Inc, is requesting approval to allow modifications to an existing religious retreat
and retirement facility located at 22825 San Juan Road.
Previous Approvals
The site previously obtained approval (ASA-2016-08) for a retrofit of the existing wall (lower portion of
the site), stairs to the lower level of the property, and new concrete decks. The project also required the
removal and replacement of 19 trees, one of which was protected, TR-2016-43. All trees were removed;
however, the applicant did not move forward with the previously approved project, and the approval
expired on November 10, 2018.
Proposed Project
The new project proposes to further stabilize the existing stitched peers along the norther parking area
by incorporating new tie -backs and adding shotcrete to the wall face. As part of the project, the area
will include a new concrete deck with a four -foot high guardrail. The downhill facing slope will be
graded to allow for a maximum 2:1 slope to stabilize the area.

A new retaining wall is proposed along the southern parking area. The retaining wall will vary in
height but will not be greater than five feet. New turf pavers with vines will be placed between the new
concrete curb and retaining walls with the intent of new vines growing onto the retaining wall.
Additionally, components of the project include repairing the asphalt paving as needed, and relocation
of a fire hydrant.
Because the property is located with a geologic hazard zone (fault rupture and slope instability), the
City had the provided geologic and geotechnical reports peer reviewed by Cotton, Shires and
Associates, Inc. Recommendations of the peer review have been incorporated as Condition of Approval
#4.
ACTION
The Director of Community Development deems the modification minor and approves the Director's
Minor Modification with the following conditions of approval:
1. APPROVED EXHIBITS
Approval is based the plan set consisting of 16 sheets dated November 11, 2018, and labeled as
A0.1-A1.2, RW1, RW2, and C1.0 - C5.0, entitled "Our Lady of Santa Clara, 22825 San Juan Road,
Cupertino, CA 95014" drawn by Salvatore Caruso Design Corporation, Kier and Wight Civil
Engineers & Surveyors, Inc., and Gularte & Associates Geotechnical Consultants; except as may be
amended by conditions in this resolution.
2. CONSULTATION WITH OTHER DEPARTMENTS
The applicant is responsible to consult with other departments and/or agencies with regard to the
proposed project for additional conditions and requirements. Any misrepresentation of any
submitted data may invalidate an approval by the Community Development Department.

3. ANNOTATION OF THE CONDITIONS OF APPROVAL
The conditions of approval set forth shall be incorporated into and annotated on the first page of
the building plans.
4. GEOLOGIC PEER REVIEW
The applicant's geotechnical consultant shall review and approve all geotechnical aspects of the
development plans (i.e., including site preparation and grading, site drainage improvements and
design parameters for retaining walls) to ensure their recommendations have been properly
incorporated. The following should be specifically be addressed:
The upslope block wall design parameters for soil shall be reviewed by the Project Geotechnical
Consultant to assure that the design parameters utilized for this wall are consistent with the
findings of the geotechnical investigation.
The Geotedmical Plan Review shall be submitted to the City for review by City Staff and City
Geotechnical Consultant prior to issuance of building permits.
5. LANDSCAPE PROJECT SUBMITTAL
Prior to issuance of building permits, the applicant shall submit a full landscape project submittal
per sections 14.15.040 A, B, C, and D of the Landscaping Ordinance. The Water -Efficient Design
Checklist (Appendix A of Chapter 14.15), Landscape and Irrigation Design Plans, and Water
Budget Calculations shall be reviewed and approved to the satisfaction of the Director of
Community Development prior to issuance of building permits.
6. LANDSCAPE INSTALLATION REPORT
Prior to issuance of final occupancy, a landscape installation audit shall be conducted by a certified
landscape professional after the landscaping and irrigation systems have been installed. The
findings of the assessment shall be consolidated into a landscape installation report.
The landscape installation report shall include, but is not limited to: inspection to confirm that the
landscaping and irrigation system are installed as specified in the landscape and irrigation design
plan, system tune-up, system test with distribution uniformity, reporting overspray or run-off that
causes overland flow, and preparation of an irrigation schedule.
The landscape installation report shall include the following statement: "The landscape and
irrigation system have been installed as specified in the landscape and irrigation design plan and
complies with the criteria of the ordinance and the permit."
7. LANDSCAPE AND IRRIGATION MAINTENANCE
Prior to issuance of final occupancy, a maintenance schedule shall be established and submitted to
the Director of Community Development or his/her designee, either with the landscape application
package, with the landscape installation report, or any time before the landscape installation report
is submitted.

a) Schedules should take into account water requirements for the plant establishment period and
water requirements for established landscapes.
b) Maintenance shall include, but not be limited to the following: routine inspection; pressure
testing, adjustment and repair of the irrigation system; aerating and de -thatching turf areas;
replenishing mulch; fertilizing; pruning; replanting of failed plants; weeding; pest control; and
removing obstructions to emission devices.
c) Failed plants shall be replaced with the same or functionally equivalent plants that may be size -
adjusted as appropriate for the stage of growth of the overall installation. Failing plants shall either
be replaced or be revived through appropriate adjustments in water, nutrients, pest control or other
factors as recommended by a landscaping professional.
8. REVIEW BY THIRD PARTY
The final tie -back retaining wall design shall be reviewed by a third party.
9. BUILDING CODE
The building permit shall comply with the 2019 California Codes.
This approval of the Director's Minor Modification is effective March 27, 2020. The 14-calendar-day
appeal period will expire on April 10, 2020.
