Reso 2186 3-U-81 RESOLUTION NO. 2186 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMENDING THE APPROVAL OF USE PERMIT TO CONSTRUCT 0 24 RENTAL UNITS IN A P (PLANNED DEVELOPMENT WITH MULTI-FAMILY INTENT) ZONING DISTRICT. APPLICANT: Community Housing Developers ADDRESS: 277 West Hedding Street, Suite 119, San Jose, California 95014 SUBMITTED: February 12', 1981 LOCATION: Approximately 150 ft. south of Stevens Creek Boulevard and 280 ft. east of Stelling Road. FINDINGS AND SUBCONCLUSIONS: Approval is recommended subject to the findings as set forth on Page 1 and subconclusions as set forth in the minutes of the Planning Commission meeting of March 9, 1981. CONDITIONS: 1-14. Standard Conditions to the extent that they do not conflict with the special conditions enumerated herein. In the event a conflict does exist, the special conditions enumerated herein shall apply. 15. The approval is based upon Exhibits A, B, B-1 and B-2 as may be amended by additional conditions contained herein. 410 16. The approval is for a 24-unit multi-family (rental) development. The applicant/developer is a non-profit housing developer whose intent is to rent the 24 units to qualified families and the handicapped under the auspices of the Federal Housing & Urban Development (HUD) Section 8 Program. If this program is not used, and the apartments are constructed to be rented at market rates, at least 10% of the rental units shall be rented at a cost affordable for moderate-income families, as defined by the City's current Below Market Rate Housing Program manual. 17. The applicant/developer shall obtain necessary dedication for street purposes and shall fully improve Bianchi Way to public street standards from the project site to Stevens Creek Boulevard. 18. The applicant/developer shall construct a trellis or other structural elements in rear patio areas to provide privacy protection. The Architectural and Site Approval Committee shall approve the final location and design of said privacy protection devices. 19. The 18 ft. private roadway connecting the southerlymost 10 dwellings shall be widened from 18 ft. to 20 ft. 20. A rear door shall be installed on each handicaped flat to facilitate access from the adjoining carport. S -2- I S CITY OF CUPERTINO City Hall, 10300 Torre Avenue Cupertino, California 95014 Telephone: (408) 252-4505 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMEND- ING APPROVAL OF A USE PERMIT WHEREAS, the Planning Commission of the City of Cupertino received an application for a USE PERMIT, as stated on Page 2; and • WHEREAS, the applicant has met the burden of proof required to support said application; and - WHEREAS, the Planning Commission finds that the application meets the following requirements: a. That the use or uses are in conformance with the general plan and is not detrimental to existing uses or to uses specifically permitted in the zone in which the proposed use is to be located. b. That the property involved is adequate in size and shape to accommodate the proposed use. c. That the proposed use will not generate a level of traffic over and beyond that of the capacity of the existing street system. d. That the proposed use is otherwise not detrimental to the health, safety, peace, morals and general welfare of persons residing or working in the neighborhood of such proposed use nor injurious to property and improvements in the neighbor- hood.
