APPLICATION ASAC 51,809.1 -- GANNETT OUTDOOR COMPANY
APPEAL of denial by ASAC of a billboard located on the west side of
Saratoga Sunnyvale Road north of Wildflower Way.
II) DISCUSSION
Staff stated that the Sign'Ord

prohibits off -site advertising.;
Committee continue 'the 'applicat
re ulations '
{ P 11 t
nance;,;does not contain regulations
l'ilboards. However, the Ordinance
i r;!StWff recommended that the
on sfor,90 days -to study billboard
Member Miller believed 'that'±billboa'rds contravene the intent of the
Sign Ordinance prohibition of off site advertising devices. Member
Mann noted that the Committee had consistently required lower sign
heights. Chairwoman Jackson strongly believed that staff should
develop billboard regulations, and supported a continuance for
that purpose.
The applicant's appeal is based on concern for their legal
equities; the Committee decided not to consider case -specific legal
issues in determining their recommendation on this matter.
RECOMMENDATION
ASAC recommends denial of Application ASAC 51,809.1 citing inconsistency
with the sign ordinance restriction of offsite signs, and the size of
the proposed device.
Staff recommends that Council direct!Ilstaff to study billboard and off
site sign regulations; forward results'to ASAC to be used in
considering a possible sign o,rdlinance ;im'endment.

COMMENTS:
® A. ASAC direction from informal review is basis of Use Permit conditions 17(a) and (b)
B. Staff objects to proposed exterior staircase added to south elevation after Use Permit

should consider alternate solution reducing its mass and visibility. Enclosure may be
possible without counting as floor area, if stairs required for code compliance.
C. ASAC direction to continue fascia band from south to west elevation has been met;
however, window size on west elevation not reduced per ASAC suggestion.
D. Architectural enhancement of north elevation not indicated; reliance on offsite
landscaping ineffective to ensure long-term screening of added building mass.
E. Minimum shrub size of gc required under N. De Anza Conceptual Plan
RECOMMENDATION

LANDSCAPING FOR RETAINING WALL: Use Permit condition requires
provisions of tree pockets in downslope retain wall to provide
vertical relief; technically infeasible to shape pockets in wall
plane. Alternate proposal of 2' wide planter strip between wall
face and back of curb, with trees placed in concrete root
retainers.
ASAC
- BUILDING FORM: Found limited 'use of three story sections
appropriate and consistent with the intent of previous
direction.
LANDSCAPING: Determined that lalt:ernat'i.ve tree planting strategy
will accomplish the"object"ive .of screening without use of
"pockets." Required minor alteration of tree types selected for
wall screening.
