Reso 0941HC-51,502.1 RESOLUTION NO. 941 OF THE ARCHITECTURAL AND SITE APPROVAL COMMITTEE OF THE CITY OF CUPERTINO RECOMMENDING APPROVAL OF SITE, ARCHITECTURE AND LIGHTING FOR A FIVE -UNIT CLUSTER RESIDENTIAL DEVELOPMENT. PROPERTY OWNER: Regnart Creek Estates (WTW-Warren Whaley) APPLICANT: Shutts & Schwimmer ADDRESS: 14 West Main Street, Los Gatos, California 95030 LOCATION OF PROPERTY: North side of Orogrande Place approximately 230 ft. westerly of Stelling Road FINDINGS: The Architectural and Site Approval Committee finds as follows with respect to this application: 1. That the proposed development is consistent with approvals granted -under, Planning Commission Resolution No. 2020. CONDITIONS OF APPROVAL: 1-8..'. Architectural and Site Approval Standard Conditions to the extent that they do not conflict with the special conditions enumerated herein. In the event a conflict does exist, the special conditions as enumerated herein shall apply. ® 9. The recommendation of approval is based on Exhibit A 2nd Revision, B and B-1 of this application except as may be amended by special conditions contained herein. 10. The proposed easterly side setback distance for Lot 3, as depicted on Exhibit A 2nd Revision is not approved. The subject setback shall require review by the Planning Commission. 11. A detailed tree protection plan shall be provided at the building permit stage, subject to staff approval. Said details shall specify the manner in which existing trees will be protected during grading and construction activities. 12. The proposed safety rail depicted on Exhibit A 2nd Revision is not approved. "Picket" type, metal, removable fence details shall be provided at the building permit level, subject to staff approval. 13. Appropriate measures shall be provided for the fire turn -around space to ensure that this area is not utilized for parking purposes. 14. The proposed bike path is not approved. Formal landscaping shall not be required for that area between the private driveway and Regnart Creek. The intent of these provisions is to maintain the native environment of this vicinity.
