Reso 0896~ HC-51,075.48 RESOLUTION NO. 896 OF THE ARCHITECTURAL AND SITE APPROVAL COMMITTEE OF THE CITY OF CUPERTINO RECOMMENDING APPROVAL OF ROOF - MOUNTED APPURTENANCES FOR A PROPOSED RESTAURANT TO BE LOCATED IN VALLCO FASHION PARK PROPERTY OWNER: Vallco Fashion Park APPLICANT: Benihana of Tokyo, Inc. ADDRESS: 8685 N.W. 53rd. Terrace, Miami, Florida, 33131 LOCATION OF PROPERTY: Vallco Fashion Park - FINDINGS: The Architectural and Site Approval Committee finds as follows with respect to this application: 1. That recommendation for approval of visible roof -mounted appurtenances, in exception to Condition Three of ASAC Standard Conditions of Approval, is based upon the following conclusions: a. The unique interior design of subject restaurant precludes strict compliance with Condition Three of ASAC Standard Conditions of Approval. b. Relocation of subject equipment to a proximity with reduced • visibility levels can technically be achieved through extension of lateral ducts; however, it is recognized that such a require- ment may increase fire hazard potentials created by potential cleaning and maintenance shortcomings. 1. The minor interruption of the Vallco roof line created by units other that the primary kitchen exhaust element does not warrant the increased fire hazard potentials posed by their relocation. 2. Revision of the major kitchen exhaust unit location will resolve the most significant visibility concern: of subject application while minimizing 'f:ire'hazard.p'otentials providing that the Chief Building Inspector concurs with this recommendation. CONDITIONS OF APPROVAL: 1-8. Architectural and Site Approval Standard Conditions to the extent that they do not conflict with the special conditions enumerated herein. In the eventt-a conflict does exist, the special conditions as enumerated herein shall apply: 9. The the recommendation of approval is based on Exhibits B-1 and B-2 of this application except as may be amended by conditions contained in this resolution. -1- .0 HC-51,075.48 Resolution No. 896 (continued) 10. The proposed blue exterior tile roof color is not approved. The roof treatment of.subject application is continued to permit the applicants to develop a proposal which achieves a significant degree of harmony with the existing Vallco Fashion Park theme. 11. Wall -mounted signing for subject restaurant is not approved at this time. The applicant shall submit a signing proposal to ASAC in conjunction with presentation of the the roof treatment. "Said elements shall be compatible in nature. 12. The location of appurtenances depicted on Exhibit B-1 is approved, with the exception that the major kitchen exhaust element shall be moved away from the parapet to the greatest extent possible, subject to review and approval of the Chief Building Inspector. All necessary fire prevention measures shall be undertaken to en- sure the propriety of this condition. 13. The peaked -roof skylight depicted in Exhibit B-1 is approved at this time. The applicant agrees that said approval is contingent upon the assumption that subject skylight is not visible to the public, and that ASAC or its staff shall retain the authority to require replacement of said skylight with a dome matching the appearance of existing Vallco Fashion Park skylights, should subject sky- light found to be visible after installment.
