PUBLIC HEARINGS
4. Application RC-51,133.1 - Robert L. Boughton, Jr., requesting
approval of site, architecture;: landscaping, lighting, signs
and underground of utilities for professional office building
to be located at the southwesticorner of Miller Avenue and
Richwood Drive.

A brief history of the previous transactions on this property were
presented by the Planning Director.,
The Planning Technician showed colored slides of the site from the
East, North and the West. The site plan was displayed.
The Traffic Engineer recommended a'32' wide driveway to this site from
Richwood Drive. Typical elevations were shown, as well as a detailed
landscape plan.
Member Adams noted there has been no Planning Commission approval to
date on this, so any H-Control action would be contingent on the
Planning Commission approval. The'[Planning Director said the
Architectural and Site Approval and the Tentative Map will come
before the City Council at the same, time. He added that the adjacent
residents were contacted this date.
Mr. Robert Boughton, 17129 Ventura;Blvd., Encino, California, was
present to answer any questions. He wanted to cooperate with the
City in every way possible.
Chairman Ryner asked for comments from the audience.
Mr. John Zems, 101.65 Vicksburg Drive, Cupertino, said he knows this
property has been rezoned to Professional Offices for several years,
but he was present at this meeting1to see what the plot plan looks
like. He is particularly interested in the lighting proposed.
Mr. Boughton said he has made many trips up here from Southern California
to see what direction the City wanted the development of this property
to take. The plan is for a slump stone building with tile fascia and
extensive landscaping. He tried to keep the whole thing within the
periphery of what the City would like to see here. The sign is very
small in comparison to the size of ;,the building. He was cautioned
that it is imperative the entire air conditioning units be completely
hidden within the fascade of the bLildirg. It is real rather than
imitation slump stone. The tinted" glass is a dark brown with rather
a copper tone to it. The compl.etei.building will be used as an
insurance office. j

Chairman Ryner noted the absence of sidewalks on the plan.
Mr. Boughton said the sidewalks are entirely around the property.
There is an elevated walkway to the rear door from the parking
lot and one leading to the front door, with public sidewalks all
the way around.

Landscaping
Mr. Boughton said the plans were drawn by a party here in Cupertin
so they would know what plants would do'best in this area. The
Architect and the landscape people have received copies of the
H-Control conditions.
Member Adams asked about the fencing. The Planning Director said
there is an existing redwood fence. This particular zoning does
not require a masonry wall between it and residential property.
Mr. Zems said he understood at the time of rezoning that there
would be a screen of evergreens along his property line. He sug-
gested Italian Cypress. The present plans call for low plantings:
Member Adams noted the plans call for a slump stone trash enclosurE
in the corner. He recommended the addition of some taller -growing
shrubbery to offer the adjacent, single -story units more privacy.

Lighting
Mr. Boughton said there is an overhang around the entire building.
On the bottom side of this overhang the lights are flush. There
are two lights over the sign up, under the soffitt and they will
shine toward the sign. There will be 3 of.the eyeball fixtures.
In addition, there will be fixtures over .the front door and two
rear doors. They will be flush with the soffitt. There will be a
starlight, roof -mounted light to illuminate the.parking lot.
These will be mounted above the tile. Most workis done during
the day, but it is sometimes dark before they all leave:the premise

Chairman Ryner asked the applicant if he had considered low-level
lights within the planter area rather than the roof lights. Mr.
Boughton said he is afraid of the potential vandalism; lights on
the roof will discourage this. Chairman Ryner said the low-level
lights should be considered because of the adjacent residential.
Signs
There will be a small logo sign, visible from Richwood Drive, and
the other sign will be fronting on!Miller.
Mr. Zems said the lights on the roof will do the job for the office
building but will be undesirable for the residents nearby. He felt
that low-level lighting would do tie iob better. Chairman Ryner
was in favor of 3 or 4 lights in the planter. Member McLaren was
concerned about the lighting of the parking lot. Mr. Boughton
wanted to light the parking lot because of the possibility of
theft of tires, etc., from the cars in the lot.
Mr. Zems said the type of roof lighting Mr. Boughton plans to use
won't give foot candles but will give foot Lamberts. He said they
are called "balls of fire" and can blind you at 500 feet. *He used
to be a Lighting Engineer with P.C.&'E and was involved in the
lighting in industrial parks, etc..,

Member Adams asked the applicant if he had considered the logo be
placed or. the middle rather than the corner of the building on

Mr. Carl Berg, 2775 Middlefield Road, Palo Alto, was present to discuss
the proposal.
The Planning Director said a previous plan has been approved by this
body. The applicant -is r;e-v involved in going before the Planning
Commission to adjust the lot lineslibetween Lots 13 and 14. The
request before this body at this time is to install a mechanical
equipment screen of cement, asbest6s board on the easterly (rear)
portion of the building. The screen will be painted to match the
existing screen presently on the westerly (front) section,
Mr. Berg said the only change is ttie North elevation to put in windows
as are on the South side. They are now putting in a two-story building
on Lot 14 and they, think it will be more pleasing to the occupants of
Lot 14 to look at windows and extensive landscaping rathet..than a blank
wall. He said they own both lots.

office building to be located on Lot 14, West Valley Industrial
Park.

The Planning Director said the proposal is for a 30,000 square foo
two-story office building.
Site
Mr. Carl Berg, 2775 Middlefield Road, Palo Alto, said silver dollar
eucalyptus and purple plum trees will be planted in the planting
strip between the driveways. In looking at the plans, Member Gattc
noted there would be only a 1' 6" wide planter in which to put
trees. Mr. Berg said he would have to check this out with the
landscape architect.
Member Gatto asked about the walkway. Mr. Berg said there will be
a walkway on the left side. Visitor parking is in the front and
employee parking in the rear. It was suggested they could increase
the width of the planter if the driveway were narrowed. Director
Sisk said that in West Valley Industrial Park, screening is pro-
vided for the parking. They are 8 to 10 spaces over the required
parking ratio, with the same ratio as Vallco Park. Only the top
floor is leased at this time.

Member Adams asked if the tenant for the ground floor will also need a
sign. Mr. Berg said they don't anticipate the need for a sign on the
outside of the building. a
In answer to Member McLaren's question, Mr. Berg said he feels con-
fident they have enough clearance for any future needs as to air
conditioning units on the roof. Member McLaren stressed the fact
that the City does not want any more fences constructed on the roofs
to conceal roof apurtenances.

Architecture
Mr. Berg stated that, instead of the normal tilt -up, it will be a very
heavy, rough wood and stucco structure with Spanish motif. There will
be a 6' wide balcony in the middle of. the front. The colors are dark
brown and cream -color stucco. They will probably use Mission tile in
some shade of red. Member McLarenisuggested they take a look at the
color of the roof the of the PaloOAlto Savings and Loan building.
Chairman Ryner asked about the trash enclosure. Mr. Berg said it is
composed of a 6' high redwood fence. Chairman Ryner noted that if built
as the plans indicate, a dipsy dumpster could never get in and out of
the trash enclosure; it probably needs to be redesigned.

Landscaping
Member McLaren asked for a presentaii tion of the landscaping adjacent
to the freeway. She feels that the ice plant indicated along the
trash enclosure is insufficient. Mr: Berg said there will be eleven
15-gallon silver dollar trees, five 5' to 6' redwood trees, and ice
plant will be used as a ground cover. By Ordinance, there is a 6'
minimum on trees.

Member Gatto asked what type of maintenance plan is proposed. Maintenance
Mr. Berg said they have a full-time gardener. plan

Lighting
In answer to Member Gatto's question about the exterior lighting,
Mr. Berg said they will be flush with the building and go straigh
up. There will be two lampposts at the corners of the rear of the
building. They can have them on a time clock. The applicant agree
to Member Gatto's suggestion to cut down the 125 watt lights.

property for four cars to be removed and replaced with landscaping
to more effectively screen the parking lot; reduce the light in-
tensity at the base of the columns to under 100 watts; and the
trash enclosure is to be redesigned to insure access to the dipsy
dumpster. .

11. Application HC-51,241.5 -- Oak Meadows Development Corporation
requesting approval of site, architecture and landscaping for
a 211-unit condominium development to be located.1600 feet
west of Foothill Expressway on Fermanente Road.

After having sat through the City Council meetings on this proposed
development, Chairman_ Ryner decided to set some ground rules, It
was not his intent to cut off any valid and/or relevant discussion,
but he wanted the audience to refrain from repetitive discussion.
The Planning Director said the landscaping will come before this
Committee at a later date. PD zoning has been granted to this pro-
perty. The common green areas will be owned and maintained by the
Homeowners' Association. The residential units have been clustered
in the flat area, with the hilltop remaining as open. space. The �
parking ratio is 4.45. There will be two parking stalls for each
unit as well as visitor parking areas. No more than 30% of the
structures in the southeast,corner of the property can be 2-story.
Slides of the site plan were shown and described. Of major im-
portance is the intention to retain the mature oaks on the property
There should be provision for children to get to the schools.
Instead of improving Voss Avenue for access to the schools, the
applicant proposed extending sidewalks to continue down Stevens
Creek Blvd. to Lebanon. There will be a tunneling effect coming
through the sound mound for access to Stevens Creek Blvd.
Elevations showed the types of structures and. roof lines. There
will be some retaining walls throughout the project. The majority
of the units will be able to gain the 20 x 20 garage enclosures,
except there will be a problem in the southeast corner.
Mr. Barry Bobbitt, 7291 Coronado Avenue, San Jose, said 17.1 of the
43 acres will be left open for'public use. Member Gatto asked if
the public would gain access to this open space. The Planning
Director said this has not as yet been resolved. The City wants
to retain an easement for bike paths, etc., up there.
Mr. Bobbitt said they do not plan to do any contouring in Phase I.
There will be a specially designed sound mound, a slump stone wall
and generous landscaping along Stevens Creek Blvd. The street
pattern has been kept to a minimum that will serve all the people.
Every effort will be made to preserve the mature oaks. The tunnel
is 8' high, and it will be lit and landscaped. They are anticipatii
a 23 - 25 month time table. The recreation building will be
included in Unit III or IV. All utilities will be underground,
including radio and TV antennae. On the south property line there
is a difference of about 9 feet between this and the. neighbors'
property.

In answer to Member Adams, Mr. Bobbitt said the living units will run
1100 square feet to 1800 square feet. They will cost between $28,000
plus optionals and $35,000 plus optionals.
Mr.. Bobbitt said they have installed a 36' concrete pipe to take the
water off the land.
The Planning Director commented that there will be a 9' wall next to
one of the units. Mr. Bobbitt said;he already has a buyer for this
unit who is an ardent handball player.
The location of some of the mature trees dictate custom homes will
have to be built around them.
Member Adams commented that when there are fires in the foothills down
in Southern California. they spread like mad. He asked what provisions
have been made to guard aga..nst this Mr. Bobbitt said they are using
fire retardent roof materials. Oak:'trees run down into the recreation
areas.
Member Gatto asked for an explanati6n!on how they arrived at the
decision to have these long rows of houses. Mr. Bobbitt explained
the staggered buildings and roof lines. He said there will be a
minimum amount of grading in the soUtlaeast corner of the property
because of the neighbors and because of the mature oak trees. He
said there is a distance of from 851'to 105 feet from the backs of
these homes to those of the neighbors'
Mr. Charles Lowe, 10i10 Lebanon Drive, asked about the time table. He
asked at what point in the development does the sound mound and wall
go in. He also asked about.the wall on the east boundary. He thinks
there should be a more care-ful look at the tunnel that will bring the
children right out onto Permanente Road. It would be shorter to go to
Voss Avenue. Mr. Bobbitt-said thejchildren will come from the under-
pass onto a sidewalk. The redwood b' fence is still going to be there
before you get to Permanente Road. ::she lower part of the sound mound
will be built with Phase I and the balance as soon as possible. The
east boundary fence will be built along with those units, Phases II and
III.
1-story versus IMr. Francis Wallace, 2284 Medina Lamle, said there is a very low spot in
the southeast corner that is an old"creel,_ bed. When the duplexes

along Medina were built they were r+stricted to one-story. He felt
this restriction should carry-over to the adjoining development.
Mr. Bobbit said there will be six-listory and five 2--story units on the

Mr. Franks, 10201 Lebanon Drive, said he was not aware until this
meeting of the restricted use of the open space at the top of the
hill. He also wanted to know whose responsibility -it is if there
are any drainage problems. The Planning Director said it is the
responsibility of the developer to construct and maintain proper
drainage. The City wants the top of the hill left open for bike
trails, etc., that are left open. Mr. Bobbitt said he would like
to see the top of the hill made into a City Park at some point in
time. It is not as steep as.Linda Vista Park.

Mr. Bobbitt next discussed the architecture. He said the units

has been spent by the architect and interior decorator to make sure
they did not create a step or stacking effect. Only the top of the
gable of a single -story home would show over the 14-15' sound mound
The underpass will be of smooth concrete. They will'put wood
timbers or something similar at each end of it. The sound mound
can be walked up and will be landscaped. There will be a 6' masonr
wall on top of the sound mound. They are using earth tone colors.
The heavy siding will be painted earth colors. Heavy cedar shakes
will be used on the roofs. There will be functional fireplaces of
masonry with wood trim.
Member Gatto questioned the wall and mound. It will be within a
couple of feet of the eave line. He asked why they are hiding the
buildings. Mr. Bobbitt said their only aim is to make it pleasant.
All banks will be contoured with an undulating effect. It is a
distance of 50 - 60` from the slump wall to the rear of the homes.
On the westerly portion, the sound mound can either have or not have
a wall on it.
Member Adams was concerned about the roof lines.
Member Gatto said the site plan and linearity of the plan seem to
be in conflict with the terrain. Individuality is needed for the
units. He feels they are fighting the natural terrain of the hill.
Mr. Bobbitt said all the homes going down the hill will have decks.
Patios will be furnished where there are no decks.

MINUTES OF THE DECEMBER 6. 1971 H--CONTROL:MEETING
The trash and garbage pickup will be just like in regular homes.
Garage door openers will be furnished.
Mrs. Francis Wallace, 22848 Medina,'wanted to know what the roof lines
will look like from their duplex across the fence. She was told they
will see a back gable coming down and a single story.
Mr. Charles Lowe, 10131 Lebanon Drive asked if the developer has
gotten away from the 2-story returning to a single story type home.
Mr. Bobbitt said this has not been changed.
Mr. Bobbitt said they are consolidating their 2-story units toward
the center of the project. The open space is basically confined to
the top of the hill.
Chairman Ryner asked if there were any more comments from the
audience because this is the last opportunity to speak up. When this
(comes before the City Council again;it will not be a public hearing.

Mrs. Wallace does not want two --story units on the south boundary.
imr. Richard DeLuis, 22816 Medina, said he and Mr. Wallace own all
,the property along Medina and;they object to two-story homes along
(tine south side. Mr. Bobbitt said he understands their concern and
Twill try to cooperate wherever possible.
Member Adams wondered if the publicjconcern about the two-story units
Fs due to blocking the view or the lack of privacy. He, personally,
jcould see no objection to their seeng'the roof lines and possibly
the tops of the windows. Mrs. Wallace said they experienced this
situation before and they lost $5,000'!to $7,000 because of the loss
(of view and privacy. She can't visualize an attractive wall of wood.
She asked again to see renderings from their point of view of their
duplex.
Member Admas asked the applicant if'';he would be willing to have only
single story homes on the south side. Mr. Bobbitt said they are
(trying to avoid a step effect and want to vary the elevations.

Member Gatto was concerned about the almost continuous wall around
the property. The linearity conflicts with the contours of the
property. The architecture does not form a unified project. He
would like a more definitive rendering of the architecture
correlation of the contours of the site. On these bases, he moved
for a continuance.
Member Admas feels he has not seen enough of the precise archi-
tectural plans to make a decision.
Member McLaren noted these people are not protesting the plan, but
have specific points to which they object.
