Roll Call Members present: Marquez, McLaren, Ryner, Small and Chairman Adams. Also in attendance: Chief Building Inspector Benevich, Public Works Director Yarborough and Recording Secretary Dolores White. Minutes of the Previous Meetin 1. Approval of Architectural and Site Approval Minutes of October 7, 1970. After a correction had been. noted by Member MCLaren on Page 5, fourth paragraph, it was moved by Member Ryner; seconded by Member Small and passed unanimously that the minutes of the meeting of October 7, 1970 be approved as corrected. Written Communications 1. From Jerome M. White and Associates, Inc., Developers, con- firming incorporation of irrigation and lighting system within the Lake Biltmore Apartments plan. It was moved by Member Small, seconded by Member Marquez and passed unanimously that the correspondence received from Jerome M. White and Associates, Inc., Developers be recognized as received and filed. 2. From Mr. Pat O'Connell of Sterling Homes regarding modifica- tion of condition pertaining to W estridge Village. Public Works Director Yarborough -reported that the Building Department had brought to the staff's attention that the installation of header boards was being substituted in lieu of curbing in the Westridge Village development and, after some review, it was suggested that the developer apply for a Variance if he was unable to comply with the condition and offer his reasons for non-compliance. He indicated his concern that,in the many times the plans had crossed the hands of the Building Department and Engineering Department, this particular item had not been questioned previously. Mr. Yarborough expressed his feeling that, due to the fact that the 12 Standard Conditions of H-Control and the Planning Department have been confused and misinterpreted many times in the past, the mistake i, in this case had been a legitmate one. It was -recommended that a staff report be received for the record as to when the application had been approved and under what conditions and, further, that the matter be referred back to the staff for their conclusions. He said the information was insufficient at this time to meet with any final conclusion. A further suggestion was made by Member Small that the development located on Homestead Road be investigated for comparative purposes. Application No. 51.,244-41F6-HC-70 of Otsen Signs for replacing existing Richfield sign with ARCO sign at service station located at the southeast corner of intersection of Saratoga - Sunnyvale Road and Silvejado Avenue. Public Works Director Yarborough described the application while showing slides and indicated Richfield Oil C�Ompany is in the process of convert-' ing all of their existing signs throughout the country to the new ARCO signs. He said.the only condition recommended would be landscaping to be placed beneath the sign on the site, adding -that the applicant had been 'requested to presentea landscaping plan. The applicant,'Mr. McLey of Otsen Sign Company, Campbell, advanced to the podium and indicated that he ha received a letter recently from the City pertaining to the landscaping. He said that the Atlantic - Richfield Company was agreeable to the addition of landscaping beneath the sign as requested. Mr. McLey continued by reading the letter of approval from a representa- tive of Atlantic -Richfield Company. He said that a letter -.to the City would also be forthcoming to confirrr approval. It was suggested by Mr. Yarborough that items of minor nature be delegated to the staff for handling; leaving major items to be reviewed by the Committee. He indicated his feeling that items con- cerning landscaping were of a minor nature and could be handled in a sufficient manner by the'Staff Cort}mittee. Chairman Adams informed the applicant that this application would be before the City Council at their next meeting to be held on November 2, 1970, and suggested the applicant be present for comment at that time. 5. Application No. 51,209-480-!IC-70 of Otsen Signs for replacing existing Richfield sign with ARCO sign at service station located at the northwest corner of intersection of Saratoga - Sunnyvale Road and Valley Green Drive. Application No. 51,015-482-HC-70 of Federal Sign and Signal Corporation for sign for Huston's Gifts located in the Cross- roads Shopping Center adjacent to Mervyn's Department Store. In response to an inquiry from Chairman Adams, 1fr. Yarborough informed 51,015-482- the Committee members that the only consideration involved in the HC-70 ® application was pertaining to the copy on the proposed sign. He addedithat the sign would be internally illuminated. The standardization of'all signs within the complex had been previously approved,, according"to Mr. Benevich, and the only. vote to be -taken at this time would be on the copy. It was moved by Member Small and seconded by Member Ryner that Applica- tion No. 51,015-482-HC-70 be recommended to the City Council for approval at their next regular meeting'. He then thanked the Committee for approving the application and indicated he would be giving the Staff Committee -suggestions pertaining to improve- ment of procedures which could be a aid to them. 7. -Application No. 51;243-477 HC-70 of Cupertino Day Nursery School for building sign for school'located on the south side of Cali Avenue, east of Saratoga -Sunnyvale Road. Public Works Director Yarborough reiorted that contact had been'made with the„applicant following'the staff meeting,at which time it was suggested that said applicant bring.in a diagram of -the sign.as proposed. While showing slides, Mr. Yarborough described the sign as being approximately,one-half of the square footage allowed in the Sign Ordinance, having dimensions of approximately 10 feet in width with the height varying from approximately 26 inches on the sides to 36 inches in the center. He said tie items of primary importance to the Committee at this time were 'the colors, placement and message on .the sign. It was suggested by Member Ryner that the matter be continued until proper drawings and sufficient information is presented as referred to on the application form. Member Marquez was in agreement with Mr. Ryner and further commented that, in his opinion, the sign as presented was not a very professional one. It was' moved by Member Ryner; seconded by Member Marquez and passed unanimously that Application No. 51l243-477-HC-70 be continued to the next meeting of this Committee to allow the applicant the opportunity to submit sign plans,as well as dimensional or plot plans in relation- ship to direction of streets as to $ign location. The applicant identified himself as Jack Jones residing at 3239 Country- side Drive, San Mateo. 8. Application No. 51,002.1-478-HC-70 of Melcher Construction Company for a four -unit apartment building located on the south side of Salem Avenue near Foothill Boulevard. Public Works Director Yarborough presented slides,commenting that the 51 002.1- plot plan involved in this application had been revised to;conform 478-HC-70 with the Zoning Ordinance. He said the complex is of the basic nresentatior apartment -house type construction incorporating a shake roof and added that this type of design is similar to many others throughout. the valley. A building modification had been made at the rear of the property to provide for enclosed parking and the applicant had also made provision for minimum clearance near the garage area. Mr. Melcher of Melcher Construction Company, applicant, commented that the color of the building was to be a sand gold with a dark brown trim, would have a shake roof, Spanish planters and trim around the I windows, and stucco walls. Mr. Yarborough reported that an additional condition had been added since he had last spoken to the applicant. The Building Department, he said, has recommended a bond be posted until the landscaping can be installed to guarantee the conditions of approval would be abided. by. Mr. Melcher voiced his objection to posting a $500.00 bond on the land- bond objec- scaping,suggesting a clause be added to the conditions that final tioii voiced approval would not be given until the landscaping was completed. Mr. J. Robert Dempster came forth from the audience voicing his concern as to the many burdens presently being placed upon local sub -dividers and builders. He said many of the present conditions used -to relate only to commercial buildings and added that require- ments have now become unreasonable. Member Small responded to Mr. Dempster's comments by saying, that,when a builder sells his apartment house, the City has no control over , upkeep of the property. He felt the conditions should be upheld as in every other application and, hopefully, the purchaser will maintain the property. further dialogue Chief Building Inspector Benevich offered his opinion that a four-plex apartment house complex is a commercial venture and should be treated ® as any other application located in a commercial area. The applicant had requested placement of the ARCO sign in the corner triangle which would be in conformance to the ordinance if higher than i o feet so as not to obstruct the view of motorists. The sign, itself, is a standard ARCO sign as previously approved and would be in accor- dance with the Sign Ordinance. A suggestion had been made that the structure supporting the sign be of slumpstone or wood to tie in with the building. Mr. Yarborough continued that the lighting fixtures were shown on the plans and would be the same as the service station on Homestead Road and Wolfe Road. s In addition, the driveway access would be surrendered, according to further the applicant, at such time as traffic conditions change in the area, description. The Committee was reminded by Mr. Yarborough that they were the only 4 review process through which this application would pass and that this application would not be reviewed by the City Council. Mr. Dempster, 20325 Stevens Creep, Boulevard, commented that drainage on the sloped area would be provided for; the lighting would be of the low standard type with 360' light, as recommended by the City and presently incorporated into the service station on Homestead Road and Wolfe Road; and the telephone w.opld be. located within the building. In concluding, Mr. Dempster said the applicant had been caught .in the policy change and modifications had been made to comply with conditions within a period of four days, adding that any additional requirements would be complied with to meet standards as revised. ! The lighting shall be of a diffused soffet type,which is not visible from the street,with the exception of the driveway lighting to be light standards not to exceed 36 inches in height with a light display of 360 degrees. The owner of the property, Mrs. Messina, residing at 12421 North Capitol Avenue, San Jose, came forward commenting that landscaping plans had been revised, adding that a copy of the revisions had been previously given to Mr. Benevich for his information. Chairman Adams requested that it be made part of the record that the plan included removal of the existing raphiolepsis and installation of 5-gallon junipers. Aftera short discussion regarding proposed landscaping, Member Ryner questioned Mrs. Messina (who also owns the Burger Chef Restaurant) as to the exposed refuse area at the said establishment. The Committee members were informed by Mr. Benevich that an architect was working on plans for this area to make it less obvious to the public. In continuing, Mr. Benevich said the City Council was holding approval of the application in abeyance pending landscaping approval by the Architectural and Site Approval Committee. It was suggested that a Minute Order be initiated indicating approval of the landscaping for presentation to the staff. It was so moved by Member Marquez, seconded by Member McLaren and passed unanimously by the Committee. The discussion reverted back to a question which arose at the previous meeting wherein it suggested that Phase C of Application 473-HC-70, pertaining to signs, be continued for clarification of the Sign Ordinance. Mr. Yarborough indicated the staff recommendation after considering the Sign Ordinance in its entirety to be that a sign be placed at the rear of the landscaping instead of the two signs on adjacent streets as .proposed originally. It had been suggested, he said, that the sign be placed in this location at an angle to both streets. It was commmented by Mr. Benevich that the sign was 9 feet'x 10 feet (180'total square feet) and added that Standard Oil Company was in favor of placing the sign outside of the line -of -site triangle in this instance. While showing drawings to the Committee, he said that a portion of the existing building front had been prepared with a facing of redwood batts as a sample, adding a, suggestion that the members examine this facade as well as tiielremainder of the facility and give their opinions and recommendations. For expediency, Chairman Adams recommended that each member visit the facility on an individual basis, ratifier than as a group,, and that the discussion be continued at the; next regularly scheduled meeting. Some of the ideas for future use Of the yard were as follows: to build a room onto the area placing it adjacent to sheet metal buildings for lockers, lavatories and a lunch room for employees' use; to place landscaping in the middle of the area; and to establish parking areas on the property. He said it had been considered to defer the expansion of the building to concentrate on.the items previously mentioned. In continuing, he said planning ahead for future employees is a problem which also must be solved. The Sanitation Board is presently reviewing sewer services for this location also and this information will be supplied to the members when word; is received.
