CC Resolution No. 19-133 Accepting the Carmen Rd Pedestrian Bicycle Bridge Feasibility Study Report Conducted by Mott Macdonald RESOLUTION NO. 19-133 A RESOLUTION OF THE CUPERTINO CITY COUNCIL ACCEPTING THE CARMEN ROAD PEDESTRIAN/BICYCLE BRIDGE FEASIBILITY STUDY REPORT CONDUCTED BY MOTT MACDONALD WHEREAS, the Carmen Road Pedestrian/Bicycle Bridge is consistent with General Plan: Community Vision 2015-2040 Policy M-2.3: Connectivity; and WHEREAS, the Carmen Road Pedestrian/Bicycle Bridge Grade Separated Crossing Study is identified within the City of Cupertino 2016 Bicycle Transportation Plan as a Tier 2 project and within the City of Cupertino 2018 Pedestrian Transportation Plan as a Tier 1 Grade Separated project; and WHEREAS, Community outreach has occurred at the following community meetings: j • Community Meeting #1,January 24, 2019 • Community Meeting #2, May 29, 2019 WHEREAS, acceptance of the Carmen Road Pedestrian/Bicycle Bridge Feasibility Study Report is to accept the findings of the study only and does not include the approval of design and/or construction. NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby accept the Carmen Road Pedestrian/Bicycle Bridge Feasibility Study Report. BE IT FURTHER RESOLVED that this Resolution is not a project under the requirements of the California Environmental Quality Act, together with related State CEQA Guidelines (collectively, "CEQA") because it has no potential for resulting in physical change in the environment, either directly or ultimately. In the event that this Resolution is found to be a project under CEQA, it is subject to the CEQA exemption contained in CEQA Guidelines section 15061(b)(3) because it can be seen with certainty to have no possibility of a significant effect on the environment. CEQA applies only to projects which have the potential of causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. In this circumstance, the acceptance of the feasibility report would have no impact on the environment. The foregoing determination is made by the City Council in its independent judgment.
