A RESOLUTION OF THE ARCHITECTURAL AND SITE APPROVAL COMMITTEE OF THE CITY
OF CUPERTINO
WHEREAS, the applicant has submitted an application requesting approval of
site, architecture, landscaping, grading, lighting and undergrounding of
utilities for twenty-nine single-family cluster residential units and three
single-family detached residential units with exhibits regarding the property
as indicated:
PROPERTY OWNER: Chester Ea Damico (Attorney in fact)^for family
APPLICANT: Mackay Homes, Division of Kaiser Aetna
ADDRESS: 1030 Curtis .Street, Menlo Park, California94025
LOCATION OF PROPERTY: Adjacent to and westerly of McClellan Road. approximately
250 feet westerly of the intersection of Byrne Avenue
ZONE: RIC-7 0.5
FIRE ZONE: 3
WHEREAS, the Architectural and Site Approval Committee has reviewed the
application with regard to the areas of aesthetics and site plan,
THEREFORE, BE IT RESOLVED THAT THE COMMITTEE RECOMMENDS approval of site,
architecture, landscaping, grading, lighting and undergrounding of utilities
subject to H--Control Standard Conditions and as indicated on Exhibits A, B, B-1,
B--2, B-3, B-4, C Ist Revision, C-•-1, D & E and subject to the following conditions.:
1. That air conditioning units be screened either` behind fences or
placed within the tenant's patios.
2. That the public deck included in the application be modified to
be a stand-up observation point to be aesthetically pleasing to
the historical marker.
3. That the selection of the street trees species be left to. the
City staff with the minimum size of fifteen (15) gallon.
4. That two pole lights be;added to, .the slope section of the property
in and near the benches adjacent to the pathways. Said lighting
shall be placed in a position to attempt to prevent vandalism.
5. That.the landscaping area outside of the fence along McClellan Road
include plantings spaced at occasional distances of heights of five (5)
or six (6) feet to help break up the fence line.
6e That all plants on the McClellan Road frontage be increased to
five (5) gallon size.
7.4 > That the scope of landscaping approval be limited to the developed
portion of the property and the upper portion of the Stevens Creek
Flood Plain bank as described by Exhibit C lst Revision.
8. That the developer shall either post a suitable performance bond
_ or deposit an amount of cash with the City of Cupertino to guarantee
completion; of landscaping work on the lower portion of the Stevens
Creek Flood Plain bank as described by Exhibit C lst Revision. The
amount of `,said bond or cash deposit shall be determined .by the
developer and Director of Public Works.

9. That should the developer or the Homeowiw rs Association desire to
construct a fence on the property line between the flood plain and
their property, the design of said fence shall be subject to review
by the Architectural and Site Approval Committee. The cost of said
fence shall be born entirely by the developer or Homeowners Association.
10. That the landscaping 1`or the lower segment of the Stevens Creek Flood
Plain bank shall be planned and developed in conjunction with the
development of the adjoining segment of the Horse Ranch Park. Said
landscaping planting and installation shall be regulated by the City.
11. That the Committee compliment the applicant on his presentation and
development
All conditions outlined here in are subject to the approval of the City Council
and their action is required for final apYroval of this application.

the Architectural and Site Approval Committee of the City of Cupertino, State
of California, by the following roll call vote:
