Staff report: Staff member Kramer reminded the committee the sign
portion of this application had been reviewed previously. The .proposed sign k
follows the basic intent of the new Design Guidelines for the Saich corner.
The landscaping has been executed by Jim Coleman and includes modifications k11

to the site. These modifications have incorporated the suggestions made for
mounding; clumping of trees and shrubs Ground cover ,in front will be grass�E
All plants along the street frontage are'5-gallon size or larger.
Lighting, calls for two standards. Applicant has stated that pole suggested

Slides were shown of building sign "Steaks, Shakes and Pancakes". These letter
will cover an area 5' x 5'3" which will be within ordinance.
Slides of lighting planned on building and the decorative lanterns were shown.
Mr. Jim Coleman, architect, answered I'iember Koenitzer that the street trees for
Alves Drive had not been determined as yet.
Member Koenitzer questioned the growth habits of several proposed plantings; he
said all trees seemed to be deciduous. Mr. Coleman pointed out several ever-
green trees.
In answer to Member Weinstein, Mr. Coleman said that the mounding to the right
of parking entrance was approximately 30". He described the mounding plan. He
assured Member Sallan that the mounding and covering would give adequate screen-
ing.
Member Koenitzer said he would like the tree in front of the building to be an
evergreen; also some raised area or. curb at Alves Drive. Mr. Coleman said
there is 23' from curb to the parking lot with 5' sidewalks: There will be
plants of varying heights which will screen autos. On some mounding, there will
be a flowering ground cover to give accent.
Member Sallan said the variety was good. She would like Liquidambar substi-
tuted along Highway 9 and in the parking area. All plants should be 5-gallon
except those really close to the building. Mr. Coleman pointed out he followed
the theory of 1-gallon plants for fast growing items and 5-gallon size for slow
growing items. Member Sallan said those plants were not that fast growing and
directly abut cars. She said.there was a choice of increasing from 1 to 5
gallon size or some type of mounding approach on Alves Drive. Everything north
of sidewalk could be mounded in varying degrees.
Member Sallan also questioned distances on center of plantings. She was concerned
about 5'-6' distances, feeling they should be 3'-4', particularly for the park.
perimeters.. Also Rhus-lancea tree could be 15-gallon on Alves Drive side.
In answer to Member Weinstein, it was explained the garbage disposal area is
inside the building.
Mr. Victor Newlove, 5767 Wilshire Blvd., Los Angeles, architect, signed in to
answer questions on lighting. Ile said it would take approximately 14 weeks to
obtain the Weyerhauser poles and the restaurant plans on opening in 4 or 5 weeks.
He said he did not like globes in par -King lots; they emphasize the poles and the
parking area. He proposed to go to something more efficient for lighting the
parking area. He showed the light source used by Clean Scene and noted some
light would be coming from street lights.
Member Weinstein pointed out the committee had proposed to implement uniformity
of lighting for this quadrant. Other applicants for this quadrant should be
contacted so uniformity could be maintained.

Member Sallan expressed concern that any action counter to guidelines would
adversely affect guidelines.
Mr. Newlove was asked why the poles had not been ordered earlier. He said
they had not wanted to order something they objected to. Chairman McLaren
noted.the committee had not been notified of their objection's,

The possibility of opening without lights was discussed. Ms. Kramer said
they could put up temporary lighting. She also noted.the applicant's
opposition to globes and suggested perhaps the globe could be changed
as a compromise o
Mr. Robert Eakin, 2270 Kendle St.; Cupertino said the electrician had order
ed.the light standards and reported there would be a 14-week delay for any
Weyerhauser pole.
Chairman McLaren--asked if there was an alternate sign, Mr. Eakin said this
was what had been used on new installation across the street• and. they assum-
ed this was the desire of the committee.
Chairman McLaren . asked if the committee felt. this portion of the application
should be continued to consider other lighting Member Koenitzer said if
the standards were to be changed, he would like to re -open consideration of
lighting for the entire center.
It was noted�lr- Eakin had been by-passed in this discussions Staff had
been under the impression Bob's Big Boy had been notified,, but they had not.
Chairman McLaren said she felt more study was needed. She asked -the appli-
cant to come in with more information and other light standards to be con-
sidered. Member Koenitzer felt staff should be aware that this should not
hold up opening approval. Member Sallan said the manufacturer should'be
contacted by :the City to verify -situation and lend support for need'of
Bob's Big Boy for opening,
Member Weinstein expressed his,, concern for some quantative measure for
lighting; particularly the concept of many more poles of 5to 6',.,,height
of low intensity, Mr. Newlove said he relies on his electrical engineer
and manufacturers of lights themselves ;

Chairman McLaren suggested Mr. Eakin and Mr. Boyd get together during the
break and discuss lighting possibilities. sir. Boyd said they would be
getting the Weyerhauser poles without any delay according to the Weyerhauser
representative.
Signing: Member Weinstein said this was a marked improvement over the other
sign and generally within guidelines. He asked if the applicant would have
any objection to reversing the colors. He said the "Steaks, Shakes and Pan-
cakes" sign was of no value and would detract from the facade. He did not
think it was necessary.
Member Koenitzer said he did not feel the sign was unreasonable. He thought
there would be less light intensity at night with the red background than if
it were reversed. He was indifferent about the "Steak, Shakes and Pancakes"
sign.
Member Sallan asked about using some deep earth tone in place of the red on
the sign. Mr. Newlove said they preferred to use colors that have been used
for some 80 other stores as identity. Brown would not be as effective and
would not project image.
Chairman McLaren said she was pleased with the sign and the scaling down.
With the fast traffic on Highway 9, the "Steaks, Shakes and Pancakes" sign
would not be obtrusive. Mr. Newlove said this was graphic tradition of
Bob's Big Boy.
Member Weinstein ascertained the sign would be 8' above the sidewalk level.
Member Sallan suggested mounding on w=:_dest portion of landscaped area.
Chairman McLaren noted this was a Pub=-ic Hearing and opened the meeting to
comments from the audience. There were none.
Member Koenitzer moved, seconded by Member Weinstein, to close Public Hearings.

Revision, the lighting portion to be continued to next regularly scheduled
meeting at which time applicant and City will investigate original Weyerhauser
lighting to determine availability and to consider changes in styling for
light fixtures. The sign portion of the application is approved.

being planned by a nursery and in answer to Member Weinstein assured the
committee there would be sufficient ground cover.
Member Sallan noted landscaping along fence was discussed at the previous
meeting but was not shown on the revised plan.
After a brief discussion, Chairman McLaren opened the meeting to comments from
the audience. There were none.
Member Sallan moved, seconded by Member Koenitzer, to close Public Hearings.

Member Sallan moved to recommend to City Council approval of Application
HC-51,311.3, subject to standard H-Control conditions, enclosures C-lst
Revision, and with the additional conditions

(2) landscaping be provided along fence in west yard and it be of the

ing approval of site, architecture, -landscaping, grading, lighting and
signing for five single -story professional office buildings located at
the northwest corner of the intersection of Torre Avenue and Pacifica
Drive.

Staff report: Ms. Kramer used a tentative. map. of the northwest
corner of Torre Avenue and Pacific Avenue to point out site. Guidelines
used are those for Brian Terrace subdivision. There are five offices withi
one driveway into site. She.pointed ou.t.two trash enclosures, sign place-
ments and interconnecting parking area.
The roof tile has been changed to flat concrete to tie in architecturally
with the Frost office complex. A sample of tile and mate rial.on lighting
was distributed to committee.
Mr. Jim Jacobsen, 2828 N. Weshon, Fresno9':signed in.
There were no questions on site.
Architecture: The the would be dark red with antique tint to it. It
will show more red than indicated by sample. Exterior walls will be I
stucco finish of beige or chocolate color. 2x8 trim along bottom of dark
brown wood. At each entrance will be a wood deck coming out from building.
Windows will be tinted glass with anodized frames,
Member Koenitzer questioned the doorways. Mr. Jacobsen said the reason
for the keyhole effect was that from the wood deck to'the sun screen is
only 6' so cutouts had been made to allow for people's heads.
Chairman_McLaren questioned whether there were accomodations for disabled l
people. The applicant agreed to provide a ramp for wheelchair patients. .1
The air conditioning units are concealed behind parapet walls.
Wood screens are to provide light and also give privacy.
The trash enclosures were described. Thev will have wood doors and the
IP rest will be stucco finish similar in design to buildings.

Landscaping: Mr. Jacobsen described the planned landscaping. Member Sall a
said deciduous trees were good for accent, but she would like to have one
other one inserted on south side of entrance.
It was noted there would be no interference with visibility of traffic
flow by trees.
In discussing types of trees, Chairman McLaren noted the City had.had
problems with sidewalk damage from Oa1c tree roots.
Member Koenitzer noted the need for more base planting around the building,
especially building 5 at the east end. Mr. Jacobsen felt the berm and
creeper would be sufficient. Member Sallan noted creeper should cover
fast at 5' center.

Member Sallan questioned distances on center of oleander on west portion of
property. She felt 10' on center would still have spaces between. Mr. Jacobsen
said it depended on the type of oleander planted.
Grading has been approved.
Lighting: 8' standards with smoked glass were chosen. It was understood the
bulb would show through dark globe. 1,1ember Koenitzer asked about lighting
and it was explained there are 8 standards in the parking lot with additional
lights on the building.
Member Sallan said she liked the style but does not like to see light bulbs
inside. Mr. Jacobsen said the frosted bulb would give a soft light. Member
Weinstein suggested a clear bulb in the smoked glo.be.
Signing: These are only directcry.signs with names and locations. Materials
will be wood and the color will match the trim of the building. They .will be
6811 from base. The location of signs was discussed. Member Koenitzer suggest
either having another sign or locating the middle sign more centrally.
It was ascertained the owners had made arrangements for cut -through parking
lots. The parking site is already approved; the whole development will be
interconnected.
Chairman McLaren opened the meeting to comments from the audience. There
were none.
Member Koenitzer moved, seconded by Member Sallan, to close Public Hearings.

Member Koenitzer moved to recommend approval of HC-51,027.12 to the City
Council with standard H-Control conditions and Exhibits A, B, B-1, B-2,
C and C-1 with the following additional conditions:
(1) That at least one ramp be provided to each office for use by
handicapped people.
(2) That the Red Oak tree on Torre Avenue be changed to Holly Oak or
some other evergreen Oak tree of 15-gallon size.
(3) Directory sign for three buildings to the rear be moved to the
center facing the driveway on Torre Avenue so it can be seen
coming in that way.
(4) An additional tree be added on the south side of driveway with
possibly moving the other tree slightly to adjust for it.

4. Application HC-51,321<1 of Estate Homes, Inc. requesting
approval of landscaping for eleven. duplexes located on
Maxine Avenue southerly of Homestead Road adjacent to
Interstate -Route 85,
Staff report: Staff member Cowan said this was continued
from a meeting in August to allow staff and applicant to pursue de-
sign alternatives for the sound wall adjacent to the freeway. There k'
are two main, design constraints. (1) A certain amount of 'bureaucracy,
involved and (2) grading problems existing on property, The property
i.n_-thesouth. portion drains toward the freeway. The owner would have 1
to.import fill to create mound and existing orchard trees removed..

Alternates A -and B_were ruled out; Alternates C and D are proposals.
under consideration.

The staff recommendation is some landscaping be placed on State
right-of-way. The City's concern is impact of wall from the freeway.
Consultation with the landscape architect of the Highway Department
could determine what shrubs should be used. Borrowing landscaping
from inside to use,on outside of wall was suggested. Mr. Cowan said -
the State had preference for certain types of. plants.
Member Sallan complimented staff on application report which represent
thought and preparation in contacting people.
A slide transperancy of aerial photo showing existing trees and
property line was shown, 'Also slides of area and other sound wall
treatments in adjacent areas were shown.
Chairman McLaren polled the committee and they agreed with `Staff "
recommendation of Alternate D.

Member Koenitzer suggested a method whereby certain trees could be removed
from inside wall and placed outside so that the developer would have to add
very few new trees. lie said he was surprised to see oleanders being used in
back yards since they are poisonous.
Member Sallan said her preference is Alternate D. She suggested taking out
every other tree from inside of fence and placing to the outside. She
suggested the developer could add clumping of 3 or 4 bushes lower out on
the slope. Mr. Cowart said the State has a sprinkler system installed which
might be a constraint on planting further down on slope. He suggested the
committee should decide on number anc spacing, allowing State to come up
with ultimate detailed solution. The applicant could then build wall and
not be held UP.
Staff member Kramer said the builder could plant on State property before
building wall since it takes about 2 to 4 weeks to get full approval and
State permit. She noted 14 trees on outside of wall spaced between lots
1 to 9 should be sufficient. The State and staff could work out the
details.
Member Sallan said she would .like to see the ultimate solution proposed.
Member Weinstein.said he would not like to see an elimination of any trees
from inside wall. He felt there should be an additional 12 to 14 trees
planted on outside plus some sort of bush.
Mr. Merve Hansen, 1741 Frobisher Way, Gspertino,. said he was not in favor
of this discussion. lie wished to stay with Alternate C. He felt there
was some precedence here; where did the City get the authority to require
a builder to improve on property that he did not own? Chairman McLaren
expressed surprise that this had not been discussed with the developer.
Member Sallan pointed out the developer was not being required to plant
any extra plants, merely to intersperse from one side of wall to the other. •
Mr. Cowan pointed out it was not unusual for the City to require off -site
improvements. It was also noted that if the developer wasn't building on
this site, there would be no need foe the wall.
Mr. Hansen said they were paying $15-$1.6 a linear foot for a wall where it
would ordinarily cost $3.50 a linear foot. He realized the committee didn't
like economics but it does come into play. He said the fence would cost
$25,000 and now they wanted him to cover_ it up. Member Weinstein said the
purpose was to make it more aesthetic to the public and the additional trees
were only a matter of a few hundred dollars. Chairman McLaren pointed out this
is a problem piece of property and the City was trying to alleviate the
problem without creating a hardship.
Mr. Hansen aslced for pictures of simulated brick wall to shown and referred
committee to a brochure he had distributed. He described how wall could
look. Mr. Hansen said the trees on the inside would break up fence appear-
ance and fruit trees will have a softening effect.

Member Sallan said greenery was needed and the moving of the trees
from .one side of the fence to the other should not be a problem
economically. Mr. Hansen said the fruit trees were being left at
considerable'expense and the fence was a $255000 cost imposed by
the City of Cupertino,
Chairman McLaren pointed out drainage flow would.be toward the
highway and no fill would be. required by using Alternate Da Mr,
Hansen said there was no grading ,on rear of lots; they had approval
Of State to continue water flow. Another expense with the fence is
that fence will have a sand base so that water can seep under fence
and continue down the b ank .
Chairman McLaren said this problem is relatively simple if it can be
dealt with a local level and expressed hope for cooperation on the
_ part of the applicant. Mr. Hansen said the staff was aware,of his
feelings and that he had only received the written recommendation
in the mail a few days ago..
Chairman McLaren noted this was a Public Hearing and opened the -
meeting for comments from the audience. There were none,
Member Weinstein moved, seconded by Member Sallan., to close Public t

Chairman McLaren explained she had voted no because she felt they were getting
into something new and she would like to have more time and information on the
procedural aspect of working with the State.
She notified the applicant this would be heard by the City Council at their
November 19, 1973 meeting.
5. Application H C-5].,075.37 of Vallco Park, Ltd. (Intersil Parking
Lot addition) requesting approval of site, landscaping, grading
and lighting for the expansion of the off-street parking lot
located at 10900 Tantau Avenue.
Staff report: Staff member Cowan said the property involved in this
application is completely surrounded by other industrial property except the
southeast corner which is adiacent to single family residences in Santa Clara.
He referred to the two conditions ado-)ted by the Planning Commission and City
Council, Conditions 16 and 17 of Resolution No. 1206. Lighting was a concern.
Mr. William Tagg, 1619 Torrington Ave-Zue, Sunnyvale, said the lighting
standard is the same standard used in several other developments in Vallco
Park. The pole is 25' high with a doable light.
In answer to Chairman McLaren, IIr. Ta-,g said there is a buffering of landscaped
3' berm and redwood trees staggered 1)' on center. The closest fixture is 75'
from the property line.
Member Sallan questioned perimeter of illumination. Mr. Tagg said there would
be some light at base of fence until he trees are full grown. The fixtures
have a sharp cut off.
Member Weinstein asked if there had been any complaints about lights at
adjacent developments and '1fr. Tagg said there had not been any. He then
offered to move'the standard back to 85' from the property line.

adding one or two trees on small corner to cover cars.

Member Sallan recommended approval of Application HC-51,075.37 with
standard H Control conditions and Exhibits C and D with the following
additional conditions*
(1) That the lighting portion of the application is approved and
that subsequent to installation a review is still possible
should there be any problems generated by lighting fixture on
the property.
(2) That the fixture' designated 75' from south boundary line be
moved to approximately 85 ' from the property line.
(3) Relative to landscaping, that there be the addition of one
15-gallon tree in the planter area adjacent to the entrance
of the parking lot on Tantau Avenue. This to be a 15-gallon
can size of evergreen Ash or something similar.

ing approval of site, "architecture and landscaping for a nitro
MM gen gas 'plant located.at 10900 Tantau Avenue.

Staff report* This application involved the same site of Interstil
property. The applicant "is proposing to install a nitrogen gas 'plant
within the existing parking area. Mr. Cowan said the applicant would k
describe the building materials that would screen the nitrogen plant and'
the trash enclosure adjacent to it..
Mr. William Tagg, 1619 Torrington Avenue, Sunnyvale, said the materials
would be the same as on existing structure on. site.
Landscaping* Staff suggested gas installation facing single "fam ly
residences have -ample trees for coverage.
The trash enclosure is adjacent to and southerly of the gas plant'. .The
cold storage box extends above wall but it is. about 400' from property
line andthere are trees in between.

Member Weinstein asked if tilere would be any gaseous emissions. Mr. Roy
Stark, Union Carbide representative, said no, they would be invisible.
He said it goes through several mufflers so it will not be heard or seen.
Member Sallan inquired how plant would function, i.e, if there would be
any truck traffic. I'Ar. Stark s aid no, the plant was proposed to eliminate
all but about 5 trucks a month.
It was ascertained there would be noshing noxious about the emissions.
Member Koenitzer questioned noise generated by the cooling tower, vaporizer,
etc. Mr. Stark said considerable work had been done on this. They had
retained an independent testing lab :o establish noise level now at the
property line. The client has agreed there will be no change; i.e, nothing
over the ambient level of 50-53 deci'-)els.
Architecture: Same materials will be used; light tan slumpstone with wood
cap across top. 'Ir. Stark described intent to completely harmonize with
surroundings.
Landscaping: Chairman McLaren asked about screening of cold box tank. Mr.
Stark said it will be following same existing landscaping plan. He noted
the cold box tank is recessed into a 7' pit.
Member Koenitzer said he would like to see some taller planting around side.
The wall is 14' high and plants are :.'-3' shrubs. He suggested using Italian
Cypress. Mr. Stark pointed out narr��., space available and said they were
afraid the car bumpers would destroy any plants extending above bumper
height. Ile also said he did not think a lot of trees would be in harmony.
They had hoped to get something that would grow up wall. Ivy was suggested.
A discussion of planting along wall Around cold box tank was held.
Mr. Stark suggested contacting landscape architect to determine the best •
solution.
Chairman McLaren announced this was Public Hearing and opened the meeting
to comments from the audience. Therc-were none.

9. Application HC-51,050.3 of John Brooks Boyd representing
Bank of America requesting modification of the.si-gn
exception for the Bank of America located at the north
side of Stevens Creek Boulevard approximately 300 feet
west of Saratoga -Sunnyvale Road.

Staff report: Mr. Cowan reminded the committee this applica
tion received approval for .a sign exception. in September. When this
committee reviewed it, they indicated they felt the sign in front was
too big. The applicant is now willing to reduce sign to 8' x Pl",
and to trade the two logos on the north and east elevations for the:
Bank of America words to be placed next to doors on the west and
south elevations.
Mr. John Boyd, 454;Forest Avenue, Palo Alto, passed two photos
around. He said the bank felt people would not be able to identify
the bank by the logos alone.
In answer to Member. Sallan, Mr. Boyd explained when the ASAC had,,
asked for the. sign to be lowered, it became out of scale., People
coming down the street may or may not see sign. When you pull into
parking lot, the sign will be hidden. The bank would like to E
identify entrance. They are asking the committee to trade a smaller
sign at the street for words to identify the building from the park-
ing lot.
Member Weinstein said he could not support the change.
Member Koenitzer said he did not; see why l' high letters would be
needed to identify the entrance. Mr. Boyd offered to change -letters
to loll, but Member Koenitzer suggested 4" letters. Mr. Boyd.pointed
out letters are-10' back under the canopy.
Member Sallan noted there was now no identifying of building on the
north side and asked why this was not now important. Mr. Boyd said
it was still important to them, but they felt it was more important
to have bank identified at .the,street. level.

NEW BUSINESS:
It was explained the staff is initiating a new program whereby one
member of the staff will be part of inspecting party to make sure
landscaping is done as approved. Member Sallan proposed an addition
to conditions. Mr. Cowan said there are not that many cases when then
landscaping was not maintained, but in such case the bonding program
or cash deposit could be required.
Ms. Kramer said the°Karpet King people had been contacted about their!
sign and would be followed closely to make sure they conform.
Member Weinstein introduced two things to staff - an article about
what Palo Alto is doing about signs and sign ordinances and he
suggested the committeenotice the Holiday Inn sign in Palo Alto.
Chairman McLaren referred to the San Jose Realtors 'bulletin of
October 18 relating to signs for open houses and violations. She
also referred to Member Koenitzer's sign ordinance preamble.
