jMr. Edwin J. Myers, 10601 So. Saratoga --Sunnyvale Road, Cupertino, said the
(committee's guidelines had been followed with one exception, which was to
;delete two parking spaces halfway between two planter strips on Stevens
'Creek Boulevard and put in one plantin; strip. The owner felt since at
other end of property where street light controller would be going in,
;causing loss of parking spaces and because of complaints from the beauty
parlor in Montgomery Place, they could not afford to lose two more spaces.
He said they had added trees, and changed size as suggested and felt they
,had complied with wishes of committee.

,Member Weinstein said the landscaping plan appeared to be adequate, and
!the height of the planting along Stevens Creek Boulevard seemed to be
I'sufficient to screen autos.
!Member Koenitzer questioned whether 5' centers were close enough.

.property and the tenants did not want to be obliterated from the road;
they wanted to be seen.

''Vice -Chairman Sallan said it was the ccn.mittee's intent that the plantings
,would be such to hide the cars, not thc. buildings. She noted she liked the
,'selection of plants, particularly alonz; the Stevens Creek Boulevard frontage.
''She had two suggestions: She expressec'. her concern of deciduous trees
because of dropping leaves and blank visual effect in winter. She would
suggest using one or two deciduous for accent and substituting evergreens
for others. Mr. :Ayers said the two co,.,ld not be mixed. Member Koenitzer
pointed out there was a Texas privet wl_ich is evergreen in each group.
Vice -Chairman Sallan said she was also concerned about on -center spacing.
She reiterated the coi:.mittee's intent v,as not to cover buildings but to
screen cars. Pruning could control height.
1,1r. Myers said the landscape contractor- would fill in if the spacing was
not adequate but they did not want to add plants that are not necessary.
After further discussion, Vice -Chairman Sallan opened the meeting to

Member Weinstein said there was a certain degree of subjectivity to
landscaping® He felt there should be closer spacing of shrubs along
Stevens Creek Boulevards
Member Koenitzer said the plants in the parking lot islands could not
be too high or they would cover.lighting in parking lot.
After a discussion of plant spacing, it was decided that 3' or 4' on
center spacing would be necessary to screen cars.
Member Weinstein moved to approve Application HC-51,015015 subject .to
standard H-Control conditions, according to Exhibit C, 1st Revision
and the following modifications
-(1) Planting of shrubs, particularly xylosma, nandina and
along Stevens .Creek Boulevard be planted on 4° centers
for the purpose of providing screening of the 20 parking
spaces

Staff report, Mr. Cowan noted this application had been continued so
owner could be asked if new sign program could be considered. He. -said
it was the City Attorneys opinion that since the sign is not integrated
into building and application Is for architecture modification, the
committee cannot require sign change. Since new Sign Ordinance is
being discussed, the signs could.be.co.nsidered then.
Member Weinstein asked if there we'reany plans for upgrading this.

IMr. Myers said the tenants o,.an their signs; he was representing the owner,
not the tenant, of the restauranr. He pointed out: Safeway, Ange's and drug
.store are under separate ownership. M_. Myers said the new leases contain
'a clause giving the owner control over signs which the older leases do not.

'A brief discussion was held regarding City jurisdiction to make signs
:conform. Vice -Chairman Sallan noted that some point in the future signs
would have to conform to new ordinance independent of "lease" matter.

3. Application HC-51,311.3 of Mitchell Bagar requesting approval of
site, architecture, landscapin; and grading for one duplex unit
located at the southwest corner of Randy Lane and Hogue Court.
.Staff Report: sir. Cowan referred to variance gran,:ed and the copy of
Resolution No. 1191 attached. The property has a sinr_le family residence
on it which will be used to create a duple_. lie said conditions of approval
in Resolution 1191 are guidelines. It �,as felt the upgrading of the older
residence would improve the neighborhood.
Mr. Cowan also referred to condition 2 which was the retaining of specimen
'trees on site.

Afember Koenitzer questioned how Hogue Court was allowed when house was too
close to street. lie felt this should be more closely checked in the future.

The trees that were to be kept and not damaged were pointed out by
use of slides.. Drawings of proposed architectural changes and
additions were shown.
Mr. Mitchell J. Bagar, 101.29 Randy Lane, Cupertino, signed in.
Member Koenitzer noted that without knowing interior arrangements,
he questioned if it was necessary to have long walls around side of
new duplex. He also questioned lack of yard for tenant.
Mr. Bagar said this had been an oversight by the architect. There
would be a fence separating front --area from rear.
Mr. Bagar explained to Member Koenitzer that the rear door was to.
the garage of the new duplex unit. There is also a door into the
new garage for the old house.
Mr. Cowan said the two units had to be connected; was a technical
requirement.
It was felt a fence should be erected along edge of new yard area.
Mr..Bagar explained how new unit had to fit lot and tie in with
existing building.
The coTm-aittee expressed its opinion that this was a good job of
upgrading, and integrating older structure with architecture in area.
There were no problems with grading. Member Koenitzer pointed out
there should be no cutting around existing elm tree. He would prefer
no more than 1' change in grading.
Mr. Bagar said the grade in front would be altered very little, less
than 4"; new area will have approximately 12" of fill.
Member Weinstein ascertained that two apricot trees and one existing
pepper tree would be eliminated from the site; an existing elm and
two apricot trees would be retained.
The strip between the drivewayswas discussed. mr, Bagar said he
would recommend strip be reduced to 47 from the garage as tenants
would be stepping into planter area from cars. Member Weinstein
felt the strip should be retained. He suggested filling it with
Hahn's ivy and some ground cover.
The landscaping plan for northern elevatilonof.house was discussed.
Vice -Chairman Sallan asked the applicant if he would bewilling to
accept a continuation of landscaping portion of application. Mr.

Member Koenitzer moved to recommend adproval of the site, architecture and
grading of application HC-51,311.3 to the City Council with the standard
H-Control conditions, Exhibits A, B, B-1 and with the following conditions:
(1) That a fence with a gate be extended from the west side of
the new structure to the western boundary dividing yard in
that area into two parts so that one part can be used as
enclosed back yard.

Hogue Court.

40. Application HC-51,015017 of Parham -Cabral Realty
requesting approval of a sign plan for an existing
office building located at the southwestcorner of
Saratoga --Sunnyvale .Road and Stevens Creek Boulevard
in the Crossroads Shopping Center,
Staff report: Mr. Cowan noted this was a request to put- a sign in
phase A of Crossroads Shopping Center. The sign meets with the
technical requirements of ordinance.
Slides were shown of the sign and storefront, It was noted there
are a multitude of signs on fascia.
Member Koen.itzer questioned if any stores had signs hanging from
the canopy. He was told none do, although it was permissable by
ordinance.
Mr. Cowan said there were three alternatives available to committee
(1) approve, (2) approve temporarily until sign program is submittE
or ('3) not approve any sign until owner brings in sign program.
It was noted staff has been trying to talk about changing ordinances
Member Weinstein said the basic problem is the center itse"lf.and
proof_ that strip type centers should not be proliferated. He said
he realized ownership is too: nebulous to justify discrimination
against one applicant.
Vice -Chairman Sallan said she found the committee in a position of
saying "we don't like something, but we will do it".
Enforcement of sign conformance was discussed.

Mr. John G. Parham, 22306 S. De Anza Circle, Cupertino, said he was very
interested in the beautification of Cupertino. He noted he would probabl
spearhead change in center signing.
The sign will contain three names, Parham, Cabral and Cabrillo Realty.
Member Koenitzer ascertained letters of sign are approximately 6" in
height.
After a brief discussion, Vice -Chairman Sallan opened the meeting to
comments from the audience. There were none.
Member Weinstein moved, seconded by Member Dressler, to close Public
Hearings.

Member Weinstein moved that application HC-51,015.17 be approved subject
to standard H-Control conditions and Exhibits F, F1, F-2, F-3. The
motion was seconded by Member Koenitzer.

Vice -Chairman Sallan notified the applicant this would be heard by the
City Council at the September 17, 1973 meeting.
A recess was taken at 9:35 p.m. with the meeting reconvening at 9:43 p.m.
Staff member Cowan said the Sumitoma Bank had requested a slight modifi-
cation in architecture. The approved plan and the proposed plan were
then exhibited.
Mr. Mitsuru Tada and Mr. Wing Lo, representing the Sumitoma Bank,
explained proposed modification. Mr. Tada noted they were proposing to
eliminate 6' overhang on south side facing service station. He pointed
out smaller windows for privacy and security. They had reduced amount
of glass on west side which would be facing shopping center; also the
amount of glass by drive up because of security reasons.
Member Dressler ascertained 20' of overhang was being removed. Mr. Tada
explained too much overhang distracts from beauty of northern elevation.
After further discussion, Member k:oenitzer moved to approve proposed
modification. Seconded by Member Dressler.

UNFINISHED BUSINESS:
7. Discussion of final draft relative to Design Criteria
Guidelines for the northwest quadrant of the intersection
of Saratoga -Sunnyvale Road�an.d Stevens Creek Boulevard.
Mr. Cowan referred to memorandum and enclosed draft. After a
detailed discussion, the following changes and additions were made:
1. Building and Landscaping Setbacks
a. All building setbacks on properties facing Stevens
Creek Boulevard shall be a minimum depth of twenty-
five (25) feet from property line and not greater
than forty (40) feet from property line.

d. The landscaped area along Saratoga -Sunnyvale Road and
Stevens Creek Boulevard shall have a minimum setback
area of thirty (30) feet measured from curb to back of
landscaped area. The type and material of landscaping
contained in this area shall conform to the plan prepared

Design Project.

5. Wining
a. All ;round signs for the site shall be "low profile monumental"
signs of 6' height with absolute maximum of 8'.
b. All signs will be determined by each applicant in accordance
wita the type and size o` the establishment. The use of
natural materials, like ,.00d should be encouraged on all
signs t•:herever possible.
Member Koenitzer said that station referred to at last meeting on corner
of Stevens Creek: Boulevard and Saratuga-Sunnyvale Road had even more
signs posted.
ilember Koenitzer noted the station a� Homestead Road and Highway 9
still had a pile of old tires and wracked autos on their lot.
Member Koenitzer asked if the newspaper representatives had met
with regard to racks on public streets. Mr. Cowan said this was
in the process of doing so.
Member Weinstein suggested the City hire a consultant on optics and
illumination for the purpose of writing an ordinance if the budget .would
permit. Member Koenitzer noted this vculd require purchasing equipment
and having someona calibrate. Staff is to check.
It was suggested that the coatmittee review the sign ordinance independently
and present written material to staff. 11r. Cowan suggested the sign ordinance
could be discussed piecemeal at end of the meetings. Vice -Chairman Sallan
suggested having copies of what has hef_n done by individual coTiniittee members
and initial draft presented at next rieeting.
The request was made of staff to get slides of low profile signs in
other cities.
At 11:30 p.m., Member Koenitzer moved, seconded by Member Weinstein, to
adjourn to the next regular meeting on September 19, 1973 at 7:30 p.m.
