PUBLIC HEARINGS
1. Application HC-51,002.5 of T. Zubrycky and Sons requesting approval
of site, architectures landscaping, and grading and undergrounding
of utilities for a triplex located in Tract 2769, Lot 47, La Cresta
Subdivision, Alpine Drive. Referred back to H-Control from City
Council meeting of 11arch 5, 1973.
Mr. Cowan reviewed this application, the reasons for its being returned
to ASAC, and the Council's concern for a compromise between the applicant
and the homeowners to the rear. He referred to Exhibit D-1 which
diagramatically describesthe visual line of sight from the second floor
balconies. It is the applicant's i.ntenc to show that the 10' trees
to be planted along the rear property line will cut this line of vision.
It was recommended this contention be investigated and confirmed by a
State licensed architect. The present fence of 4-1/2' is to be recon-
structed to a height of 6'.
In answer to Chairman Sargent, '1r. Cowan said the trees discussed were
Dwarf Eucalyptus and the on center measurement was 5'.
Mr. James S. Watterson, 465 S. Mathilda Avenue, Sunnyvale, representative
of Mr. Zubrycky, signed in. He pointed out the existing units on Alpine
Drive are 20' from the property line with balconies approximately 15'
from property line. The proposed apartments will be 30' from the property
line.
Mr. Watterson then showed slides taken standing on a ladder of approxi-
mately 15', the same height of a 6' person standing on the proposed
balcony. He indicated a 10' pole at rear of property with a crossbar
representing the 6' fence. After showing slides of adjacent houses and
lots, he showed slides on which the proposed fence and trees had been
blocked in. He also showed a side of several Dwarf Eucalyptus trees
approximately 3 years which stoodi 15' to 20' tall.
c1r. Watterson expressed the opinion that this would be a reasonable
solution to the problem as it avoided loss to the applicant since the
view was of value, and the proposed triplex would add to neighborhood
as regarding appearances.
Chairman Sargent then opened the hearins for comments from the audience.
Mr. Ronald Schwartz, 10347 Vista Knoll. Drive, Cupertino, then spoke.
Ile did not feel the applicant h,a proposed the change expected by
City Council. He questioneu- the pictures as representing view from
balcony. He showed slides he had taken of views from his backyard

intruded upon. He expressed his disbelief that the plantings would

After more discussion, Member Sallan asked M Schwartz if he felt
any size planting would do the job. Mr. Schwartz said he agreed
plantings were a nice feature,,but could not make up,for a poor
plan.

there will always be this problem. The committee could not go to

involved,, He expressed, his opinion the applicant had provided
information.in good faith as to what could Iie. done.. He noted the
three changes offered. (1) The set --back of 30' instead of 201,
(2) A balcony that is solid, (3) Plantings which are required to:
be 10' tall when planted.- He also noted the trees selected are of
a round shape., rather than cone -shaped, providing a more dense screen.
The committee expressed their concern for this problem and suggested

Mr. Cowan noted the application had_ been continued because of the
applicant's absence. The co_._mittee. had expressed its concern regard-

entrance, The Ordinance allows for one sign. Applicant would have

Member Koenitzer said he liked the wrought iron signs and felt they
identified 'the apartment complex and saw.no need for additional signs
Member Salla.n agreed and Chairman Sargent said the wrought iron signs
were what is desired for Cupertino. Mr. Smith said they had a
problem with the ground lights which illuminated the wrought iron
signs being stolen and that the height of the -trees hid these 'signs.
Chairman Sargent noted an exception to the ordinance should be filed,
Mr. . William Ward, 14116 Seven Acres Lane, Los Altos Hills, said the
problem was the wrought iron letters are only 6" with the exception
of the "VZ1 which is 13" and people don't see them. They need some
type of identification. They have 500 residents and 120 units for
rent each year; In answer to. Member.McLaren, Mr. Ward said they
have a turnover of approximately 15-20 units a month.

Chairman Sargent then said if the applicant intended to file for Guidelines
an exception., the committee could give some guidelines. He noted
that some members of the committee felt the wrought iron signs
were adequate identification, Member Koenitzer said, he -would like
to see a sign to fit in with masonry wall of a much lower design,
not over 6`` and standing on base similar to the wall.
Mr. Smith said they had discussed signing with City Hall and had Sign not
.gone ,into ordinance very carefully. He understood they were allowed seen
a sign of 25 sqa foot measurement If the sign were any l'm7er, it
would not be seen;

make new casting.
Chairman Sargent summarized by saying both temporary signs and flag-s Summary
should come down. He recommended this application be continued.. He
noted that according to.ordinance they could have one sign; there are
already three wrought iron signs The committee' agreed that to re, -
move the wrought iron signs would be expensive and too bad since
they are attractive. He noted identification needs had to be weighed
against consideration of people living in Cupertino. Size of signs
are .being reduced because it is felt to be an improvement toward. less ;
glaring identification, and more attractive to the City. He suggested
if they wished to file for.: exception, they. should contact City Staff.

and be more aesthetic,
Member Sallan asked about south gall area. She would like to see
another planter box along .the gall Nor; Won- said he didn't know
if there would be room as there might be a sa-rety factor involved
since this would be a walkway area. Member Dressler said he liked
the architecture by itself without ' more plantings.
Member Sallan said'Staff had suggested reducing width to the smallest
size possible, Chairman Sargent expressed appreciation to Mr; Wong
for voluntarily lowering sign in line with desired signing for this area.
