A RESOLUTION OF THE CUPERTINO CITY COUNCIL AUTHORIZING
THE CITY MANAGER TO VOTE "YES," AND SIGN AND SUBMIT THE BALLOTS
ON BEHALF OF THE CITY FOR THE PARCELS OWNED BY THE CITY THAT
ARE SUBJECT TO THE PROPOSED 2019 CLEAN WATER AND STORM
PROTECTION FEE
WHEREAS, the City of Cupertino has initiated a ballot proceeding to establish a
Clean Water and Storm Protection Fee;
WHEREAS, the ballot proceeding requires that ballots be mailed to the owners of
all parcels that are subject to the proposed fee, and those ballots must be signed by the
property owner or an authorized representative of the owner;
WHEREAS, the City owns 42 parcels that are subject to the Stormwater Fee, and
the City Council wishes to cast an affirmative vote for each of the 42 parcels and authorize
the City Manager to sign those ballots on behalf of the City Council; and
WHEREAS, the Clean Water and Storm Protection Fee Measure will fund needed
maintenance and operations of the City's Clean Water and Storm Protection system and
efforts to ensure that storm runoff meets strict State and Federal clean water standards to
protect our local creeks and San Francisco Bay.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Cupertino that the City Manager is directed to indicate a "yes" vote on the ballots
representing the 42 City-owned parcels.
BE IT FURTHER RESOLVED that the City Manager of the City of Cupertino is
hereby authorized to sign those ballots and submit them to the City Clerk prior to July 5,
2019 at 5:00pm.
