CC Resolution No. 9582 • e RESOLUTION NO. 9582 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTMO MODIFYINC3 THE CONDITIONS OF APPROVAL FOR USE PERMtT APPLICATION 4-U-85 OLA HASSAN (FORMERLY SNEAKERS OF NORTHERN CALIFORNIA) WHEREAS, the Director of Community Development determined thnt substAntial evidence indicated that unlawful activities related to the Ola's Caribbeun, Cajun and African Restaurant was detrimental to the public health, safety and welfare, and WHEREAS, the Director of Community Development scheduled a public hearing before the Cupectino City Council on March 4, 1996 to consider whether the use permit has been conducted in a manner detrimental to the public health, safety and welfare, and WHEREAS, Mr. Ola Hassan asked for and was granted u continuance of said hearing from March 4 to Macch 18, 1996, und WHEREAS, the Ciry Council reviewed and evaluated written, and graphic information together with verbal testimony from public officials, the use permit applicant and other i~terested parties, NOW, THEREFORE, BE IT RESOLVED, that the City Council hereby modiftes conditional Use Permit 4-U-85 based upfln the following findings and conditions. FMDINGS: 1. The City Council wnducted two previous revocation hearings on September 19, 1994, and November 21, 1995 to consider means to more effectively control the subject restautant/bar to reduce disorderly conduct. In each instance, the Ciry Council modified the use permit to impose more effective security measures. 2. Santa Clara County SherifTs records demonstrate a wntinued pattem of unlawful ' activity resulting from the operation of the subject faciliry. The unlawful activity results in public safety problems und abnormally high policing costs. The public safety concern is heightened by a February 6, 1996, incident involving the discharge of appmximately 17 rounds from a fire arm. 3. A Hewlett Packard representative submitted correspondence to the City descnbing the threat to their employees as a result of the operation of the restaurant/baz facility. . . . . ::...t ~ ~.:.n y w 2'~.._ .$P .Y:f~^~"'.. , ? • • AMENDMENT TO THE CONDITIONS OF APPROVAL TO APPLICATION 4-U-85. 1. The hours of operation described in Condition 17 of Planning Commission Resolution No. 260? upproving 4-U-85 is umended as follows: The hours of operation arc limited to the hours of 6:00 a.m. to 10:00 p.m. duily.
