A RESOLUTION OF THE C[TY COUNCIL OF THE CITY OF CUPERTINO
ACCEPTMG QUITCLA[M DEED AND AUTHORIZATION FOR
UNDERGRQUND WATER RIGHTS FROM MARC MCGEE AND KRISTI
A. MAILHOT; APN 357-08-013; LOCATED AT 10250 SCENIC BOULEVARD
WHEREAS, Murc McGec and Kristi A. Muilhot, Grantors, hovic executed a
"Quitclaim Deed and Authori7ation", which is in good and sufficient form, quitclaiming
all their rights in and authorizing the City of Cupertino, County of Santa Clara, State of
Califomia, to extract water from the underground basin, underlying that certain real
property sittwte in the City of Cupertino, more particularly described in the attached
Exhibit "A" and Exhibit "B", as follows:
All that certain real property situate in the City of
Cupertino, County of Santa Clam, State of Californi~, us
shown and delineated on the nttssched attached Exhibit "A"
~ and Exhibit "B".
NOW,1'HEREFORE, BE IT RESOLVED, that the City of Cupertino accept said
"Quitclaim Deed and Authorization", so tendered;
IT IS FURTHER RESOLVED that the City Clerk is hereby authorized to record
said "Quitclaim Deed and Authorization^ and this resolution.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Cupertino this 16th day of JunuAry, 1996, by the following vote:

day of ~C~~'E? 199 hereby grant, bargain, assign, convey, remise, release and forcver
quitclaim unto the CITY OF CUPERTIIJO, a municipal corporadon, hereina@er referred
to as the "GRAIVT'EE", its successors and essigns, all the right, titlq interest, estatq claim
and demand, both at law and in equity, and as well in possession es in expectancy of the
GRANPOR as owner of that certain real property situate in the County of Santa Clara,
State of Califomie, and specifically described as follows:
SEE ATTACI~D EXHIBIT "A" & "B"
to pump, take or othervvise extract water from the underground basin or any underground
strata in the Santa Clara Valley for bene6cial use upon the lands ovedying said
underground basin, and GRAIVTOR hereby irrevocably authariz~ C,~E~ ity
saccessors and assigns, on behalf of the GRANfOR and its successors in ovmership or
ovedying Iands in the said lots to take from said underground basin within the said lots any
and all water which the owner or ovmers of said overlying lands may be entitled to take
for beneScial use on said lands and to supply such water to such owner or owners or
others as a public utility; provided, however, that nothing contained in this instrument shati
bc deemed to authorize GRAI~TPEE to enter upon any of the lots delineated upon the
above descdbed map ar to suthorize GRANTEE to make any withdrawal of water which
will result in damage to any building or st~vccure erected upon said lots.
