The cross-scr-tion of Pla.ry Avenue needs a few more feet width at the intersections to be safe, but can be narrower between intersections; a detailed layout is needed. The Director of Planning explained that a standard tract development is governed by strict and specific regulations, but the cluster concept is flexible. A. dcvel..oper can make a Development Plan, and with this plan ao a basis, ask for vari. ti_ons from the Cluster Ordinance. In this case, the applicant statod that it would be too Much work and expcnr>e to prepare a development plan for the ent4.re area at this time. The Planning Commission w:nt along with this, allowing final Development Plana to be submitted in stagr.s. Mayor Dempster said he understood the applicant's proposal is that it be made some sort of Ordinance. He feels that as long as they have the PC-Ii zoning, why can we not, based on the assumption that this plus any conditions the City Council requires, be made a part of the Use Permit. The City Attorney said that the Use Permit was recommended by the Planning Commission, subject to certain conditions. The applicant has cope up with a counter Resolution. The City Attorney said the City Council_ world have the power to amend the Resolution presented by the Planning Commission. The Director of Planning emphasized that the Planning Commission should see the detailed Development Plans. The applicant_ should take the Cluster Ordinance and ask for variations, paragraph by paragraph. Mr. Robert Costello, attorney for the applicant, said they have no ob- jections to procedural adjustments. He said that tha Resolution he drew up does, as much as was possible, go through the Cluster Ordinance and indicate variations required. Mr. Mittelman said it was their feeling that the Development Plan should be made a part of the Tentative Map and be required at that time. Comm. Frolich said that, somewhere along the line in a PC-H Zone, a map must be submitted. Some kind of label is required, and the Planning Commission f_lt that RI.0 came closest to what the applicant is proposing. The City Attorney said that he has always been in favor of calling it R-1 with Variances. Mr. Costello agreed with Comta. rrolich that they are varying off the Cluster Ordinance. He submitted that the PC•11 Ordinance does not say that the regulations for a specific Zone must be followed. Mayor Dempster askad the Director of Planning what is there that is different about this Resolution proposed by the applicant. The Director said that by subtle charges in wording the City can lose control of the standards. Mayor Dempster wanted specifics. Councilman Finch felt that if a detailed Development Plan .had been pre- sented as req.a.ired soma of the "vagueness" would have been eliminated. Mr. Costello said the ap-plicant would sub -fait a Development Plan as de- tailed as possible at: this time and c^me, back in with a more detailed one at the proper time. Comm. FrolicIh did not ar;rse with the idea that the applicant be allowed to present a whole- new list of rules tl--.at he has set, up; this would set a precedent that could cLuse a lot of headaches for the City. Ccatello said in the "Use" section t1j:1ey could say RIC to simplify the whole thing. Councilman Fitzgerald said that somewhere, the City made a mistake. There is no record of a Tentative Map on -the Stcneson property and recorded Minutes indicate non.. Mayor Tsempst r called for a break at 9:30; meeting reconvened at 9:50 P.1M. Councilman Finch suggested the applicant take the Plannin; Commission Resolution No. 301., under RIC; analyze it; and write down, point by point, those things with which they cannot agree. Mr. lsittelman said they have done essentially that, and came up with the Resolution which was presented by them. Mr. Costello said the RIC will control the use of this land; the next step is to go down each clause and set out -i:hat Variances are needed. He added that he does not feel all the Cluster Ordinance applies. These are incorporated in his Resolution, verbatim or with slight: revisions: 1.4; 15, 19, 23, 26, 29, 30, 32, 33, 34, 37, 38, 39, 40, 42, 43, 44, 45, 47 and 48. Councilman Finch suggested that the Planning Commission, the City Council and the staff sat down with Resolution No. 301 and go over it, point by point. The applicant is welcome to come, also. This might be handled eypeditiously at a joint meeting. The City Attorney said the City Council can decide this, or can refer it back to the Planning Commission, whichever they see fit. The staff was instructed to review: Resolution No. 301, the Cluster Ordinance and variations that they can go along with. IV MISCELLANEOUS The following Minute Order was requested by the Director of Public Works: Moved by Councilman Finch, seconded by Councilman Stokes, to approve entering into a contract with Leonard Construction Company, 9 Rancho Del Mar, Aptos, California, for the construction of "Mary Avenue Main (2" Water Service)t° in the amount of $5,437.80.
