He said this was premature; that the money has been budgeted for this project. Moved by Councilman Finch, seconded by Councilman Fitzgerald, to approve the Minutes as corrected. Motion carried, 4-0 IV ORAL AND WRITTEN COW. JNICATIONS WRITTEN: 1. Application from Lloyd Hines for the Planning Commission vacancy. 2. Letter from San Francisco Football Team regarding franchises for community antenna service. The City Manager suggested this be referred to the City Attorney for his review and report. The City Council felt that, since Cupertino has no community antenna service, there is no reason to go into this further. 3. Memo from the County Economic Development Association. 4. League of California Cities communication, asking for names of officials who are interested in serving on League committees. 5. P.esolutien from City of Escalone in regard to lnwlessness, holders of public office, etc. -1- 6. Resolution from City of San Mateo supporting the Armed Forces in Viet Nam. 5 Moved by Councilman Finch, seconded by Councilman Noel, that the written communications be received and filed. Motion carried, 4-0 ORAL COMMUNICATIONS There were none. V A. REPORT OF PLANNING COMMISSION (See Minutes of November 8, 1965) Comm. Traeumer reported that, with the resignation of Chairman Gates, the Commission voted to have Comm. Johnson complete the term as Chairman and Comm. Hirshon complete the term as Vice -Chairman. Comm. Traeumer then recapped the Planning Commission's Hearings on last week's agenda. 1. Pacifica Partnership: Application 17-U-65 for a Use Permit, Medical -Dental Building at Pacifica; PC-H Zone. Approved by Planning Commission Resolution No. 308. MINUTE ORDER: Moved by Counc. Finch, seconded by Counc. Noel, to grant the Use Permit 17-U-65 as per Planning Commission Resolution No. 308. AYES: Counc. Finch, Fitzgerald, Noel, Dempster NAYS: None ABSENT: Counc. Stokes Motion carried, 4=O 2. Diversified Properties: Application 21-V-65 for a Variance to Increase Height of Shopping Center Pole Sign to 25' at 10021- 10071 South Blaney. Approved by Planning Commission Resolution No. 309. Mr. Robert Stare, 3275 Stevens Creek Blvd., San Jose, was present to speak for the applicant. Councilman Noel asked what would go on this sign. Mr. Stare said leases have already been let to the Stop and Go Market, a beauty shop, and a real estate office. The others have not yet been leased. These shops are behind the Burger Pit. The old shack adjacent to tae Nite Kap further obscures the view of these shops from Stevens Creek Blvd. Counc. Fitzgerald asked what effect this sack's going down would have on this application. Mr. Stare said he would be happy to forget about the sign Variance if the shack were removed. He said he was told, before this shopping center was built, that the shack would be condemned and torn down. The Chief Building Inspector said the shack is built of rood exter:x.o ^, but has a sprinkler system in it. The building will stand until th,- owner decides.to remmove 1 t. The owners appeared before the H-Control and they decided to upgrade the shack rather than remove it at this time. Councilman Noel wondered how this Variances could be granted when, not to long ago they turned down one for the Cupertino Nursery. n Councilman Fitzgerald said that a year ago,.the Council offered to get together with the sign_ companies, to try to come. up w:i.tti some feasible chr'lnge's to the Sign Ordinance, but nobody turncd.,t_.j.). CutinCilmait Finch felt this was the concern of the -businessmen and the Council; the 'si n companies only 'do as they are instructed. It was pointed out by the Chief Building Inspector that the Urich Service Station, Burger Pit, and the Shopping Center across .the Blvd..all have 20' signs and he does not feel this Variance is. warra-ated. Moved by Councilman Fitzgerald, seconded by Councilman Noel, to deny application 21-V-65. AYES: Councilmen Fitzgerald, Noel, Dempster NAYS: Councilman Finch ASSENT: Councilman Stokes Motion carried, 3-1. B. REPORT OF THE ARCHITECTUPAL AND SITE APPROVAL COMMITTEE (See Minutes of November 9, 1965) Chairman Horgan said he had.received a call from Mr. Chrisman that day stating that the entrance sign under application 206-•HC-65 is still undecided and requested approval of it be withheld. So moved, by Councilman Finch, seconded by:Councilman Noel.. Motion carried, 4-0 In regard to application 207-HC-65, for the La Cresta entrance sign, the Chief Building Inspector said the H-Control had approved 5' x 11' signs, which is 5 sq. ft. more per sign than allowed under the Sign Ordinance. Councilman Fitzgerald felt we should stick to the Sign Ordinance. Mr. Robert Bradford, 10256 Alpine Drive, displayed a picture of the permanent entrance signs and stated it would then throw them out of`proportion if they dropped it any lower. Councilman Fitzgerald withdrew his opposition. Moved by Councilman Finch, seconded by Councilman Fitzgerald, to approve the H-Control Minutes of November 10, 1965, except for 206-HC-65, which application was withdrawn. VALLEY TITLE COMPANY (Page Properties): t3- 14Cation 8=U=65, for a Use Permit for a 50-acre one -family Cluster Development within s. PC-H Zone, east of.k.zry Avenue, north of Stevens Creek Blvd. Approved by Planning jCbmmission Resolution No, 30.1. Appeal re conditions '(continued, from -:November 1st.). Mr. Irwin Mittelman, 1050 University Drive,' Menlo Park, showed colored slides of typical developMeats, similar to the typca thay have plan-acd for this site. Re emphasized the park -like atmcs.phere of the common greens and the private patios for individual units. -3- 1`, Mr. Robert Costello, Councel for the applicant, was Assistant Chief City Attorney for San Jose for 10 years, and subsequently was City Attorn-.,, for Redwood City. IIe said this is a. uni.q::e, sophisticated development planned for Cupertino. Because it is new, it is not the eas "V.est thi.n.- to integrate all the elements that go into its.size and type., We muat achieve now that degree of certainty from the City to convince the financing institutions and others that it is feasible. He then went over the Cluster Ordinance and the Planning Commission's Resolution No. 301, pointing out what he felt were vague points, and asked that the City Council clarify them so that they will have a sound foundation on which to proceed. He felt that the Resolution, drawn up by the applicant, reflects a compromise.on.their part. Mr. Costello said they already have PC-H zonirg and doubts the validity that Resolution No. 301 should rezone that which is already PC-H. He objects to having to bring the Development Plan in for approval, step by step. He challenged many parts of the Cluster Ordinance, saying th,�;y are vague and indefinite. He said the applicant is more concerned with procedure and form than they are with substance in the Resolution. Councilman Fitzgerald asked whether this project could be developed under R-24, over and above this Cluster Ordinance. Mr. Costello said the difficulty is lumping Cluster R-24 and PC-H. Some R-24 conditions would be just fine, others difficult. They would rather go by the Resolution which the applicant has presented, which reflects compromise. Councilman Fitzgerald asked the Planning Director if this Resolution is a reasonable compromise. The Planning Director said some compromises were made. If the applicant had followed the Cluster Ordinance and stated the variances needed, paragraph by paragraph, it would be more acceptable by the City. Mayor Dempster asked where the differences are. The Planning Director said time had not allowed a thorough investigation, since he has received a copy of this final resolution offered by the applicant, because there are differences in many paragraphs. One main difference is in the width of Mary Avenue. The applicant proposes 70' with 80' at inter- sections; the Planning Director feels 80' and 90' in some portions will be needed. The Director of Public Works said that, basically, he agrees with the Planning Director. Councilman Finch said the staff could not be expected to analyze an Ordinance presented by the applicant in so short a time, when it takes six months for us to prepare an Ordinance. Mr. Mittelman said he has discussed these changes with the City Staff as they went along. The Planning Director said he could study the ramif ications:this latest Resolution within two weeks. Councilman Finch and Fitzgerald felt that this would make a tool with which to work. Councilman Fitzgerald asked the Planning Director if the staff could control this project under P, 24. The Director said that it would be difficult. Mr. Mittelman said the intent was to get as broad an interpretation as possible. He also stated that this will not set a .precedent since there is no other piece of property in the City of Cupertino, outside the Town Center, that is of comparable size. The City Attorney said that he had had numerous conferences with the applicant and the Planning Director on this application. The label in the nature of a residential use in a Planned Community is important. He had suggested R-1 with Variances. Mayor Dempster and Councilman Finch were in favor of setting this for a study session. Councilman Finch felt strongly , tha.t the staff should give advise to the Council on this.. Mr.. Costello said he had no objections to having the staff loot: into this further. he emphasized that defini- tions and certainty are a must. -4- The Ad4ourned City Council meeting was set forTuesday, November 23rd., 8:00 P.M., the City Manager to arrange a meeti_n- place and notify everyone. The Planning Commission is to be invited to this meeting. The Planning Director, in regard to the applicant's reference to vagueness, said the reason for that is that a Development Plan would be required. The applicant suggested the Development Plan could not be ready all at once, and offered to bring it back in, step by step. B. ANNEXATION: Approving the Annexation of Certain Contiguous Uninhabited Territory Designated "Merriman 65-3" to the City of Cupertino. (Ordinance No. 322) The City Clerk stated there were no written protests. Mr. R. H. Cromwell, 10520 Merriman, Cupertino, said he is the owner of the property in question. He said that when the new legal description came out there was a discrepancy of four feet. The City Attorney advised it should be put over for two weeks, to enable the staff to straighten it out. So moved, by Councilman Finch, seconded by Councilman Noel.: C. ORDINANCE 220F: Amending Ordinances No. 002 and 220, Introducing Standardized Zoning Symbols, and Introducing Zones for Public Buildings, Quasi -Public Buildings, and Transportation. (First Reading) The City Attorney said that, since this is a standard Ordinance, it would be in order to have it read by title only. Moved by Councilman Finch, seconded by Councilman Noel, to have Ordinance No. 220F read by title only. Motion carried, 4-0 This was done by the City Clerk. VII ORDINANCE AND RESOLUTIONS FOR ADOPTION A. ORDINANCE NO. 323: Rezoning Property of Joseph Dumont from R-3-H to C-1-H; 1 lot, 20532 Kirwin Lane. Second Reading. Moved by Councilman Finch, seconded by Councilman Noel, that Ordinance No. 323 be read by title only.
