CC Resolution No. 9269 RESOLUTION NO. 9269 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO AUTHORIZING THE FILING OF A CLAIM WITH THE METROPOLITAN TRANSPORTATION COMMISSION FOR ALLOCATION OF TRANS- PORTATION DEVELOPMENT ASSISTANCE FUNDS FOR FISCAL YEAR 1995-96, FOR INSTALLATION OF HANDICAP RAMPS AND WHEELCHAIR DETECTORS WHEREAS, the Transportation Development Act (TDA) (Pub, Uti\. Code 99200 ª ~,), provides for the disbursement of funds from the Local Transportation Fund of the County of Santa Clara for use by eligible claimants for the purpose of the installation of pedestrian and bicycle facilities; and WHEREAS, pursuant to the provlSlons of the TDA, and pursuant to the applicable rules and regulations thereunder (21 Cal Adm, Code 6600 ª ~,), a prospective claimant wishing to receive an allocation from the Local Transportation Fund shall file its claim with the Metropolitan Transportation Commission; and WHEREAS, TDA funds from the Local Transportation Fund of Santa Clara County will be required by claimant in Fiscal Year 1995-96 for installation of pedestrian and bicycle facilities; and WHEREAS, the City of Cupertino is an eligible claimant for TDA funds pursuant to PUC Sections 99233.3 as attested by the City of Cupertino's opinion of counsel dated December 21, 1993; NOW, THEREFORE, BE IT RESOLVED, that the City of Cupertino City Council is authorized to execute and file an appropriate TDA claim together with all necessary supporting documents, with the Metropolitan Transportation Commission for an allocation ofTDA funds in Fiscal Year 1995-96, BE IT FURTHER RESOLVED that a copy of this resolution be transmitted to the Metropolitan Transportation Commission in conjunction with the filing of claim; and the Metropolitan Transportation Commission be requested to grant the allocations of funds as specified herein, PASSED AND ADOPTED at a regular meeting of the City Council of the City of Cupertino this 17th day of January , 1995, by the following vote: RESOLUTION NO, 9269 YQ1!: AYES: NOES: ABSENT: ABSTAIN: Members of the City Council Bautista, Burnett, Sorensen, Dean None Koppel None ATTEST: APPROVED: /s/ Kim Marie Smith City Clerk /s/ Wally Dean Mayor, City of Cupertino
