RESOLUTION NO. 9219
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO APPROVING OF THE
GUIDELINES FOR THE PLACEMENT AND DESIGN OF RECYCLING AREAS IN DEVELOPMENT
PROJECTS
WHEREAS, on Oc t . 17 , 1994, the City Council reviewed and recommended approval of
Ordinance No. 1671 which adds Chapter 19.81 to the Municipal Code and implements State law regarding the
provision of adequate and accessible areas for collecting and loading of recyclable materials in development
projects; and
WHEREAS, the siting, design, construction and accessibility of recycling areas and enclosures shall be
subject to City approval, in accordance with design guidelines to be adopted by the City Council.
WHEREAS, guidelines are at this time the most appropriate means to address the siting, design,
construction and accessibility of recycling areas for the following reasons:
a) That the type and amount of recyclable materials generated varies from business to business;
b) That new technologies and processes will eventually increase the proportion of solid waste that
will be useable and marketable as recyclable materials;
,c) That the means of collection may vary from recycling vendor to recycling vendor; and
d) That the use of guidelines will increase the City's flexibility to respond to changes based on
experience and new infonnation.
WHEREAS, the City Council and Planning Commission allows staff at its own discretion to make
additions, deletions or modifications to these Guidelines as needed.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Cupertino hereby adopts
the City of Cupertino Recycling Areas Design Guidelines as described in the attached Exhibit I.

Recycling Areas Design Guidelines
SECTION I: GUIDELINES FOR ALL DEVELOPMENT PROJECTS
A, Recycling areas should be designed to be architecturally compatible with nearby structures and with
the existing topography and vegetation.
B. 1)1e design and construction of recycling areas shall not prevent security of any recyclable materials
, placed in the receptacles provided.
C. The design, construction, and location of recycling areas shall not be in conflict with any applicable
federal, state, or local laws relating to fire, building, access, transportation, circulation, or safety.
D. Recycling areas or the bins or containers placed therein must provide protection against adverse
environmental conditions, such as rain, which might render the collected materials unmarketable.
E. Driveways and/or travel aisles shall, at a minimum, confonn to local building code requirements for
garbage collection access and clearance. In the absence of such building code requirements,
driveways and/or travel aisles should provide unobstructed access for collection vehicles and
F. Directional signs clearly identifying all recycling and solid waste collection and loading areas and
the materials accepted therein shall be posted adjacent to all points of direct access to the recycling areas.
G. Developments adjacent to recycling areas shall be adequately protected from any adverse impacts such as
noise, odor, vectors, or glare through measures including, but not limited to maintaining adequate
separation, fencing, and landscaping.
H. Table A provides an example of the minimum interior space recommendations for a combination
recycling and trash area enclosure. Applicant may propose an alternative arrangement of space based
on the project's specific recycling and trash volumes.
SECTION 2: ADDITIONAL G1 JIDELINES FOR SINGLE TENANT DEVELOPMENT PROJECTS
A. Areas for recycling shall be adequate in capacity, number, and distribution to serve the development
project.
B. Dimensions of the recycling area shall accommodate receptacles sufficient to meet the recycling needs
of the development project.
C. An adequate number of bins or containers to allow for the collection and loading of recyclable
materials generated by the development project should be located within the recycling area.
SECTION 3' ADDITIONAL GUIDELINES FOR MlJI.TIPLE TENANT DEVELOPMENT PROJECTS
A. Recycling areas shall, at a minimum be sufficient in capacity, number and distribution to serve that
portion of the development project leased by the tenant(s) who submitted an application or applications
resulting in the need to provide recycling area(s) pursuant to Section 19.81.030 of the Municipal Code.
B. Dimensions of recycling areas shall accommodate receptacles sufficient to meet the recycling needs of that
portion of the develcpmentproject leased by the tenant who submitted an application or applications
resulting in the need to provide recycling area(s) pursuant to Section 19.81.030 of the Municipal Code.
C. An adequate number of bins or containers to allow for the collection and loading of recyclable materials
generated by that portion of the development project leased by the tenant(s) who submitted an application
or applications resulting in the need to provide recycling area pursuant to Section 19.81.030 of the
Municipal Code, should be located within the recycling area.
