RESOLUTION NO. 9212
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
ACCEPTING A GRANT OF EASEMENT FOR CONSERVATION PURPOSES
FROM ISHW AR PRASAD MURARKA AND RAGINI SHAH MURARKA, AS
CO-TRUSTEES OF THE MURARKA 1994 LIVING TRUST, 10446 SAN
FERNANDO AVENUE
WHEREAS, Ishwar Prasad Murarka and Ragini Shah Murarka, as Co-Trustees of
the Murarka 1994 Living Trust, Grantor, have executed a Grant of Easement, an
easement for conservation purposes over the property situate in the City of Cupertino,
County of Santa Clara, State of California, more particularly described in Exhibit "A"
and Exhibit "B", attached hereto and made a part hereof:
All that certain real property situate in the City of
Cupertino, County of Santa Clara, State of California,
consisting of approximately 0.006 acre, located at 10446
San Fernando Avenue.
NOW, THEREFORE, BE IT RESOLVED, that the City of Cupertino accept said
Grant so tendered; and
IT IS FURTHER RESOLVED that the City Clerk is hereby authorized to record
said Grant of Easement and this Resolution.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Cupertino this 17th day of October ,1994, by the following vote:

adequate root mass of the trees by an ISA Certified Arborist
agreed upon by the prcperty owner ani the Cœm..uú.ty
Develcpoont Director.
g. Construction which causes the rE!IIDVëÙ of JOOre than 15% of
the absorb~ root mass of any tree is prdùbited.
h. C11an;¡e of soil grade beneath the canopy, ani within 10 feet
of the canopy is prdùbited.
2. Public utility cx:.upanies shall not be allCMed to trench in the
designated easeJreI1t area nor shall they be allCMed to place wires
above the trees ani within the easement.
Grantor hereby fUrther grants to Grantee a right of reasonable access
ani privilege to enter upon his lan::1s =ntiguous to ani along the line of
said hereinabove described strip f= the purpose of inspection.
It is urrlerstood that the existirg concrete walkway lcx:ated on the
sa.rt:herly side of the prcperty, within the hereinabove described
=nservation easement, is allowable until such tÍlæ as it is replaced.
